About this file

This document is a Single Source Determination using Simplified Acquisition Procedures (SAP) for a contract extension with the Kentucky Authority for Educational Television (KET). The document authorizes a seventy-seven (77) day extension of current preventative maintenance, logistical, and system support services for the National Weather Service (NWS) All-Hazards Weather Radio (NWR) network in Kentucky. The extension, valued at $39,390.25 and executed as a firm-fixed-price contract, is designed to provide ongoing protection of life and property while NOAA works to award a follow-on contract. KET is identified as the sole source due to its unique position as a state agency with the ability to house NWS transmitters on Kentucky State facilities and own the communication network handling all NWR transmissions in Kentucky.

The justification highlights KET's critical role in maintaining the NWR network across thirteen transmitter sites in Kentucky, including locations in Elizabethtown, Hazard, Lexington, Louisville, and others. The single-source determination emphasizes that attempting to use alternative sources would require costly and disruptive site leases, potentially compromising the 24/7 emergency weather communication system. The contract is being executed under the Department of Commerce, specifically through NOAA's Acquisition and Grants Office, Western Acquisition Division, and the National Weather Service Central Region Headquarters.

SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

REQ 142030-25-0112

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), Western Acquisition Division (WAD) and National Weather Service, Central Region Headquarters (NWS CRH).

2. Description of supplies or services required to meet agency needs (including the estimated value).

In accordance with FAR 52.217-8 - OPTION TO EXTEND SERVICES (NOV 1999), contract 1305M220CNWWR0058 P25010 will provide a seventy-seven (77) day extension of the current preventative scheduled and unscheduled maintenance, logistical and system support services that are in place for the National Oceanic and Atmospheric Administration (NOAA), National Weather Service (NWS) All-Hazards Weather Radio (NWR). This extension of services will provide ongoing protection of life and property for the residents of Kentucky while working to award the follow-on contract for these services to continue beyond the current period of performance.

The purpose of this action is to extend services for seventy-seven (77) days in accordance with FAR 52.217-8. At the time of award, the price evaluation did not include the evaluation of FAR 52.217-8 in accordance with NAM 1330-17.203(b). This action is to include the evaluation and make a fair and reasonable determination per the aforementioned NAM reference.

Requisition 142030-25-0112 provides funding for the aforementioned extension of these services for seventy-seven (77) days after the period of performance for Option Period IV ends. This is a firm-fixed-price contract in the amount of $39,390.25.

3. Identification of the single source or the brand name to be solicited.

Name: Kentucky Authority for Educational Television (KET) Address: 600 Cooper DR, Lexington, Kentucky 40502-1669 Point of Contact: Elaine Crawford Phone number: (859) 258-7000

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:

Other - Only one source is capable - Kentucky Authority for Educational Television (KET) is the only responsible source to satisfy agency requirements. The services provided by the Kentucky Authority for Educational Television are unique due to the fact they are a state agency with the ability to house transmitters owned by the NWS on Kentucky State owned facilities. KET also owns the communication network that handles all of the NWR transmissions in the state of Kentucky. They do not permit unescorted access to their public safety areas or State of Kentucky equipment. This includes any state microwave backhaul equipment utilized by NOAA for network connectivity. If the NWS were to attempt to utilize any other source, specific site leases would be required for each of the thirteen (13) NWR network transmitter sites located in Ashland, Bowling Green, Covington,
