A.1 Type of Contract

The Department of Interior, Bureau of Indian Affairs (BIA) intends to award a firm fixed price contract from this solicitation for commercial services under Federal Acquisition Regulation (FAR) Part 12 Acquisition of Commercial Items and Part 13 Simplified Acquisition Procedures. .

North American Industry Classification System code (NAICS) is 115310, Support Activities for Forestry- Fuels Management Services, with a size standard of $34m.

A.2 Contract Term

The Government anticipates awarding a firm fixed price contract by September 1, 2024.

A.3 Set a-Side

This solicitation is an Indian Small Business Economic Enterprise (ISBEE) set-aside. Under the Buy Indian Act, 25 U.S.C. 47, offers are solicited only from Indian Economic Enterprises (Subpart 1480.8) that are also small business concerns. Any acquisition resulting from this solicitation will be from such a concern.

C - Description/Specifications

C.1 Background

The Fuels Management program within the U.S. Department of Interior, Bureau of Indian Affairs (BIA), Southern Plains Region (SPR) has been mandated to provide Hazardous Fuels Reduction (HFR) on Trust lands within the jurisdiction of the Region in Oklahoma, Texas and Kansas. One of the primary methods of providing this type of service is the mechanical removal of Eastern Red Cedar (ERC) and other undesirable vegetation. These actions are accomplished by hand thinning, machine thinning & piling Eastern Red Cedar (ERC), and/or Lop & Scatter of vertical ERC within a specified project boundary. The objective of this mechanical treatment is to remove 90% all ERC within the treatment perimeter. These actions seek to provide the ecological restoration of the native plant and animal communities present near Tribal homes, infrastructure, and adjacent communities. The HFR treatment will also reduce negative effects of catastrophic wildfire in and adjacent to Trust lands.

C.2 Statement of Work

A. The contractor shall furnish all necessary labor, transportation, equipment, qualified personnel, and material to complete the mechanical treatment of ERC and other undesirable vegetation.

B. All work will be inspected and approved in accordance with the standards specified below. Periodic inspections will be made on site during project implementation. The purpose of the inspections will be to review contactor activity to ensure adequate contactor performance. A final inspection will be made by bureau personnel once the contractor has concluded implementation at each project location. The purpose of the final inspection is to ensure that all project work has been completed according to the contract specifications. Inspections maybe limited to bureau personnel’s normal work schedule.

C. Personnel will utilize a compact track dozer, excavator, mechanized shredder and/or chainsaw. The compact track and/or excavator rubber track mounted vehicle is capable of shearing, falling, piling and completely shredding trees up to 14 inches in diameter. Specific actions will include a combination of activities below:

1. Lop & Scatter.

In Timbered areas, all ERC trees will be felled into smaller pieces (so they lay flat to the ground) and scattered about the forest floor. This method, commonly referred to as “lop and scatter”. Cut ERC slash will be a minimum depth of 24 inches (2 feet) from the ground.

All vertical ERC will be felled then flush cut at the base of the stem. Uprooting (pushing) of trees will not be allowed due to the potential for excessive soil disturbance. All stumps will be flush cut down to within 2 inches or below to ground level, or 2 inches above obstacles, such as surface rock.

Falling will be accomplished by heavy equipment and hand-Thinning.

In Open areas where grass is the predominate fuel model, all ERC <3 ft tall will be masticated and/or thinned & piled.

2. Thin and Pile

All ERC will be thinned and piled within the delineated project boundaries. Thinning should be accomplished via chainsaw; mechanical rotary saw or shear machine or machine attachment. ERC root balls must remain in the ground and intact to minimize ground disturbance. All stumps must be cut within 2 inches of ground level with no splintering; stumps must be a flat and smooth. All ERC piling should be completed in such a way that facilitates burning once the mechanical project is complete.

Piles must also be void of soil throughout to ensure thorough consumption of piled material for a follow-up prescribed burn project. All piles must be placed/piled a minimum of 100 yards from any project boundary, hardwood timber stands and/or improvements (structures, roadways, powerlines, pipelines, etc.) unless specifically approved by BIA personnel. All piles must have a minimum height of 14 ft, (dependent on available ERC). The height is given to reduce the need to burn numerous smaller piles throughout the treatment unit. There must be a 20-yard pile spacing between individual piles. Any/all burning will be completed by qualified BIA fire staff at later date.

D. All machinery that will be used will have a weight restriction of 16,000 pounds OR 8 PSI equipment ground pressure. This restriction seeks to minimize sub-surface ground disturbance.

E. All mechanical operations conducted will be avoid damage to fences, and other improvements. Any damage incurred will be reported to the Fuels manager as soon as possible.

E - Inspection and Acceptance

E.1 52.246-4 Inspection of Services-Fixed-Price (Aug 1996)

(a) Definition. “Services,” as used in this clause, includes services performed, workmanship, and material furnished or utilized in the performance of services.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

(c) The Government has the right to inspect and test all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government shall perform inspections and tests in a manner that will not unduly delay the work.

(d) If the Government performs inspections or tests on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties.

(e) If any of the services do not conform with contract requirements, the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by reperformance, the Government may-

(1) Require the Contractor to take necessary action to ensure that future performance conforms to contract requirements; and

(2) Reduce the contract price to reflect the reduced value of the services performed.

(f) If the Contractor fails to promptly perform the services again or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may-

(1) By contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service; or

(2) Terminate the contract for default

F.1 Period of Performance

It is anticipated that award will be made by September 1, 2024, so that all work can be completed during the month of September and/or October 2024. Contractor will have 30 calendar days once they start, to complete all work, weather permitting.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award.

The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor.

Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR mailto:jocelyn.littlechief@bia.gov has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e)The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk. (End of clause)

H.1 Work Hours

The performance period established for project work is based upon all work being conducted during regular working hours between 8:00am and 5:00pm, Monday through Friday, excluding Government holidays.

Prior approval is required to work weekends.

H.2 Wage Rates

Contractor is required to comply with current wage rates for Caddo County. A copy is provided as Attachment #2.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
