The offeror is cautioned to study the Evaluation Factors stated below along with their relative importance. Your package shall address each of these factors since these are the standards against which your proposal will be evaluated. It is the offeror’s responsibility to include the appropriate documentation in its package to allow a complete technical/price evaluation. Failure to submit the appropriate
140G0222R0015 documentation may result in the rejection of the offeror’s proposal.
The offeror’s package shall consist of all required information requested in this combined synopsis/solicitation, signed SF1449, completed pricing schedule (Attachment 2), acknowledgement of any amendments, any information requested in the proposal instructions, and completed FAR Clauses and Provisions that are in full test. Offerors shall provide their Dun & Bradstreet (DUNS) number.
Failure to provide this may result in the rejection of the offerors proposal.
Refer to Attachment 1 for additional proposal instructions.
(IX) FAR 52.212-2 EVALUATION - COMMERCIAL ITEMS (NOV 2021)
(a) The Government will award a firm-fixed-price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. When combined, the non-price Factors 1 through 5 are significantly more important than Price.
Evaluation factors are listed in descending order of importance with Factors 1 being the most important. Factor 1 is Pass/Fail. If Factor 1 fails, that offeror will be excluded from the selection process.
Factors 2 and 3 are next in order of importance but are of equal importance. Factors 4 and 5 are next in importance but are also of equal importance.
Factor 1 Technical Merit Factor 2 Laboratory QA/QC Operations Factor 3 Schedule Factor 4 Qualifications and Experience of Key Personnel Factor 5 Past Performance
NON-PRICE/TECHNICAL EVALUATION
FACTOR 1: TECHNICAL MERIT
Proposals will be evaluated based on the offeror’s approach, capability, and experience in measurement of analytical precision based on results from blind replicated samples contained within the sample set.
Analytical accuracy of the results and systematic errors will be evaluated using independent determinations and historical analytical data for those materials. The proficiency samples shall be analyzed on equipment identical to the Offeror's proposed system using chemical preparation techniques presented in the Performance Work Statement including:
1. Ability to meet the appropriate levels stated for each analysis.
2. Suitability of proposed method for each analysis.
FACTOR 2: LABORATORY QA/QC OPERATIONS
Proposals will be evaluated based on the offeror’s experience in data management and quality control procedures to include the following:
1. Ability to control the quality of required analyses, management, procedures, delivery of analyses that conform to contract.
2. Requirements and maintenance of substantiating evidence of instruments that analyses conform to contract quality requirements and furnishing information to the Government as required.
FACTOR 3: SCHEDULE
Proposals will be evaluated based on the offeror’s approach, capability, and experience for managing the requirement schedule of this contract including:
1. Reasonableness of proposed work schedule to fulfill RFP requirements including how sample throughput rate will be accomplished, including data management, time allocated for the preparation and submission of required reports.
FACTOR 4: QUALIFICATIONS AND EXPERIENCE OF KEY PERSONNEL
Proposals will be evaluated based on offerors approach to manage and administer subject IDIQ contract, and its task orders will be evaluated based on the attributes of qualifications, education, certification, and experience and applying these attributes to the personnel’s primary duties in effective management of the IDIQ contract and task orders.
1. Ability to provide qualified key personnel assigned to this contract in order to manage the contract effectively conforming to the contractual requirements.
FACTOR 5: PAST PERFORMANCE
Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with the PWS, contract schedule, and contract terms and conditions. Past performance is also a measure of the risk of performance associated with the offeror. The Government will assess the offeror’s record of past performance on similar contracts as an indicator of success under this requirement.
The Government will treat each client reference’s response as Source Selection Sensitive in accordance with FAR 3.104. An Offeror will have the opportunity to respond to negative past performance information if the Offeror has not previously had an opportunity to respond to it.
The Government reserves the right to contact references for verification or additional information.
The Government will review past performance to examine the depth of experience of the Corporation successfully completing projects having the same or similar magnitude and complexity. A minimum of three references shall be provided.
(b) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(c) The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussion if later determined by the Contracting Officer to be necessary. (see FAR 52.212- 1(g) Contract award which is incorporated by reference on page 5 of this combined synopsis/solicitation).
Notwithstanding the overall technical score, a proposal may be deemed unacceptable if it fails to meet the stated minimum requirements of any one factor.
PRICE EVALUATION
The offerors price proposal will be evaluated separately from the non-priced Evaluation Factors listed above. Offers will be evaluated on the basis of total aggregate price for all items listed in Attachment 2 – Pricing Schedule for all three (3) years plus six (6) month option period. Note: The pricing schedule reflects estimated quantities. Exact quantities will be determined at the task order level.
The individual fully burdened hourly labor rates as well as the total sum of all burdened hourly labor rates for each labor category, location, and contract year will be further assessed for price reasonableness in comparison amongst the other offerors and the government estimate as indicated below.
To ensure fair, reasonable and balanced prices, the Government will perform a price analysis. Normally, adequate price competition establishes a fair and reasonable price. Price analysis techniques may include but not limited to:
• Compare proposals with the IGE/IGCE
• Compare proposals to each other
• Compare proposed prices with historical prices paid
• Compare proposed prices with commercially/publicly available information
• Internet search
• Catalog/market prices
• Compare prices with similar items, adjusted for differences
The Government may use price realism analysis to perform risk assessments and responsibility determinations. The offerors price proposal which are unrealistic in terms of technical approach or unrealistically low in price may be deemed reflective of an inherent lack of technical competency or indicative of failure to comprehend the complexity of the contract requirements and may be grounds for the rejection of the proposal. Offerors are reminded of below notes in Attachment 2 – Pricing Schedule.
NOTE 1: THE ESTIMATED QUANTITIES ON ATTACHMENT 2 WILL BE USED FOR
PRICE/COST EVALUATION AND ANALYSIS FOR PRICE REASONABLENESS ONLY. THE
GOVERNMENT IS NOT OBLIGATED TO UTILIZE THE ESTIMATED QUANTITIES.
NOTE 2: OFFERORS SHALL PROVIDE THEIR FULLY BURDENED LABOR RATE, THAT
INCLUDE WAGES, OVERHEAD, GENERAL AND ADMINISTRATIVE EXPENSES, AND
PROFIT FOR EACH METOD.
NOTE 3: OFFERORS SHALL HAVE NO ROUNDING ERRORS. MUST BE EXACT AND
MUST ROUND TO 2 DECIMAL POINTS FOR EACH METHOD.
EVALUATION PROCESS
The proposals will receive a preliminary review to determine whether the proposal contains sufficient information, as required by proposal stated below, to allow Government to perform a meaningful evaluation. If the results of this preliminary review indicated that the proposal lacks sufficient information
140G0222R0015 to allow a meaningful evaluation to be conducted, the Contracting Officer (CO) may eliminate the proposal from further evaluation and consideration for award.
A Technical Evaluation Committee (TEC) comprised of Government personnel will evaluate proposals.
The technical evaluation and rating of proposal will be conducted in strict confidence. The number and identities of offerors will not be revealed to anyone not involved in the evaluation and award process or to other offerors.
The proposals will be evaluated against the factors set forth in this combined synopsis/solicitation. Price portion of proposals will be evaluated independently of technical portion of proposals. The TEC will not have access to price information until completion of the technical evaluations of the proposals.
After completion of the technical and price evaluations, the TEC will make an award recommendation based on the evaluations to the CO. The CO will then consider all proposals and the evaluation factors stated herein, including assessment of the degree of risk associated with the proposals, to determine the offer that provides the overall best value to the Government.
The Government will assess its level of confidence that the contractor will successfully perform the requirements based non-price merit using the following confidence level results. Technical and past performance, when combined, are the offer’s non-price merit, which is of greater value/importance than price.
HIGH CONFIDENCE
The Government has high confidence that the Offeror understands the requirement, proposes a sound approach, and will be successful in performing the contract with little or no Government intervention.
SOME CONFIDENCE
The Government has some confidence that the Offeror understands the requirement , proposes a sound approach, and will be successful in performing the contract with some Government intervention.
LOW CONFIDENCE
The Government has low confidence that the Offeror understands the requirements, proposes a sound approach, or will be successful in performing the contract even with Government intervention.
Factor 5 - Past performance will also include the following rating:
NEUTRAL
In the case of an offeror without a record of relevant, recent past performance or for whom information on the past performance is not available, the offeror will be evaluated neither favorably nor unfavorably on past performance.
BASIS OF AWARD
Refer to section (IX)- FAR 52.212-2 – EVALUATION- COMMERCIAL ITEMS.
The award of this requirement shall be made using only the procedures found in the Federal Acquisition Regulations (FAR) Part 12 Acquisition of Commercial Items and Part 13 Simplified Acquisition Procedures including Subpart 13.5 - Simplified Procedures for Certain Commercial Products and Commercial Services.
The Government will use a best value process for the source selection. The award will be made to the responsible offeror whose offer conforms to the combined synopsis/solicitation requirements and provides the best value to the Government considering all evaluation factors.
140G0222R0015
The Government contemplates a single, 3 year Indefinite Delivery, Indefinite Quantity (IDIQ) with an optional 6-Month Extension (per FAR 52.217-8) contract.
In determining which proposals offers the greatest value or advantage to the Government, overall technical merit will be considered more important than price or cost. The degree of importance of price or cost as an evaluation factor will increase with the degree of equality in the technical merits of the proposals, therefore the Government reserves the right to award to a lower price offeror when offers are considered essentially equal in terms of technical merit.
Between acceptable proposals with a significant difference in technical merit, a determination will be made as to whether the additional technical merit or benefits reflected by a higher priced proposal warrants payment of the additional price or cost.
(X) The offeror shall submit a completed copy of the provision at FAR 52.213-3 - OFFEROR
REPRESENTATIONS AND CERTIFICATIONS – COMMERCIAL ITEMS (NOV 2021),
with its proposal. An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at https://www.sam.gov. (A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
