About this file

This is a Single Source Justification document for a simplified acquisition under the Simplified Acquisition Threshold (SAT) of $250,000 for the Department of Veterans Affairs VISN 02 Manhattan VA Medical Center. The justification supports awarding a $28,190.85 contract to Graybar Electric Company Inc. for emergency repairs of an inoperable Schneider Electric Galaxy 5000 Uninterruptible Power Supply (UPS) that powers an Azurion machine in the Hybrid Operating Room.

The justification cites unusual and compelling urgency as the basis for the sole source award, as the UPS system is critical for providing uninterrupted power during surgical procedures. Graybar Electric Company is an authorized distributor for Schneider Electric (the OEM) with immediate access to inventory and staff. While market research identified 315 businesses under NAICS code 811210 in VetCert and 39 potential companies in DSBS, the emergency nature of the repairs and need for OEM parts justified selecting Graybar. The original equipment was installed by Schneider Electric in 2012, but their APC division could not be directly awarded the work due to lacking a SAM registration. The justification was signed by Contracting Officer Jacob Burg on February 7, 2025.

VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT

Revision: 01 Effective Date: 11/15/2024 Page 1 of 2 Acquisition ID#:

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C242-25-AP-1677

1. Contracting Activity: Department of Veterans Affairs, VISN 02, Margaret Cochran Corbin Manhattan

VA Medical Center.

2237 # 630-25-2-6084-0080.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Emergency Repairs for its inoperable Schneider Electric Galaxy 5000 Uninterruptible Power Supply (UPS) that powers an Azurion machine located in Hybrid Operating Room (OR). The Azurion machine in the Hybrid OR is a mission-critical medical system that requires a continuous and stable power supply to ensure uninterrupted patient care during surgical procedures. This is the only UPS system connected, and any power disruptions could lead to equipment failure during critical Veteran operations. Replacement of DC capacitors, charging circuit, circuit board, and batteries is the only guaranteed way this system won’t fail during use. Estimated amount of $28,190.85.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Unusual and Compelling Urgency per 41 USC 3304(a)(2) as implemented by FAR 6.302-2.

Graybar Electric Company Inc is an authorized distributor for Schneider Electric the OEM of the MGE Galaxy 5000 80 kVA installed at the Manhattan VA Medical Center. This urgent and compelling need to immediately respond and repair equipment that is used in the performance of surgeries is vital.

Graybar Electric Company has staff and inventory ready to be utilized for this immediate need.

Finding another alternative vendor would cause additional unnecessary delays in repair costing additional future scheduled surgeries to be interrupted.

4. Description of market research conducted and results or statement why it was not conducted:

A search on Veterans Small Business Certification (VetCert) website using NAICS Code 811210 found 315 businesses. Without a way to sort this data, the ability to find a company to specifically perform UPS repair inefficient.

A search on Small Business Administration (SBA) Dynamic Small Business Search (DSBS) with NAICS code 811210 and keyword of “UPS” listed 39 companies that potentially may be able to service the repair but given this emergency its very unlikely one would be able to be on site and coordinate with obtaining supplies from OEM Schneider Electric to perform emergency repair service.

Schneider Electric was identified as the Original Equipment Manufacturer (OEM) of the UPS Galaxy 5000 80 kVA unit located at Manhattan VA Medical Center. It also installed the equipment back in 2012. No other documented service report was found. A requested quote was provided; however, it was mentioned by the Schneider representative that their APC division who would be performing the repair does not have its own SAM account and cannot be directly awarded to. Further conversation with Schneider Rep provided an authorized distributor company named Graybar Electric Company that has Schneider inventory and project management oversite capabilities. Writer contacted Graybar to confirm availability, resources, and to provide a quote. Graybar sent quote to immediately address all needs of this emergency repair service.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
