USGS 140G0325Q0067 Professional Dive Services Indefinite Delivery-Indefinite Quantity (IDIQ)
Professional Dive Services
USGS California Water Science Center
Statement of Work
1.0 INTRODUCTION AND BACKGROUND
The US Geological Survey (USGS) requires professional dive services for the purpose of maintaining, installing, and removing USGS underwater oceanographic and water monitoring equipment throughout the Sacramento / San Joaquin Delta and San Francisco Bay in northern California. The USGS does not maintain an internal professional dive cadre, and we do not have in-house professional trained divers within our organization.
As such, we plan to contract for an outside vendor/contractor who specialize in providing a myriad of diving services and underwater work techniques.
This will support our work as USGS Hydrologists to monitor and report the overall conditions of California rivers, particularly the California Delta area. In order to do this we place underwater oceanographic equipment in pre-designated locations, which monitor conditions and provide data to USGS. Over time the equipment must be maintained, may become damaged by underwater debris or high-flows, become outdated, or for whatever reason must be moved or replaced. The purpose of this contract for professional commercial dive services address these needs as necessary, and to serve as our eyes for hidden or undetected obstructions which could inhibit equipment operation or possibly destroy our valuable equipment.
We have contracted out for commercial dive services in the past and have had success using this approach to supplement our water monitoring missions without the need to develop our own in-house commercial dive capability. Maintaining our water monitoring stations in the Delta is considered to be mission-critical; and continuous and proper operation of our real-time monitoring network is absolutely critical to the ongoing Water Science data collection.
2.0 OBJECTIVES:
Without properly placed and properly operating underwater equipment we could easily misinterpret data or worse yet, overlook or not detect potential irregularities in our river systems. If this happens the health and safety of our surface and ground water, hydro vegetation, aquatic life, shorelines and people could be detrimentally affected. With sound equipment in good condition and the proper placement of this equipment, we can be assured we are collecting valuable and accurate data. Maintenance of a reliable and high-quality data collection network is a high priority.
3.0 TECHNICAL REQUIREMENTS
The intent is that this contract Statement of Work (SOW) be a very broad description of the types of work that will be ordered for the commercial dive services necessary. The contract is an Indefinite Delivery/Indefinite Quantity (IDIQ) contract. The idea is that the contract describes a broad scope of work, and broad general requirements. In addition, the contract contains the general contract terms and conditions.
The broad scope of the IDIQ contract’s Statement of Work, is then refined to more specific or discrete work items, or tasks called a Task Order (TO).
Under the IDIQ contract’s “umbrella” terms and conditions, individual TO’s will have their own SOW and funding, and the contractor will perform work under the TO as described therein. Every dive mission will be station-unique, but many will be identical or similar in nature as to the work to be performed (for example, aquatic weed abatement). Task orders may include, but are not limited to, the types of tasks noted below.
3.1 Overall Requirements:
3.1.1 The contractor shall provide all dive and safety personnel and equipment necessary to perform the assigned work. Personnel shall be appropriately trained and certified, for the work requirements involved. The contractor shall provide at least one certified safety diver/observer who shall be present at the dive site, at all times while a contractor diver is in the water. (In other words, one diver and one safety diver/observer). USGS personnel on scene (if any) shall not serve as the safety diver/observer under any circumstances;
3.1.2 When required, the contractor shall provide and operate their own vessel/watercraft necessary for the planned dive operation, including their own operators and any necessary equipment for the planned operation. Where it is determined that USGS watercraft is adequate or satisfactory for the mission, the USGS watercraft (operated by USGS personnel) shall be used in lieu of the contractor’s watercraft. USGS watercraft shall not be operated under any circumstances by contractor personnel. Use of contractor’s vessel or USGS vessel will be coordinated in advance of dive operations for each dive-day mission.
3.1.3 When using USGS watercraft, the contractor is still responsible to provide all necessary equipment to support the planned mission. With proper pre-arrangement, and if the USGS vessel has a tool, item, or equipment which may benefit the operation, that item may be provided for the contractor’s use, at the discretion of USGS. This does not relieve the contractor of responsibility to be prepared and have all necessary items available to perform the planned tasks.
3.1.4 Operations will be conducted conforming to the contractor’s normal operational commercial diving safety policies and procedures. Contractor is responsible for advising USGS personnel of safety protocols and procedures when necessary, before commencement of dive operations, as applicable.
3.1.5 The contractor shall operate motor vehicles, watercraft and conduct dive operations in a safe manner meeting all laws and regulations required while performing each task of the Task Orders.
3.1.6 The USGS does not have dedicated diving capabilities or diving procedures or guidelines. As such, the contractor is solely responsible for any and all operational diving procedures and protocols; and the contractor is responsible for immediately advising USGS personnel of any safety issue upon first becoming aware of same.
3.1.7 Additionally, the contractor shall maintain any and all licenses, certifications, continuing education / training currency requirements, safety reporting, etc. necessary to accomplish this work within the guidelines and requirements of the appropriate governing entity associated with such license, certification, training, safety, or insurance provisions relating to this work.
3.1.8 Work locations are within the San Francisco Bay Delta as specified in task orders issued over the course of this contract. (see attached “exiting station map” for a general geographic boundary of the “Delta Area”.
3.2 Task Order Requirements. The contractor is responsible for providing their own equipment, such as any necessary underwater tools, air tools, welding equipment, wrenches, etc. The government will not be providing any tools or equipment in this regard. Work to be performed under the task orders may include, but is not limited to activities such as:
• General station maintenance
• Cleaning submerged instrumentation
• Replacing missing / damaged hardware
• Securing submerged scientific instrumentation to existing infrastructure (existing infrastructure can include bridge fenders, US Coast Guard channel markers, pilings, pump stands, temporary frames, etc)
• Adjusting physical location of scientific equipment
• Debris clearing / invasive weed abatement
• Checking channel cross-sections at stations to ensure no large debris is blocking data acquisition beams. Removing debris as required.
• Installing, checking and cleaning invasive weed abatement mats
• Install submerged scientific equipment
• Search for / retrieve submerged scientific instrumentation
• Position and secure oceanographic equipment to riverbeds and pilings using underwater wrenches, screwdrivers, compasses and other tools.
4.0 DELIVERABLES
4.1 Task order
s will fund the actual work to be conducted. Task orders will generally be funded for a certain number of dive-days. The dive-day missions will be coordinated with USGS in advance, but for simple or routine tasks (e.g., checking the equipment and clearing weeds) multiple dives at multiple sites might be expected for that day. For more complicated tasks (for example, setting up and installing a completely new station, and initial checkout) perhaps only a single or couple of locations might be involved, with one or two dives at each site.
4.2 The main deliverable is the “commercial diving services” with the contractor provided dive team and necessary equipment to accomplish the dive-day goals. The contractor personnel must have ability to provide quality detailed work by touch and feel without being able to see underwater in extreme turbid water conditions while placing, securing and/or retrieving oceanographic equipment and repairing instrument hardware at site locations in the San Francisco Bay Delta.
4.3 For each dive (or dive-day as appropriate), the contractor will deliver a documentation of worked performed. The contractor shall operate motor vehicles, watercraft etc. as necessary to conduct dive operations in a safe manner meeting all laws and regulations required while performing contract work. All work will be performed at site locations in the San Francisco Bay / Delta, as specified in task orders issued over the course of this contract, or as directed by the UGSS technical liaison point of contact for the contract.
4.4 Reports: Contractor shall submit a report for each dive site, appropriate for the work accomplished. A dive log may be all that is necessary with comments for each site. This should be agreed in advance for each work activity to be conducted. Factors to be reported may include conditions of monitoring equipment and mounting hardware beneath the water surface; nearby hazards or observations; problems or issues encountered at the site; suggestions or corrective actions taken. This may be annotated on the dive log, or for a more complex issue provide a written report or summary of problem.
4.5 There are a number of existing sites that may be visited. Please see Section Map below for a depiction of most of the current monitoring sites. It is expected that maintenance may be required at most of these sites over the course of the contract. Sites may be added or removed over time based on water science requirements that evolve, river conditions, technology changes, new monitoring initiatives, etc. In addition, there are several sites in San Francisco Bay that may require dive services. It is not expected that any new sites will be added that are outside the geographic area already depicted in the map.

The Department of Labor will accept payment in accordance with the following standards as compliance:
The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

Conformance Process:
The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR 4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification, wage rate, and/or fringe benefits which shall be paid to all employees performing in the classification from the first day of work on which contract work is performed by them in the classification. Failure to pay such unlisted employees the compensation agreed upon by the interested parties and/or fully determined by the Wage and Hour Division retroactive to the date such class of employees commenced contract work shall be a violation of the Act and this contract. (See 29 CFR 4.6(b)(2)(v)). When multiple wage determinations are included in a contract, a separate SF-1444 should be prepared for each wage determination to which a class(es) is to be conformed.
The process for preparing a conformance request is as follows:
1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).
2) After contract award, the contractor prepares a written report listing in order the proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.
3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the U.S.
Department of Labor, Wage and Hour Division, for review (See 29 CFR 4.6(b)(2)(ii)).
4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.
5) The contracting officer transmits the Wage and Hour Division's decision to the contractor.
6) Each affected employee shall be furnished by the contractor with a written copy of such determination or it shall be posted as a part of the wage determination (See 29 CFR 4.6(b)(2)(iii)).
Information required by the Regulations must be submitted on SF-1444 or bond paper.
When preparing a conformance request, the "Service Contract Act Directory of Occupations" should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination.
Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination (See 29 CFR 4.152(c)(1)).

** UNIFORM ALLOWANCE **
If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination.
