Please acknowledge the certification status in your proposal (it will be confirmed on government websites). If the appraiser is licensed in another state and applying for a license in the subject jurisdiction, he/she must provide a reference to the state and certification status.

2. Technical Acceptability

a. Experience for Assignment – Both geographical competency and technical competency will be considered. The contractor shall provide a standard Appraiser's Statement of Qualifications and a signed proposal letter that describes and attests to the following:

i. The appraiser is required to provide verifiable evidence of general and technical appraisal experience within his/her statement of qualifications, a resume, and/or curriculum vitae. Please identify experience appraising similar property as well as recent experience working with the federal government regarding acquisitions, dispositions, and commercial services.

ii. The appraiser’s resume or statement of qualifications should show geographical competency, specifically as it relates to the Iliamna area, Lake Clark and the Tazimina Lakes. If the appraiser has experience with these property characteristics, but not in the market local to the subject property, then they must so-state this fact and demonstrate his/her experience in other areas as well as the actions proposed that will allow them to complete the assignment competently.

iii. The appraiser’s resume or statement of qualifications should show a clear understanding of conservation easements as they related to UASFLA assignments. iv. A designation from a recognized professional appraisal organization will be considered but is not required. If the appraiser is a member of a professional organization, this should be identified in the statement of qualifications or resume with the name of the organization, and the level, type, or category of such membership.

STATEMENT OF WORK

Agency Case ID: Chulitna and Tazimina Conservation Easement (±14,660 acres in total)

AVIS Number: P230066

This Statement of Work (SOW) is a guide to the appraiser to help identify the appraisal problem. It is not intended to limit the scope of appraisal investigations or bias the independent judgment or value opinions of the appraiser.

The selected appraiser must independently verify all information provided in this Statement of Work for reliability and subsequent to use in the appraisal.

Any questions about these appraisal instructions or other technical requirements for this assignment should be addressed to the AVSO review appraiser, who is identified in the Assignment Contacts section.

SECTION 1 – Subject Identification & General Information

Identification Case Name Chulitna and Tazimina Conservation Easements Location LACL Tracts 09-101, 09-122 (por) and 10-148. The subject properties are located in the Lake Clark National Park and Preserve, Port Alsworth, Alaska.

Acreage ±14,660 acres in two (2) assessor’s parcels Property Type Raw Land.

Case Type Partial acquisition of a conservation easement.

Client U.S. Department of the Interior, Appraisal and Valuation Services

Office (AVSO)

Intended Users The appraisal report will be used by the client and the National Park Service (NPS) on behalf of the United States of America (USA).

Intended Use The appraisal will be used to provide the client and intended user with information about the subject property and its current market value which will be used to acquire the rights to facilitate the purpose of the National Park Service.

This appraisal is not intended for any other use.

Area Map with Proposed Easements (also supplied as exhibits)

Source: National Park Service.

Please note: Details maps of each individual tract have also been provided as exhibits

Property Description

NPS Tract APN Land Area (Ac) Primary Characteristics

LACL 09-101 & 09-122 (por) 12,740 Raw Land LACL 10-148 1,920 Raw Land

Total 14,660

The subject is comprised of three vacant tracts land that total approximately 14,660 acres. The subject is recognized by the NPS Tract Numbers 09-101, 09-122 (portion) and 10-148. Note that the subject is accessed by way of boat or floatplane along the shores of Lake Clark and Tazimina Lake. Access to the subject must be investigated and confirmed as part of the appraiser’s due diligence.

The agency’s proposed action is to acquire conservation easements over the entire 14,660 acres of subject land. Please note that NPS is acquiring conservation easements only (no improvements will be acquired). As noted, the purpose of this appraisal assignment is to provide an opinion of the compensation due for the acquisition of rights on the subject land. The rights represent a partial interest of the property and appraisals for partial interest acquisitions are covered in the Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA). The review appraiser will not dictate to the contract appraiser the scope of work necessary to achieve credible appraisal assignment results in the context of the intended use and users, other than the requirements outlined in this statement of work. However, the appraiser is advised that the goal of any acquisition by the USA is to impartially protect the interests of all concerned (the property owner and the USA) and that the compensation paid will leave the property owner (monetarily) in the after condition the same as he/she was in the before condition.

Legal Description

Before Acquisition:

Please refer to the Preliminary Title Report (title report(s) will be provided as exhibits when they are complete) for a full legal description.

After Acquisition:

The area is the same in the “after” acquisition condition; however, a portion of the rights will no longer be held by the underlying property owner. The draft legal description of the proposed conservation easement area is provided as an exhibit and described as follows:

Please note this is a draft legal description and the range portion of the description is not included.

For reference, the Chulitna CE range is R31 and the Tazimina CE range is R30. A final legal description will be provided once it has been completed.

Property Interest

The agency has requested the value of the acquisition based on the purchase of conservation easements over the entire property. In the before condition, the property interest is the fee simple estate subject to existing easements and encumbrances. In the after condition, the property interest is the same, with the additional encumbrance of the proposed conservation easement. In the after condition, some of the owner’s rights from the before condition are impacted and the consideration of the reconfiguration of rights remaining with the owner is the basis of the valuation.

It is important to note different entities own the surface and subsurface rights (see exhibits for further details). There is language in the draft conservation easement accommodating this. NPS reports that the wording may be updated, but not significantly.

The appraiser must immediately notify the AVSO review appraiser of any indications of rights contrary to these described. This may result in amended instructions.

Outstanding Rights A preliminary title report or equivalent for federal lands will be provided but the patents have been included as exhibits. The identified documents, conditions, agreements, easements and/or encumbrances regarding the appraised property must be considered and discussed in the appraisal report in relation to their impact on value. In addition, the appraiser is expected to investigate for additional or incorrect encumbrances on the property. The provided title reports will reportedly have hyper-links to the exception and exclusion documents for downloading to help in your analysis. If you have difficulty obtaining the documents through the hyper-links, please contact the review appraiser and they will be provided directly.

The AVSO Division of Minerals Evaluation (DME) does not plan to complete a mineral report for this request. “The parcel is outside of any known hydrocarbon or mineral producing area. Datasets such as USGS's Mineral Resources Data System, local aerial imagery (Google Earth, Digital Globe), State of Alaska's mining claim mapper, and IHS Enerdeq were reviewed for relevant mineral information. There are no recognized mineral development or mineral valuation issues.” However, NPS is in the process of producing a mineral report for the conservation easement. This document will be provided as an exhibit when it is available.

Property Access

Physical The properties are reported to have physical access along Lake Clark and Tazimina Lake, respectively.

Legal The properties are reported to have legal access.

As noted, there are no rights of access to and from the subject properties from the land. That said, there is water access along the shores of Lake Clark and Tazimina Lake, as well a 17b trail easements. In conjunction with this assignment, the contract appraiser must research the status of the subject’s access.

Larger Parcel

The Agency request covers ±14,660 acres. The total acreage owned is unknown. The relevance, if any, in the determination of the larger parcel is part of this valuation. Furthermore, larger parcel determination includes examining not only for lands external to that described in this SOW, but also analyzing whether more than one larger parcel exists within the subject property.

The appraiser must conduct all research necessary for a well-supported Larger Parcel(s) conclusion presented in the appraisal. See UASFLA 1.2.7.3.1, 1.4.3-1.4.7, 2.3.3.1, & 4.3. Upon completion of the highest and best use and the larger parcel analysis sections of the report, the appraiser will notify the AVSO review appraiser and forward those sections for discussion prior to finalizing the rest of the appraisal.

SECTION 2 – Appraisal Requirements & Instructions

Appraisal Standards

The appraisal must conform to the following appraisal standards:

• Uniform Standards of Professional Appraisal Practice (USPAP), 2020-2021 edition

• Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA), 6th Edition

Applicable Law, Regulation, and Policy

The appraisal must conform to the following laws, regulations, and policies:

• Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91- 646) as amended

• Federal Regulations 49 CFR, Part 24

Market Value

The amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of the appraisal, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property at the time of the appraisal. [Interagency Land Acquisition Conference, Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition, Section 4.2.1, page 93.]

Date of Value

The date of value is the date of the last property inspection, which must be no later than 30 calendar days prior to the submission of the completed appraisal report, unless the AVSO review appraiser approves in advance other conditions in writing. This may mean that the appraiser will need to make more than one inspection of the subject and should be planned for accordingly.

Extraordinary Assumptions

None. If the appraiser determines that an extraordinary assumption is necessary, he/she must contact the AVSO review appraiser for prior written approval. If a subsequent use of an extraordinary assumption is approved, the appraisal must note that it may have affected assignment results.

Hypothetical Conditions

The subject is to be appraised based on the existing rights at the date of value.

Regarding the conservation easement, the rights appraised in the after condition of the property are different due to the proposed easement but these rights all currently exist, so they are not hypothetical.

If the appraiser determines that a hypothetical condition is necessary for the completion of the assignment, the appraiser must contact the AVSO review appraiser for prior written approval. If a subsequent use of a hypothetical condition is approved, the appraisal must note that it may have affected assignment results.

Jurisdictional Exceptions

The jurisdictional exception associated with UASFLA’s requirement that value conclusions not be linked to exposure time is allowed. If the appraiser decides to invoke USPAP’s Jurisdictional

Exception Rule to comply with other law or UASFLA regulation, he/she/they must contact the AVSO review appraiser to obtain prior written approval.

Placement in Report

The appraiser must clearly reference all extraordinary assumptions, hypothetical conditions, and jurisdictional exceptions wherever the final value conclusion is stated, including the Letter of Transmittal and the Summary of Salient Facts. These must be communicated in full, with any general assumptions and limiting conditions.

Property Inspection

The appraiser must inspect the subject property and all the market properties used in direct comparison, unless the AVSO review appraiser has approved other conditions in writing.

Please contact the review appraiser to discuss the method of inspection (direct site, flyover, drone, etc.) prior to performing the inspection.

For appraisals with an intended use of acquisition or exchange, the appraiser must certify in the report that he/she/they extended an offer to the property owner (or the owner’s representative) to accompany him/her during the property inspection. [Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Ed. (Section 2.3.1.4, pages 58)]

Permission to enter upon and appraise the property has been granted. The permission document will be provided to the winning bidder.

Prior to the property inspection, the appraiser must notify the NPS realty specialist and AVSO review appraiser of the time, as they may wish to accompany the appraiser on the inspection.

Pre-Work Meeting

The appraiser will be required to attend a pre-work meeting with the assigned AVSO Review Appraiser, the agency realty specialist and/or other agency representative, and other interested parties. The AVSO review appraiser will coordinate the date, time & place of the meeting. At the discretion of the AVSO review appraiser, the pre-appraisal meeting may be conducted telephonically or at the subject property in conjunction with the property inspection.

If any significant items of concern are observed during the property inspection, from aerial photographs, or from other materials researched during the appraisal process that were not discussed in the pre- appraisal meeting, the appraiser must contact the AVSO review appraiser before continuing with the appraisal assignment.

Controversies/Issues

A. It is important to note different entities own the surface and subsurface rights (see exhibits for further details). There is language in the draft conservation easement accommodating this. NPS reports that the wording may be updated, but not significantly.

B. Title documents, final legal descriptions, and the mineral report will be provided once they are completed.

C. It is the contract appraiser’s responsibility to perform a larger parcel analysis and report their finding and conclusions, as required by UASFLA. As such, the contract appraiser analysis and determination should include the possibility of multiple larger parcels.

Special Appraisal Instructions

1. Even though communication is encouraged with the property owner and the client agency, only the assigned AVSO review appraiser can modify appraisal instructions (in writing).

2. The appraiser may not communicate assignment results to any party except AVSO until authorized to do so in writing by AVSO.

3. Any communication (verbal or written) with the agency realty contact must include the assigned AVSO review appraiser.

General Appraisal Requirements & Instructions

1. The appraiser must hold a valid license as a Certified General Appraiser for the jurisdiction in which the subject property is located. (Valid credentials include those obtained directly from the jurisdiction, those issued under a reciprocity agreement, and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes.)

2. The AVSO statement of work, other assignment instructions and engagement letter must be included within the addenda to the appraisal report.

3. UASFLA (Page 56) states that a report prepared in accordance with UASFLA Sections 2.3, 2.4, and

2.5 is consistent with and/or exceed the requirements for an appraisal report under Standard 2 of

USPAP.

4. The appraiser must appraise the subject property in its “as is” condition unless authorized in writing by the AVSO review appraiser to do otherwise.

5. Color photographs and maps of comparable properties shall be included in the appraisal report.

AVSO will accept aerial photographs for comparable properties unless the aerial photographs do not accurately represent the property as of the date of inspection. The appraiser must photograph any unusual property features from the ground.

6. The appraisal report will be reviewed for compliance with the terms of this statement of work (including all cited standards). Any findings of inadequacy will require clarification and/or correction.

7. The appraiser shall consider the appraisal report and all DOI internal documents furnished to the appraiser to be confidential. Refer all requests for information concerning the appraisal to the AVSO review appraiser.

8. AVSO will not normally accept custody of confidential information. Should the appraiser find it necessary to rely on confidential information, he/she/they will contact the AVSO review appraiser for instructions. The review appraiser will view the information and provide further instruction to the appraiser regarding handling and storage of the confidential information.

9. While the public is not an intended user of the appraisal report, the Freedom of Information Act (FOIA) and agency policy may result in the release of all or part of the appraisal report to others.

10. If including any proprietary information in the appraisal, appraiser must gain concurrence from AVSO review appraiser and deliver the proprietary information in a separate binder.

11. When the appraiser has performed any services regarding the subject property within the three prior years, he/she/they must disclose this in the bid proposal.

SECTION 3 – Performance & Submission Requirements

The appraiser must address any questions regarding appraisal instructions and/or technical requirements for the appraisal to the assigned AVSO review appraiser.

The target date is 90 calendar days from the date of award to deliver the initial appraisal report to the AVSO for review. If the appraiser cannot deliver the report within the requested timeline, they may provide an alternative date but under no circumstances shall that date exceed 120 days from the award date.

Deliverable/Task Schedule

REQUIRED DELIVERABLES DELIVERY DATE

Pre-Work Meeting A pre-work meeting will be scheduled within 10 business days of the contract award.

Subject Property Inspection TBD (Contract appraiser shall coordinate with the property contact and AVSO Review Appraiser)

Initial Appraisal Report The target date for the initial submission of the draft appraisal report is 90 days from contract award. If the appraiser determines that a performance period of 90 days is not feasible, then an alternative delivery date may be provided in the proposal.

Review Period & Comments Provided to Appraiser

Initial review comments are due to the appraiser within 20 days after the preliminary appraisal has been received. Any corrections/revisions must be completed and returned to the review appraiser within 10 business days. The total appraisal timeline should not exceed 120 days.
