About this file
This is a Justification for RFO 12.102 Single Source Award from the National Institute of Standards and Technology (NIST).
NIST plans to award a single-source, firm fixed-price contract valued at $511,800.00 to The Albeiro Energy, LLC (UEI: Y6M1DKF55BF3) of Edison, New Jersey for preventative maintenance and emergency services for the Alerton Envision for BACtalk Control systems at the NIST Gaithersburg Campus in Maryland. The contract covers maintenance and firmware upgrades to existing devices and systems but excludes new building automation services for new construction. The period of performance includes one base year plus four option years, with an additional option to extend services up to six months. The services fall under NAICS 541519 (Other Computer Related Services) and PSC Z1JZ (Maintenance of Miscellaneous Buildings) and are subject to Service Contract Labor Standards (SCLS). The current contract with Albeiro Energy expires August 31, 2026.
The justification for sole-source procurement is based on Alerton being the original equipment manufacturer with a signed statement confirming that only Albeiro Energy can sell, install, and service Alerton systems in the Maryland area. Albeiro Energy possesses factory-trained personnel and proprietary product expertise essential for maintaining the systems. NIST determined that replacing the existing Alerton system would cost $20 million to $25 million and create significant technical, schedule, and cost risks. Market research was conducted in February 2026 and a combined Sources Sought/Notice of Intent to Sole Source was posted on SAM.gov from July 20-27, 2026, which received no qualified vendor responses. The $511,800.00 Independent Government Cost Estimate is based on historical pricing data and deemed fair and reasonable prior to award.

JUSTIFICATION FOR RFO 12.102 SINGLE SOURCE AWARD
I. CONTRACTING ACTIVITY
The National Institute of Standards and Technology (NIST) plans to contract on a single source basis to provide preventative maintenance and emergency services for the Alerton Envision for BACtalk Control systems at the Gaithersburg Campus located in Maryland. The service required is for maintenance and firmware upgrades to existing devices and systems. This service does not include new building automation services for new construction.
The vendor is The Albeiro Energy, LLC of Edison, NJ, 08817-2855 (SAM UEI:
Y6M1DKF55BF3).
II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED
The action will be awarded as one (1) firm fixed price contract for the preventative maintenance and emergency services for the Alerton Envision for BACtalk Control systems at the Gaithersburg Campus located in Maryland.
The Independent Government Cost Estimate (IGCE) for these services is $511,800.00.
Per RFO Part 2, micro purchase threshold (MPT) is $15,000, except for acquisitions of services subject to 41 U.S.C. chapter 67, Service Contract Labor Standards (SCLS), $2,500. This acquisition is for preventative maintenance and emergency services, which are subject to the
SCLS.
The cost is above the Simplified Acquisition Threshold (SAT) OF $350,000.00 for SCLS services and will be procured utilizing RFO 12.102(b) for Simplified Procedures.
NAICS: 541519 – Other Computer Related Services
PSC: Z1JZ – Maintenance of Miscellaneous Buildings
The anticipated awardee currently performs the same services for Alerton Envision for BACtalk Control systems at the Gaithersburg Campus located in Maryland under Purchase Order 1333ND23PNB190390. The current contract expires on August 31, 2026.
III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE
AGENCY’S NEEDS
Contractor is to provide all labor, supervision, tools, material, and equipment to provide preventative maintenance and emergency services for the Alerton Envision for BACtalk Control systems specified. The Contractor must maintain systems to ensure systems are in proper operating order.
The period of performance of the single source contract will be one base year plus four (4) option years with an additional option to extend services up to six (6) months via RFO 52.217-8..
IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
This is a RFO 12.102(b), Restricting Competition, Sole Source Procurement for the only one responsible source over the Simplified Acquisition Threshold (SAT) under the authority of 41 U.S.C. 1901.
V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE
QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF
THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)
Alerton is the original manufacturer of the systems this requirement will service. Alerton provided a signed statement confirming that only Albeiro Energy, LLC can sell, install, and service Alerton systems in the area where the NIST Gaithersburg, MD campus is located.
Additionally, the letter stated that customer service, training, and warranty services for Alerton are only available through approved Alerton dealers. Albeiro Energy has Alerton factory-trained personnel on staff and has access to proprietary products and information that are part of the Alerton Building Management System. Albeiro Energy, LLC is the only source NIST may utilize to provide preventative maintenance for Alerton systems.
There are currently four (4) proprietary building automation systems used to control various mechanical equipment that maintain the required environmental conditions on campus. The Alerton Envision for BACtalk Control Systems pertains to this automation on the NIST Gaithersburg, MD Campus. The estimated cost to replace this single proprietary system with another proprietary system has been evaluated between $20 Million to $25 Million, and at the present time it has been determined by OFPM management to be more necessary to maintain than replace.
VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE
Per RFO 5.101(a), a Pre-Solicitation Notice was posted on the Government Point of Entry (GPE) SAM.gov. The notice was posted under Notice ID OFPM_TEAM_SS26_29 as a combined Sources Sought and Notice of Intent to Sole Source from 20 July 2026 to 1pm EST, 27 July 2026, inviting interested vendors who feel they can provide this service to provide a response to this notification. NIST did not receive a single qualified and interested vendor response to this notice.
This acquisition does not meet any of the exceptions under RFO 5.101(b); therefore, an award notice will be posted to SAM.gov at award.
VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE
The $511,800.00 IGCE is based upon historical pricing data and the current contract 1333ND23PNB190390, which was previously deemed fair and reasonable prior to award.
The proposed price from Albeiro Energy LLC will be reviewed for fairness and reasonableness based upon historical data and IGCE prior to being awarded. The CO does in fact anticipate Albeiro Energy LLC’s price will be fair and reasonable.
VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT
CONDUCTED
Market research was performed by NIST OFPM in February of 2026. OFPM concluded that replacing Albireo Energy, LLC would require NIST to replace the entire Alerton proprietary system with another proprietary system and thus create heavy technical, schedule, and costs risks.
Acquisition Management Division (AMD) conducted additional market research, including contacting Alerton and verifying that no other companies can provide OEM servicing and proprietary product expertise for the existing Alerton systems.
A combined Sources Sought/ Notice of Intent to Sole Source Notification ID OFPM_TEAM_SS26_29 was posted on SAM from 20 July 2026 to 1pm EST, 27 July 2026, inviting interested vendors who feel they can provide this service to provide a response to this notification. NIST did not receive a single qualified and interested vendor in response to this notice.
No additional barriers to competition were established by NIST with this purchase. It was determined that only Albireo Energy LLC could meet all the requirements. Any other existing commercial or noncommercial solution would be extremely costly and timely prohibitive and would not provide the government with the best value solution. Therefore, award will be made to Albireo Energy LLC.
IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND
OPEN COMPETITION
None.
X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE
ACQUISITION
None.
XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO
REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING
SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED
AMD will closely scrutinize any requirements for subsequent acquisitions and will ensure that any restrictions to competition are adequately supported and documented. In addition, during the expected lifecycle of this equipment, NIST will work to identify additional services that could meet its requirements, to the extent NIST will ever consider switching systems.
