Revised December 2010

All personnel responsible for developing, reviewing and approving a single source determination shall ensure that sound business judgment is applied in researching, documenting and approving such actions.

The rationale for a single source determination is not constrained by this form. If filled out electronically, the form will expand to the written narrative. If not available electronically, the drafter shall attach continuation sheets to ensure rationale is fully supported.

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION

THRESHOLD AS DEFINED IN FAR 2.101

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:

QUOTE/SOLICITATION NUMBER: ACQR 5780498

ESTIMATED AMOUNT (Not exceeding $250,000): $240,000

DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The services required are to address high event-to-event variability in measured groundwater contaminate concentration data using a time-integrated sampler. At present, there is no reliable tool that can measure long term trends for low contaminate concentrations (< 50 ppb). The collection of time-integrated concentration measurements can significantly reduce event-to-event variability and improve the ability to accurately demonstrate remedy effectiveness. The contractor will validate sampler uptake rates for VOCS most commonly found at DoD sites and demonstrate in the field its effectiveness to reduce short-term variability in groundwater contaminate concentrations, while also developing a user guide to aid in properly using time-integrated samplers.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR

SERVICES CAN BE USED:

This project is funded through the Navy Environmental Sustainability Development to Integration (NESDI) program, which was approved through a competitive process amongst other Navy departments (i.e. NAVAIR, NAVSEA, NAVFAC, NIWIC). NAVFAC EXWC (EV31) collaborated with Dr.

Tom McHugh from Groundwater Services, INC (GSI). These two parties jointly submitted a NESDI research proposal, which was approved based on technical merits and determined by the NESDI review committee to be best suited to complete the requested research need.

Dr. McHugh from GSI is acknowledged in the industry as one of the leading experts on the remediation of volatile organic compounds (VOCs) in the world today and well regarded by regulatory agencies like USEPA that regulates the Navy’s legacy sites. He is also the primary expert in the field of VOC sampling using novel, cost effective methods. Dr. McHugh is well versed with the project needs. He has experience at the Navy demonstration site proposed in this study (NAS North Island), and has the experience and hands-on knowledge necessary in both VOCs and groundwater samplers to complete the project within the 2 year period of performance planned for this study (January 29, 2022).

Awarding to another contractor would require a duplication of the efforts already expended as another contractor would need to educate themselves on the project requirements, familiarize themselves on time-integrated samplers used at the demonstration site, review historical documents from the demonstration site, and establish networks with vendors do develop novel time-integrated samplers and acquire necessary laboratory equipment to evaluate uptake rates and analyze chemical compounds in the samplers. Further, GSI has developed a time-integrated sampler that allows for 6-months of continuous sampling, which is proprietary to this company. No other leading competitors have developed a time-integrated sampler that can match or exceed their product, which will yield significant savings to the DoD’s monitoring program if this can be validated.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:

Dr. McHugh is acknowledged in the industry as a leading expert on VOCs in the world today and well regarded by regulatory agencies like USEPA that regulates the Navy’s legacy sites.

Dr. McHugh was the Principal Investigator for ESTCP ER-1601 and ER-1705, which were two 2-year research projects funded by the U.S. DoD to demonstrate and various groundwater samplers to reduce short-term variability for groundwater sampling.

Dr. McHugh was the primary author of 4 peer-reviewed journal articles on factors that influence variability in groundwater monitoring data and how to reduce short-term variability during groundwater sampling.

Dr. McHugh was a member of the ITRC Groundwater Statistics workgroup and is a co-author of the ITRC Guidance Document "Groundwater Statistics for Monitoring and Compliance".

Dr. McHugh is the inventor of a patented sampler for collection of long duration time-integrated sample from monitoring wells.

Dr. McHugh supported the preparation of the training model on Groundwater Sampling methods for the 2019 RITS.

Dr. McHugh has conducted and analyzed hundreds of groundwater sampling results using various groundwater sampling technologies.

Dr. McHugh has attended and presented the results of his research at several SERDP/ ESTCP conferences.

Dr. McHugh is one of the few leading subject matter experts in the field of groundwater monitoring and has drafted guidance documents which are the leading standard for addressing short-term variability.

Revised December 2010

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE:

Based on the foregoing the Navy has determined that awarding to another contractor would result in a duplication of costs that would not be recovered through competition and awarding to another contractor would incur unacceptable schedule delays.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED: Not Applicable, no future actions are contemplated.

I certify that the statements above are complete and correct to the best of my knowledge.
