Section B: Description of the Supplies/Services Required

This is a commercial single source acquisition. The Contractor shall provide all materials, parts, travel, tools, and to provide AGE Flight with the AIMCO Battery Lifter to the 402d Maintenance Support Group (MXSG) at Robins Air Force Base (AFB), Georgia. The AIMCO Battery Lifter provides uninterrupted, onsite, high-accuracy capability/support and solves all the safety constraints by manually lifting batteries up to 125 lbs .

The Contractor shall provide the following:

(1) Aimco Portable Battery Lifter

(1) Manufacturer's standard 1 year warranty effective on the date of shipping

The Contractor is required to provide installation or training for this equipment.

Delivery shall be completed no later than (NLT) two (2) weeks after contract award, to the following address utilizing FOB Destination:

Section C: Justification for Soliciting from a Single Source or Brand Name

AIMCO Portable Battery Lifter is a sole source commercial product. Due to the circumstances described herein, the activity requests authority to acquire AIMCO Portable Battery Lifter using Other Than Full and Open Competition (OTF&OC) prescribed by FAR 13.106-1(b)(1).

This procurement involves urgent and compelling circumstances. The urgency is due to the fact that the organization is currently at a work stoppage and are attempting to find temporary solutions until a battery lifter is procured.

There are available supplies possessed by only a contractor, AIMCO Manufacturing is one such manufacturer for this item, and there are regional distributors or product partners identified. AIMCO Manufacturing has propriety rights to the proposed Battery Lifter, additionally there is an authorized distributor, Applied Handling Systems Inc., that can provide the AIMCO Portable Battery Lifter. Applied Handling Systems Inc. is a full service material handling system integrator, serving customers throughout the Southeastern Region. During Market Research there was no other contractor or authorized distributors ultimately able to obtain these supplies under the constraints of the urgent and compelling circumstances.

Although there were no other contractors ultimately identified to obtain the Battery Handler under these compelling circumstances, extreme efforts were made to do so. Both organic and outside solutions were pursued. 3 prototypes were made, two of which failed. The first outside vendor, made prototypes but it failed threshold testing. The Organic internal effort by the Robins AFB Depot made a prototype which also failed threshold testing. The second outside vendor, AIMCO Manufacturing via Applied Handling Systems Inc., came on-site, completed measurements, and constructed a prototype that met threshold testing. Therefore, the only prototype to meet the requirements (out of the three tested) was the AIMCO Portable Battery Lifter

Going with another vendor will affect the government by continuing the work-stoppage for MXSG aircraft repairs. The costs associated with attempting to pursue a new vendor would cause delays to the mission and cause issues in MXSG since this AIMCO Battery lifter has proven to exceed all threshold testing and

April 2021 Page 3 of 4 would solve our urgent safety issues. There would be substantial duplication of cost, unacceptable delays, safety hazard, as well as issues related to re-engineering another Battery Handler that would cause a delay of at least 12 months.

Section D: Efforts to Obtain Competition

Market research was performed by reviewing the Dynamic Small Business Search (DSBS) and System for Award Management (SAM) databases using North American Industry Classification System (NAICS) Code 333923, (Overhead Traveling Crane, Hoist, and Monorail System Manufacturing). The NAICS Code was established by selecting Federal Supply Classification Code (FSC) or Product Service (PSC) Code 3950 (Winches, Hoists, Cranes, and Derricks) in addition to PSC Code 3920 (Material Handling Equipment, Nonself-Propelled). DSBS and SAM database queries also utilized keywords (Material Handling System, Battery Handler) in order to locate companies that could provide an AIMCO Battery Handler (see attached BAF 77331 DSBS Query - NAICS 333923 and Material Handling System). A review of small businesses to include 8(a), HUBZone, Service-Disabled Veteran Owned Business, and Women Owned Small Business was conducted in search of a company that could provide the AIMCO Battery Handler. The DSBS database query resulted in zero (0) small businesses or OEM authorized partners. Per the OEM website, the manufacturer does have authorized resellers, distributors, partners, and third-party vendors. The OEM has confirmed that there is only one local authorized provider for the AIMCO Battery Handler. GSA 2nd Generation IT (GSA 2Git) was also queried for any source that could provide an AIMCO Battery Handler, by using the specific key words and brand name of the requirement (AIMCO Battery Handler). However, this query resulted in zero (0) capable businesses. Mandatory sources such as Ability One and ESI were not considered since they are not applicable to the subject requirement. In review, there is (1) source, within DSBS or GSA, capable of providing an AIMCO Battery Handler for this urgent acquisition, which is also identified as the regional authorized re-seller. The recommendation is to post on Sam.gov for a sole source award to the OEMs authorized re-seller, Applied Handling Systems, INC.

In an effort to remove or overcome such a barrier to competition in the future, the market will be scanned frequently for new companies that could satisfy the government's requirements. Where possible, the government will prepare future requirement descriptions suitable for full and open competition.
