PROCUREMENT OVERVIEW
Combined Synopsis/Solicitation: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation/notice. Quotes are being requested at this time. The Department of Interior, Bureau of Land Management (DOI, BLM), Montana State Office, located in Billings, MT is issuing this combined solicitation/synopsis for Sun-dance Recreational Area Shade Structure for the BLM Billings Field Office in Billings, MT 140L3624Q0104 is a Request for Proposal using FAR Part12, Acquisition of Commercial Item, and FAR Part 13, Simplified Acquisition Procedures. The solicitation document, statement of work, incorporated provisions and clauses, and solicitation attachments are attached. This document incorporates provisions and clauses which are in effect through Federal Acquisition Circular (FAC) 2024-05, Effective Date 5/22/2024.

RESTRICTIONS ON CONTACTS: Beginning upon release of the request for quotation (RFQ) through purchase order award, contacting Government employees who may be associated or have knowledge of this work is inappropriate. Offerors for this RFQ, including subcontractors and teammates, shall not attempt such contacts during this period. ALL correspondence/questions shall be submitted to the Contracting Officer Only. All questions shall be EMAILED directly to the Contracting Officer at cclapp@blm.gov. Only written RFI’s will be considered and responded to by the Government, Cut-off for questions is 09/04/2024. GENERAL
(a) The Bureau of Land Management (BLM) is seeking quotations for requirements identified in this solicitation. The BLM intends to conduct this acquisition by use of simplified acquisition procedures in accordance with (IAW) FAR Part 13. A single contract award will be made to the Offeror that submits a quotation that has been determined to be the best value to the Government.
(b) The Government will not award any contract if the resulting contract would not represent a "best value" to the Government.
(c) To assure timely and equitable evaluation of quotations, respondents are cautioned to strictly comply with all instructions within this solicitation to ensure submission of a complete quotation. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements as applicable. Failure to adhere to quotation requirements, at the time of submission, may result in the quotation being unacceptable to the Government and eliminated from consideration for award. It is the responsibility of offerors to ensure their quote is received by the Contracting Officer no later than the due date and time.
(d) Offerors are cautioned to submit adequate information to enable the Government to fully ascertain each offeror’s capability to perform the requirements in accordance with the requirements of the request for quotation (RFQ).
(e) If a respondent believes that requirements in these instructions contain an error, omission, or are otherwise flawed, the respondent shall immediately notify the Contracting Officer via email with supporting rationale by the question deadline specified on the cover page of this document.
(f) This RFQ does not commit the Government to any costs incurred in the preparation and submission of a quote or for any other costs incurred by any firm submitting a quote in response to this solicitation. Note specifically that the Offeror will not be participating in a sealed bid procurement process under this acquisition method. Issuance of this RFQ does not constitute an award commitment on the part of the Government.
(g) Quotation must be valid for a minimum of 60 days.
(h) Respondents must complete the System for Award Management (SAM) at https://www.sam.gov. The Government will obtain respondent representations and certifications through this system. Please verify that your registration is active, up-to-https://www.sam.gov/ date and includes the appropriate NAICS code identified in this solicitation. If assistance is needed in registering, please go to https://www.aptac-us.org/ to find a Procurement Technical Assistance Center (PTAC) near you. SAM Registration and PTAC Assistance are free of charge.
(i) Award is subject to and based on the availability of funds. This project is currently funded based upon an independent cost estimate.
(j) Including all other factors, to qualify for award, a respondent must be determined responsible in accordance with Federal Acquisition Regulation Part 9.
(k) Respondents shall NOT contact any government personnel related to this requirement other than the Contracting Officer.

ACCEPTANCE
Final inspection and acceptance of all items/services to be delivered under this contract shall be the responsibility of the Contracting Officer and is subject to verification by the receiving office/official. Final payment may be withheld pending completion of any necessary rework by the Contractor.
Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) (May 2013)
Payment will be based on receipt of a proper invoice** and satisfactory contract performance.
Payment requests must be submitted electronically through the U.S. Department of the Treasury Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed https://www.aptac-us.org/ in SAM) will receive enrollment instruction via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3-5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Office with its proposal or quotation.
Under this contract, a proper invoice is required to be submitted as an attachment to the IPP invoice. To prevent delays and other complications, deliverables are to be received and accepted prior to invoicing. Email a detailed invoice to cclapp@blm.gov for approval prior to invoicing via IPP.
**A proper invoice must include the following items (except for interim payments on cost reimbursement contracts for services):
(i) Name and address of the contractor.
(ii) Invoice date and invoice number. (Contractors should date invoices as close as possible to the date of mailing or transmission.)
(iii) Contract number or other authorization for supplies delivered or services performed (including order number and line item number).
(iv) Description, quantity, unit of measure, unit price, and extended price of supplies delivered, or services performed.
(v) Shipping and payment terms (e.g., shipment number and date of shipment, discount for prompt payment terms). Bill of lading number and weight of shipment will be shown for shipments on Government bills of lading.
(vi) Name and address of contractor official to whom payment is to be sent (must be the same as that in the contract or in a proper notice of assignment).
(vii) Name (where practicable), title, phone number, and mailing address of person to notify in the event of a defective invoice.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services.
