Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C250-20-AP-3866

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO) 10, Ann Arbor VA Medical Center, Dermatology Clinic, 2215 Fuller Road, Ann Arbor, MI 48105- 2303.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The VivaScope 1500 System which includes: VivaCam, PC, Display, Software and cart will provide Dermatologists the ability to read dermatologic/clinical biopsies in clinic. The imaging tool provides non-invasive, real-time images of the epidermis.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

IAW FAR 13-106-1(b)(i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. Per the Program Office the VivaScope 1500 system is the most advanced dermatology microscope on the market. The VivaScope provides superior technology that will reduce the amount of time MD staff spend looking at biopsies and improve patient flow thru the clinic.

4. Description of market research conducted and results or statement why it was not conducted:

Per the Program Office using personal knowledge of the VivaScope 1500 system and literature review this is the only equipment that will satisfy the requirement.

The CO’s market research included a VetBiz search using NACIS code 334510 and keyword “derm”. Strategic Acquisition Contracts were searched for mandatory national contracts none were found. GSA eLibrary was searched for GSA contracts and/or authorized distributors of the manufacturer. The search did not provide any additional information.

Due to the brand name only nature of the acquisition requirement the CO determined the VA Rule of 2 cannot be met to fulfill the requirement. Market research concluded an Intent to Sole Source should be post on Contract Opportunities to meet the requirement in FAR 13.106-1(b) and FAR 5.201(b)(1).
