Section B: Description of the Supplies/Services Required

The Partner Support Complex Norway Italy Reprogramming Laboratory (NIRL) requires a Liquid Cooling Unit (LCU) system to protect unique test equipment and aircraft parts valued at over $172M; overheating of the unique test equipment would cause catastrophic damage. The NIRL requires a LCU's Service Program (LSP) to ensure the NIRL can perform the mission

. Additionally, it would also ensure NIRL has the ability to directly support operational mission data testing, ongoing programs, and war fighters engaged in combat. The requirement is for semi-annual maintenance of the LCU's for one base year plus four (4) option years.

Section C: Justification for Soliciting from a Single Source or Brand Name

The LCU PAO Chiller was designed, built and installed by Innoventor for the NIRL using the specifications provided by the government during the initial purchase. Innoventor sold the drawings, software and specifications to Butler America, LLC. The rights were then transferred to the current vendor, Gas Turbine Efficiency, LLC- a subsidiary of Butler America, LLC. Due to the proprietary nature of this system, Gas Turbine Efficiency, LLC is the only vendor capable of providing the desired upgrade maintenance without substantial duplication of cost which is not recoverable through open competition, as well as unacceptable delays in fulfilling its requirements. The use of this vendor to maintain this unique equipment is essential to the government requirements, thereby precluding consideration of another company.

Section D: Efforts to Obtain Competition

The customer and buyer made inquiries to different vendors, including the usual Air Force supply channels. Both also conducted market research in GSA Advantage for other similar product schedule holders. In addition, both made an extensive search of the Internet revealing no other sources capable of meeting any of the requirements. BEMCO Inc. and LYTRON companies were considered, however, although both companies provide similar products and services, neither could meet the unique technical requirements. A sources sought notice was posted to beta.SAM.gov on 04 Mar 20 under FA2823-20-Q-9009 requesting industry responses from vendors who were capable of satisfying the technical requirements; the notice closed on 13 Mar 20 with zero (0) responses received.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

The NIRL actively surveys the market place and reviews data and catalogs to preclude the necessity for sole source acquisitions.

The NIRL will continue to monitor the industry through perusal of trade journals, technical symposiums and contact with industry representatives. Any future requirements will be researched and if industry support meeting the requirements is identified then a competitive acquisition for the requirement will be considered.
