About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) submitted by the U.S. Department of State's Bureau of Global Acquisitions for a sole-source contract award.

The Department of State Acquisition Management office seeks approval to award a new firm fixed-price indefinite quantity/indefinite delivery contract to provide exhumation support services and equipment, as well as excavator maintenance and repair services before, during, and after Defense POW/MIA Accounting Agency (DPAA) operations at Manila American Cemetery and Memorial. The estimated contract value is redacted, with pricing for the first year and entire contract period also redacted. The contractor possesses unique qualifications including purpose-built custom equipment (A-frames for lifting caskets exceeding 1,000 pounds, specialized wheeled trays, and portable custom tracks), extensive excavation experience with over a redacted number of graves, and established status as a trusted agent of the American Battle Monuments Commission (ABMC). The contracting activity is the Defense POW/MIA Accounting Agency, with the requiring activity identified as the same. The statutory authority for this procurement is 41 U.S. Code 1901 as implemented by FAR 12.000 and FAR 12.102(b). Market research was conducted but yielded no alternative sources with the required combination of specialized equipment, experience, ABMC cemetery familiarity, and demonstrated capability to safely support disinterment operations. No public notice was issued under FAR 5.101(b)(1)(ii) citing the sensitive nature of the procurement. The Contracting Officer determined anticipated pricing is fair and reasonable based on historical cost data; the contractor has provided exhumation support services since 2016 with only minor increases below cost-of-living adjustments. The justification was digitally signed on July 1, 2026, by the Contracting Officer and approved by the Branch Chief of the Bureau of Global Acquisitions.

@ Global Acquisitions w U.S. DEPARTMENT of STATE

a. Several previous contract awards have been successfully completed, most recently all three years of a base +2 IDIQ contract (contract number 19GE5023D0030).

Estimated cost to US Government of this sole-source contract would be within inflationary cost of previous contracts with same vendor, whereas a new contractor would require significant additional overhead and time to obtain the specialized equipment referenced above ( other contractors would need to fabricate such custom equipment, as the equipment is not commerciall available .

SECTION 6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS WERE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY FAR SUBPART 5.1 AND, IF NOT, WHICH EXCEPTION UNDER

FAR 5.l0l(B) APPLIES

The proposed contract was not solicited to multiple companies due to specialized nature of the requirements laid out in Section 5.

Additional market research has been conducted for this acquisition, but no other firms have been found that possess the combination of experience, specialized equipment, familiarity with ABMC cemetery, and demonstrated ability to safely support disinterment operations at the standards required by ABMC and DPAA.

IAW Federal Acquisition Regulation (FAR)5.101(b)(l )(ii) considering the sensitive nature of this procurement, it was decide to not publicize a notice.

SECTION 7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT IS FAIR AND REASONABLE

The Contracting Office has determined that the anticipated price( s) will be fair and reasonable based historical prices; DP AA has utilized Exhumation Support Services provided by same contractor since 2016, with only minor increases (less than cost of living) over that timeframe.

With this contract being within the same scope as previous contracts, we anticipate similar pricing. By signing the justification, the Contracting Officer makes a determination that the -er grave is expected to be fair and reasonable.

SECTION 8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE

PART 10) AND THE RESULTS OR A STATEMENT OF THE REASON A MARKET

RESEARCH WAS NOT CONDUCTED

Additional market research will continue to be conducted for this acquisition, but there is low expectation that it will yield additional sources for the reasons discussed in Sections 5 and 6.

However, if there are responses to the notice of intent to sole source, they will be evaluated on their technical merits.

SECTION 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER

THAN FULL AND OPEN COMPETITION

Contractor is a trusted service provider for the hallowed Manila American Cemetery and Memorial.

SECTION 10. LISTING OF SOURCES, IF ANY, THAT EXPRESSED A WRITTEN

INTEREST IN THE AC UISITION

To date, no other sources have written to express an interest.
