COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; Quotations are being requested and a written solicitation will not be issued. This Solicitation is issued as a Request for Quotation.

The associated North American Industrial Classification System (NAICS) code for this procurement is NAICS Code 334111-Electronic Computer Manufacturing size standard.

This is a 100% Indian Small Business Economic Enterprise (ISBEE) Set Aside

The objective is to award multiple Indefinite Delivery Indefinite Quantity (IDIQ) contracts to purchase new Brand Name Only Apple iPad Tablets and Accessories that complies with the Buy Indian Act. This acquisition will provide a standard method for all of Bureau of Indian Education (BIE) to purchase new tablets in limited quantities or as part of a uniform lifecycle replacement.

Authorized Resellers/Partner Status Validation. The contractor shall be an authorized reseller, as defined by the Original Equipment Manufacturer (OEM), of new equipment from OEMs proposed under this solicitation. The contractor shall ensure all products are genuine and eligible for any OEM warranties, maintenance agreements and licensing as offered. Genuine products are those products the OEM, by their policy, considers not “secondary”. The contractors shall have the capability to simultaneously deliver large volumes of products to multiple locations within the United States.

SECTION A: INSTRUCTIONS: QUOTE REQUIREMENTS

QUOTE DUE DATE: 01/18/21 AT 9 AM CENTRAL TIME

Basis for Award: This RFQ is issued IAW with FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items and conjunction with FAR 16.505. The Government will award multiple IDIQ contract to vendors whose Quotation(s) conforming to this RFQ and who has/have offered the lowest evaluated price Quotation(s). The Government reserves the right to award more or less than three (3) IDIQ contracts on any item for any quantity less than the quantity quoted and at the unit price quoted if it is determined to be in the best interest of the Government.

Evaluation: All Quotations will be evaluated by conducting a direct comparison of quotation in accordance with the evaluation process outlined in FAR 13.106-2(b)(4)(i), lowest price meeting requirements. Vendors may quote for any or all items under this RFQ. The Government will evaluate prices for award purposes by including only the prices for the base year line items. In order to ensure new design enhancements and technological updates, option year prices are not being requested for award purposes.

a. Quote Submission: Only electronic email quotes via email shall be accepted to Kenneth.lloyd@bia.gov. In subject line of email state: Quote Submission - RFQ 140A2320Q0074 – IDIQ Apple iPad – BIE. Quotes SHALL be in PDF, and compatible with Microsoft office Software. NO ZIPPED FILES are permitted.

B. Interested vendors are instructed to complete and return the following information as part of their quote:

1. Vendor Contract Information: Quote SHALL include- Business Name, address, DUNS Number Point of Contact Name, Telephone number and Email address.

2. Price Quote: Complete and submit quotation for the above Table 1 – Pricing Schedule.

- Vendors may quote for any or all items under this RFQ.

- Quotation shall be valid for a period of one hundred twenty (120) calendar days.

- Quotation shall include copy(s) of the OEM specification sheet for each product(s).

- Vendors shall bear all costs associated with the preparation and submission of their

Quotations, and the Government will in no case be responsible or liable for costs.

3. Authorized Resellers/Partner Status Validation. Quotation shall include a copy of the verification letter from the OEM that authorizes your company as a Federal Distributors for resale to the Federal Government.

4. Representation:

a. Vendor must select one of the below boxes and submit with it quote. IAW DIAR 1452.280-4 - The offeror represents as part of its offer that it [ ] does [ ] does not meet the definition of Indian economic enterprise as defined in 1480.201.

b. Vendor shall complete, sign and submit as part of it quote and IAW FAR 52.204-24, Attachment 1 - 889 Representation FAR 52.204-24 as attached to this RFQ.

C. SAM Requirement: Any contractor interested in doing business with the Federal Government must be registered and active in the System for Award Management (SAM) database at the quote is submitted, prior to award, during performance and through final payment of resultant award. SAM is a Federal Government owned and operated FREE website at www.SAM.gov.

D. Written Questions: Submit questions via email to Kenneth.Lloyd@bia.gov by January 5, 2021 no later than 10 AM Central Time.

Quotation which do not conform to the format of this solicitation may not receive further award consideration.

SECTION B - SUPPLIES AND PRICE

B.1 ITEMS BEING ACQUIRED

a. Brand Name Only: This is a “Brand Name Only” procurement for Apple products.

Alternative brands will not be accepted.

c. The Minimum Guarantee Amount: $2,500.00 provided that the contractor can demonstrate it has exercised due diligence and made its best efforts to secure a delivery order.

d. The Maximum Contract Value: $7,000,000.00 ($7M). The maximum contract value of $7M applies collectively to all awarded IDIQ contracts. The accumulative sum of payments streams associated with all delivery orders against all awarded IDIQ contracts, shall not exceed $7M.

e. Authorized Resellers/Partner Status Validation. All awardee(s) shall be an authorized reseller, as defined by the Original Equipment Manufacturer (OEM), of new equipment from OEMs proposed under this IDIQ, verified by an authorization letter or other documents from the OEM for the duration of this contract. The awardee(s) shall ensure all products are genuine and eligible for any OEM warranties, maintenance agreements and licensing as offered. Genuine products are those products the OEM, by their policy, considers not “secondary”. All warranty associated with the product shall be in accordance with the OEM terms and conditions.

f. Quantities: It is estimated that as many as 8,000 total iPad tablets may be needed in a variety of configurations and models over the life of this contract. The quantities stated herein are best estimates only. The exact quantities needed are unknown and may vary.

The contractors shall have the capability to simultaneously deliver large volumes of products to multiple locations within the United States.

g. Contract Pricing: Firm Fixed Price (FFP) type Contract for Supplies.

h. Product Delivery: Shipping must be free on board (FOB) destination CONUS (Continental U.S.), which means that the seller must deliver the goods on its conveyance at the destination specified by the buyer, and the seller is responsible for the cost of shipping and risk of loss prior to actual delivery at the specified destination.

B2 PRICING SHCEDULE

a. Period of Performance: The period of performance under this contract is the date of award to 12/31/2021 with four additional option years as listed below.

b. Option Year Prices: The Government have the option to extend the term of the contract.

Updated prices for any renewable option year will be requested from contractor(s) prior to the execution of any option year extension. The IDIQ holder shall provide the newest (the most current proven level of development available in each product model) design enhancements and technological updates at a fair and reasonable price. Each option shall include an updated price schedule and will be exercisable by issuance of a unilateral contract modification by the Government.

SECTION C: GENERAL REQUIREMENTS

1. Objective

To purchase new iPad Tablets and Accessories that complies with the Buy Indian Act. This acquisition will provide a standard method for all of BIE offices to order new iPad tablets and accessories in limited quantities or as part of a uniform lifecycle replacement.

To fulfill recurring needs required during the contract period of performance. The Government cannot predetermine the precise times and/or quantities of products. Specific deliveries of required products shall be scheduled by placement of individual Delivery Order when the need arises.

2. Changes

The Contracting Officer (CO), is the only person authorized to make or approve any changes in any of the requirements of this IDIQ, and notwithstanding any clauses contained elsewhere in this IDIQ, the said authority remains solely with the CO. In the event the Contractor makes any changes at the direction of any person other than the CO, the change will be considered to have been made without authority and no adjustment will be made to this IDIQ contract. Any changes authorized and approved by the CO will be issue in a formal written SF 30 modification to the contractor(s).

4. Equipment Condition:

New Equipment ONLY; NO remanufactured or “gray market” items. All items must be covered by the manufacturer’s warranty.

4.1. Technical Refresh.

In order to ensure new design enhancements and technological updates or advances, the IDIQ Holders shall provide “state of the art” technology, (i.e., the most current proven level of development available in each product model). Furthermore, if updates are available to other customers without charge, then they shall also be made available to the Government without additional charge.

The Contractor shall work with the CO to update technology on a yearly basis to accommodate “state of the art” technology changes provided the conditions below are satisfied.

a) The item substituted shall be fully compatible with the originally product and shall meet or exceed the original provided product technical specification provided in this IDIQ.

b) The item substituted shall be a commercial off-the-shelf (COTS) product or configuration.

c) The price of the item substituted, including any required custom services, support and warranty, shall be equal to or less than the current IDIQ price for the originally provided product.

The Contractor will propose a strategy that incorporates new technology advances that is both fair and reasonable and includes the government’s concurrence.

4.2. Items on Backorder. In their response to an individual delivery order, the contractor shall provide notification, if applicable, that a particular item is on backorder, the expected lead-time to fulfill the order, etc. It shall be implicit that a response to a request for quote with no items identified on backorder, is a declaration that the items are available at the time of quote submission.

4.3. Order Tracking (Property Accountability/Asset Management). The contractor must maintain an order tracking system that permits the ordering agencies to track the location of an order at any time, from the moment the order is shipped, to the point of delivery and acceptance.

4.4. Warranty. The contractors shall provide any OEM pass through warranty and standard commercial warranties applicable to the products being purchased at no cost. Additionally, extended warranties may be purchased as defined in each delivery order.

5. ORDERING PROCEDURES FAR 16.505

5.1. Product Delivery. All products under this IDIQ will be placed through issuance of individual delivery order in accordance with the terms and conditions, clauses and provisions, in full text or incorporated by reference, in this contract document. The contractors shall deliver the quantities of products to meet ordinary as well as fluctuating government requirements in accordance with agreed to delivery schedules stipulated in individual delivery orders.

NOTE: BIE special education program may have a special iPad order (not listed in the IDIQ price schedule) but is required to be used for special education student. Such item may require special apps or programs and may require expedited deliveries from IDIQ Holders that is imminently needed. Under such circumstance, the CO may place a special item DO under the terms of this IDIQ and the IDIQ Holder is hereby authorized to deliver such special iPad requirement at an agreed to fair and reasonable price.

5.2. Individuals authorized to purchase under the IDIQ: Only Indian Affairs COs are authorized to issue Delivery Orders against this IDIQ contract.

5.3. Completion of IDIQ Contract: This IDIQ contract is considered complete when the accumulative value of all DO’s issued under all IDIQ contracts equal its maximum contract amount $7M or at the end of the specific contract period, whichever is earliest.

5.4. Fair Opportunity Process.

6.4a. Price Reductions: IDIQ holder may not quote prices in excess of those specified in Section B2 Table - 1 Pricing Schedule of this IDIQ contract. To enhance competition, the IDIQ holder is encouraged to offer prices lower than those specified in the contract.

Pursuant to FAR 16.505(b)(1) and the procedures established herein, IDIQ holders shall be provided a fair opportunity to be considered for each order in excess of the micro-purchase threshold, unless the CO determines that one of the exceptions cited at FAR 16.505(b)(2) applies. Oral Order is not permitted.

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (April 2013)

Payment requests must be submitted electroniDeliveryy through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice

- A copy of the contractor’s invoice shall be included with the IPP invoice. If no invoice is attached, the Invoice will be rejected.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
