PROJECT DESCRIPTION: WDD Range Cattleguard Purchase

GENERAL

(a) The Bureau of Land Management (BLM) is seeking quotations for supplies listed in the accompanying continuation documentation.

The BLM intends to conduct this acquisition by use of simplified acquisition procedures in accordance with FAR Part 13. A single contract award will be made to the responsible quoter whose quotation represents the best value in accordance with the evaluation methodology outlined in the “basis for contract award.”

(b) To assure timely and equitable evaluation of quotations, respondents are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete quote. Respondents are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and any stated technical requirements. Failure to adhere to solicitation requirements, at the time of submission, may result in a respondent’s quote being deemed unacceptable to the Government and the respondent may be eliminated from award consideration. It is the responsibility of respondents to ensure their quote is received by the Government at the designated due date and time.

(c) Quoters are cautioned to submit adequate information to enable the Government to fully ascertain each respondent’s capability to perform the requirements in accordance with the requirements of the request for quotation (RFQ).

(d) If a respondent believes that requirements in these instructions contain an error, omission, or are otherwise flawed, the respondent shall immediately notify the contracting officer via email with supporting rationale prior to the question deadline specified on the cover page of this document.

(e) This RFQ does not commit the Government to any costs incurred during the preparation and submission of quotes or for any other costs incurred by any firm submitting a quote in response to this solicitation. Note specifically that the respondent will not be participating in a sealed bid procurement process. Issuance of this RFQ does not constitute an award commitment on behalf of the Government.

(f) Quotations must be valid for a minimum of 60 days.

(g) Respondents must complete and maintain an active registration in the System for Award Management (SAM) at SAM.gov prior to close of solicitation. The Government will obtain representations and certifications through this system.

System Considerations Be aware that system updates may lag behind policy changes:

• SAM Representations: Entities are still required to complete certain representations in SAM that are not included in agency solicitations, including 52.223-22 and paragraph (t) of 52.212-3.

• Impact on Agencies: Agencies will not consider these representations in award decisions, and entities are not required to update their registrations to remove them.

(h) All questions should be emailed directly to the contracting office primary POC by the deadline listed on the first page of this document. Only written questions will be considered and responded to by the Government. Responses to questions will be posted as an amendment to the solicitation. Respondents shall not contact any Government personnel related to this requirement other than contracting office personnel.

QUOTATION SUBMITTAL

Quotes must be in accordance with and in the order detailed in this section. Quotes must be submitted via email to the contract specialist and contracting officer by the due date and time specified on the cover page of this document.

REQUIRED DOCUMENTATION

Respondents shall submit the following information in response to this RFQ:

1) Short Cover Letter:

(f) for each Line Item, 13 (a) Through (f), 14, and 15. An official having the authority to contractually bind the quoter’s company must sign the SF 18 in accordance with the procedures prescribed in the Federal Acquisition Regulation Subpart 4.102.

3) Acknowledgement of Amendments: Acknowledge all solicitation amendments (if issued by the Government) by signing and returning all individual SF30s with your quote.

5) Technical Package – see evaluation factors below. Quoters must ensure that no pricing information is displayed in the technical volume.

BASIS FOR CONTRACT AWARD

The Government anticipates awarding a firm-fixed price supplies contract to a registered/certified small business concern, using FAR Part 13 Simplified Acquisition Procedures. The Government is contemplating a single award contract resulting from this solicitation.

Quotes will be evaluated using an LPTA approach. Award will be made to the responsible quoter whose quote conforms with all solicitation requirements to include terms and conditions, representations & certifications, technical requirements, and also provides the lowest total price.

Quotes will be evaluated using the criteria listed in this section. Noncompliance with the Request for Quote (RFQ) requirements may be grounds to eliminate the quote from consideration for contract award. Failure to include all information requested may adversely affect the evaluation. A quote that is orderly and sufficiently documented will enable the Government to perform a thorough and fair evaluation.

After solicitation closing, the Contracting Officer will conduct quote compliance review for determination of basic quote adequacy prior to providing commencing evaluation. Failure to provide a complete quote identified in the solicitation may result in the quote being removed from further consideration for award.

EVALUATION FACTORS FOR CONTRACT AWARD

TECHNICAL

Technical Evaluation: The criteria below will be used to determine technical acceptability:

(a) Bidder shall product specifications that clearly state product salient features and any exclusions or variations from them.

(b) An estimated delivery date will be included in quote.

To be deemed acceptable, the BLM Technical Professional must conclude that offeror’s specifications are IAW salient characteristics described in the SOW.

The proposed price will be evaluated for reasonableness.

SUBMITTALS:

A. Manufacturer's Literature: Submit 1 copy of the manufacturer's descriptive data including design data and drawings for cattle guard grids.

QUALITY ASSURANCE:

A. Welder Qualifications: As a minimum, the welder shall meet the qualifications for: Electrodes up to and including E 7018; Steel thickness 1/8- to 3/8-inch; fillet, groove, low-hydrogen welding; or meet code qualifications for structural plate and rolled structural shapes.

PRODUCTS and MATERIALS:

A. Cattle Guard Grids: Shall be constructed of materials as shown on the drawings and described in these specifications. Design loading of grids shall conform to AASHTO HS-20 or HL-93, and dimensions shall be as shown on the drawings and the Work Data Sheet.

1. New material shall be used in the fabrication of cattle guards.

2. Welding shall be accomplished with AWS E 7018 electrodes.

3. Hot rolled structural steel sections shall conform to ASTM A 36.

4. Cold formed rails shall conform to ASTM A 242. This type rail shall be welded with E 7015 or E 7016 electrodes.

5. Structural tube sections shall conform to ASTM A 500, Grade B.

6. Steel pipe shall conform to ASTM A 53, Schedule 80 or ASTM A 501.

7. Connectors, bolts and nuts shall be zinc plated and conform to ASTM A 307, or SAE Grade 8, according to SAE J 429.

8. Anchor clips shall be shop welded.

9. Parts required to be galvanized shall be treated according to ASTM A 123 for steel shapes and

ASTM A 153 for fasteners. The following components shall be furnished galvanized: nuts, bolts and washers.

B. End Wings: Shall be as shown on the drawings.

FABRICATION:

A. Steel Cattle Guard Grids: Steel grids shall be all welded construction. Welds shall be secure and complete along both edges of cross pieces and at joints in the frame and shall conform to AWS D1.1. Welding shall be performed according to a welding procedure specification (See AWS D1.1) which has been approved by the Contracting Officer.

B. Paint: Structural steel shall be cleaned according to SSPC SP6, Commercial Blast Cleaning. Cattle guard grids and end wings shall each receive a prime and finish coat. The prime coat shall be a lead free, zinc-rich, rust inhibitive alkyd metal primer. Minimum thickness shall be 1-1/2 mils dry film thickness (DFT). The finish coat shall be an oil alkyd-enamel, gloss paint. Minimum thickness shall be 3 mils DFT, applied in two applications. Color shall be Federal Safety Yellow or match color no. 13655, FS 595. Cattle guards shall be painted after fabrication.

SOURCE QUALITY CONTROL:

A. Plant Inspection: The contractor's manufacturing facility shall be open to the Contracting Officer during normal hours. There shall be a Contractor's Representative on the site to answer questions.

B. Material Marking: Material to be used in the fabrication process shall be labeled, marked, or otherwise segregated from differing material.

C. Weld Inspection: The quality of the weld shall be "acceptable" under the visual requirement of AWS D1.1, AWS B1.10, and AWS WI, CH16. Unacceptable welds or defects in the welds as detected by visual inspection or by radiographic, penetrant dye, or magnetic particle techniques shall be repaired or removed and replaced by methods acceptable under the applicable AWS welding codes, or the entire piece may be rejected by the Contracting Officer. Repaired or replaced welds shall be re-inspected by the applicable nondestructive testing method.

D. Sandblast Inspection: The Contractor shall notify the Contracting Officer when and where the grids shall be sandblasted so that the Contracting Officer will arrange an inspection of the sandblasting quality prior to paint application.

PART 3: DELIVERY

Products shall be delivered to the following:

BLM Rosebud Field Station UT-30 Mile Marker 33, Emigrant Trail Road

Delivery shall occur between Monday – Thursday from 11am to 3:00 pm. No delivery will be accepted on Holidays. Exact delivery date shall be coordinated with the BLM COR.

Delivery Notification and Packaging Requirements

Vendor Delivery Notification The vendor is required to provide at least 48 hours’ advance notice prior to delivery. The BLM Rosebud Field Station is a remote facility, located approximately three hours from the Salt Lake BLM Field Office, and is not staffed. If the vendor does not provide the required 48-hour delivery notification, the delivery will be postponed until a BLM official is able to be present at the site and coordinate the receipt of materials.

BLM will have the necessary equipment available to unload the delivery truck. All products must be packaged either on pallets or with designated lifting points to facilitate safe and efficient unloading.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph(d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the

COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

DOI-AAAP-0028 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS-

INVOICE PROCESSING PLATFORM (IPP) (FEB 2021)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP). 'Payment request' means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is:

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

Contractor's Commercial Invoice to include all elements of a Proper Invoice pursuant to FAR 52.212-4(g)

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of St. Louis (FRBSTL) within 3 - 5 business days of the contract award date. (a) Definitions. As used in this clause Sustainable product means—

(b) Requirements. The Government has identified in the statement of work or elsewhere in the contract the sustainable products that are required during the performance of this contract. (2) Furnished for use by the Government;

(3) Incorporated into the construction of a public building or public work; or

(c) Furnished for use in performing services under this contract, where the cost of the products is a direct cost to this contract.

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

• Price

• Technical Capability (The offered livestock pipe must meet the required specifications, including material, dimensions, wall thickness, coating/galvanization, and any referenced standards)

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.225-2 Buy American Certificate (Oct 2022)

(a)(1) The Offeror certifies that each end product, except those listed in paragraph (b) of this provision, is a domestic end product and that each domestic end product listed in paragraph (c) of this provision contains a critical component.

(2) The Offeror shall list as foreign end products those end products manufactured in the United States that do not qualify as domestic end products. For those foreign end products that do not consist wholly or predominantly of iron or steel or a combination of both, the Offeror shall also indicate whether these foreign end products exceed 55 percent domestic content, except for those that are COTS items. If the percentage of the domestic content is unknown, select “no”.

(3) The Offeror shall separately list the line item numbers of domestic end products that contain a critical component (see FAR 25.105).

(4) The terms “commercially available off-the-shelf (COTS) item,” “critical component,” "domestic end product," "end product," and "foreign end product" are defined in the clause of this solicitation entitled "Buy American-Supplies."
