About this file

This document is a Sole Source (Including Brand Name) Justification for Simplified Procedures for Certain Commercial Items for Trane HVAC equipment training. The United States Air Force Civil Engineer Center requires specialized training for Heating, Ventilation, Air Conditioning, and Refrigeration (HVAC/R) military and civilian personnel worldwide. The training will be provided exclusively by Trane U.S. Inc. and covers comprehensive technical instruction including electrical troubleshooting, refrigeration systems, chilled water systems, commercial HVAC service, and specific training on Trane equipment like Precedent/Voyager rooftops, RTAC rotary chillers, and CGAM air-cooled scroll chillers.

The justification details that Trane U.S. Inc. is the sole source due to its unique capability to provide training specifically tailored to their HVAC equipment. The training will be conducted over a three-year ordering period, with annual sessions for different technical modules, limited to 12-20 students per module. Market research was conducted through a sources sought notice on SAM.gov in November 2024, which yielded only one response from Trane. The Air Force determined that switching to another vendor or system would not be in the government's best interest, citing potential increased costs, operational disruptions, and the need to train personnel on multiple equipment systems.

IV. Statutory authority permitting other than full and open competition.

DAFFARS 5313.501 - 10 U.S.C. 3572, Implementation of Simplified Acquisition Procedures (41 U.S.C. 1901). Only one responsible source and no other supplies or services will satisfy agency requirements.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The acquisition of Trane equipment training is a critical requirement for ensuring the security and safety of personnel in USAF facilities. The unique qualifications and nature of this acquisition necessitate the use of

March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 5 of 7March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 5 of 7 a sole source procurement method.

The training requirements for the Trane U.S Inc. equipment are specific and cannot be met by other vendors. The training package listed in the procurement package is tailored to the Trane HVAC equipment, and only Trane U.S Inc. can provide the necessary training to ensure that personnel are adequately trained to operate and maintain the systems.

A Class J&A has been created, which covers all USAF facility HVAC chiller purchases through 30 September 2029. This J&A demonstrates that the procurement of Brand name HVAC chillers is a justified sole source acquisition, as it is essential for meeting the critical safety and security needs of USAF and government facilities.

Trane U.S Inc. is the only vendor capable of fulfilling the training requirements for the HVAC equipment. The creator of the HVAC equipment (Trane U.S Inc.) has the best knowledge of the systems to ensure that the training provided is comprehensive and effective, which is essential for ensuring the safety and security of personnel.

The unique qualifications and nature of the acquisition, including the essential equipment, lack of trained personnel, unique training requirements, Class J&A, exclusive capability, and large-scale procurement, justify the use of a sole source procurement method for the acquisition of Trane HVAC training. Trane U.S Inc. is the only vendor capable of meeting the critical safety and security needs of USAF facilities, and their selection is essential for ensuring the safety and security of personnel.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

In an effort to solicit offers from as many potential sources as practicable, the Air Force conducted thorough market research beginning in November 2024. The following steps were taken to ensure a competitive solicitation process.

A sources sought notice was posted on SAM.gov on November 22, 2024, under the reference number FA8051_TraneHVACTrainingSourcesSought. The notice outlined the Air Force's requirement for Trane HVAC training and provided a detailed Statement of Objectives.

The sources sought notice required respondents to specify their authorization and capability to perform training for Trane Equipment systems. Additionally, respondents were required to demonstrate their ability to provide software, tools, and parts necessary for system compatibility and fulfill all services outlined in the Statement of Objectives. Only one response was received in response to the sources sought notice this was Trane U.S Inc.

The response was evaluated, and it was determined that the respondent had the capability to fulfill the requirement, including training on Trane brand systems.

Further market research was conducted by communication with the Program Manager. They stated that previous purchases had been made using the Government Purchase Card (GPC).

On 26 November, 2024, written confirmation was received from Trane U.S Inc. stating that they do not have any authorized providers for their training and that a sole-source procurement would be necessary.

Through these efforts, the Air Force has ensured that all practicable steps have been taken to solicit offers from potential sources, ultimately leading to the determination that a sole-source procurement is necessary due to Trane U.S Inc.'s lack of authorized training providers.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine the price for this award to be fair and reasonable in accordance with the proposal analysis techniques in FAR 13.106-3.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

The following market research was conducted:

-Sources Sought Notice posted in November of 2024 only one person to respond with the capability of fulfilling this requirement was Trane.

-Internet Search -Previous contracts in place specifying the use of Trane HVAC equiment -Contacted Trane directly on 26/NOV/2024 for a brochure and detailed description of possibilities.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

None.

X. List of any sources that expressed, in writing, an interest in the acquisition.

See section VI above.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

The Air Force will continue to research the marketplace on a continual basis to determine if other sources other than Monaco can provide these training services. This includes conducting market research prior to exercise of future option periods.

Switching to a different company or buying a new system would not be in the government's best interest.

Adopting a different HVAC equipment system would not satisfy agency requirements based on the governments use of Trane HVAC equipment.

Secondly, there would be a need to train personnel on multiple sets of equipment and software would not be prudent from a category management perspective, as it would result in increased costs and resources.

Furthermore, the time and effort required for transitioning to a new system may lead to disruptions in our operations and potential delays in making critical decisions and upgrades.

In accordance with DFARS 213.501(a)(i) and DFARS PGI 206.304 (a)(S-70) the approval authority has determined the planned actions to remove any barriers to competition, cited on the previous justification, were completed.
