SINGLE SOURCE JUSTIFICATION NOT EXCEEDING THE SIMPLIFIED ACQUISTION
THRESHOLD
SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

Requiring Activity OBO/OPS/ART – Casablanca NCC Project
SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED
Approval is requested to award on a sole source basis to DAKICHA - L’Atelier 21 Art Gallery for the supplies and/or services described in Section 3 on behalf of the Requiring Activity.
SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
The requirement is to provide works of art, at the new Consulate Casablanca. The estimated value for the entire period of performance is $ 110,800 for six works of art. These supplies/services require that
L’Atelier 21 Art Gallery provide four paintings by Najia Mehadji, each 200cm x 200cm at $15,975 each, one painting by Safaa Erruas 120 x 230 cm, at $21,600, and one sculpture by Ikram Kabbaj, 112 x 70x25cm at
$24,300. In addition, there is $1000 for shipping/delivery costs. To allow the Office of Art in Embassies to accomplish its mission of cultural exchange within the Department of State mission, only specific works of art can be procured for their specific style, cultural relevance, medium, and scale as these works are part of the mission to highlight US artists. These artists were chosen by the Office of Art in Embassies
Curatorial Committee. L’Atelier 21 Art Gallery will provide the total of six artworks, based on design and creation details approved by OBO/ART.
SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION
In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:
☒ Other – Artwork is unique and singularly created, not mass produced. Specific pieces and artists are chosen for their specific style, cultural relevance, medium, and scale to accomplish the DOS mission of cultural exchange.
SECTION 5: DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE
QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY
CITED
L’Atelier 21 Art Gallery is the vendor chosen by the Office of Art in Embassies Curatorial Committee as the artists they represent are uniquely qualified. Public art which will be presented in the new US Consulate in
Casablanca, Morocco must reflect the values of the United States. It will meet the unique artistic criteria which has been established for use at US Embassies and consulates. Based on purchases for similar works, the price is fair and reasonable. These works of art/services are sought for their specific technique, style, medium, or background and often must be negotiated into meeting the Government’s price limitations.
Market research includes surveying all contemporary art journals, publications, and books; attending contemporary domestic and international art fairs; attending related museum exhibitions and gallery exhibitions; and consulting with related field experts such as dealers, specialized curators, and librarians.
Emphasis and selection factors include the culture of the host country and artistic heritage. The mission of cross-cultural exchange through the visual arts is the objective.
Because of the unique nature of this type of procurement for representational art to support the mission of cultural exchange within the Department of State mission, only specific works of art can be procured for their specific style, cultural relevance, medium, and scale as these works are part of the mission to highlight US and Host country artists. Each project is unique as the buildings and host countries change.
ART does not homogenize the collections but works to ensure their relevance. The works of art procured for each project have some cultural relevance that is considered in highlighting the parallels and differences between our cultures.
SECTION 6. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST
TO THE GOVERNMENT IS FAIR AND REASONABLE
By signing the justification, the Contracting Officer makes a determination that the price to the Government is anticipated to be fair and reasonable.
SECTION 7. CERTIFICATIONS
All reviews and approvals should be completed in the order listed unless otherwise authorized or required.
