About this file
This is an Emergency Purchase Extension Approval document submitted by the Illinois Department of Veterans Affairs (DVA) Division for the Illinois Veterans' Home at LaSalle, a 190-bed long-term skilled nursing facility serving Illinois veterans. The extension approval authorizes continued pharmacy services through JHC Acquisition, LLC d/b/a Omnicare of Northern Illinois for the period of January 14, 2026 through April 13, 2026. The contractor must provide complete pharmacy services in accordance with applicable local, state, and federal regulations, including a calendar cycle refill system available twenty-four hours daily, seven days per week, 365 days per year with refill-on-demand capability. Services include provision of medication carts with appropriate security and narcotic lock boxes, quarterly maintenance and inspection of carts and related materials, and delivery six days per week. The extension is necessary to allow time for the completion of a two-week protest period following the submission of a new competitive bid (IFB B-48971) and to enable transition to a new vendor, with services expected to begin around March 1, 2026. The original emergency contract (B-48698) ran from July 18, 2025 through October 15, 2025, and a prior extension (B-49330) extended services from October 16, 2025 through January 13, 2026.
The estimated contract extension amount is $150,000, matching the original contract value. No Business Enterprise Program (BEP) participation is identified for this extension; the agency documented that Omnicare cannot utilize BEP vendors due to an exclusive wholesale supplier agreement with McKesson, in-house delivery operations staffed by company employees, and patient safety and continuity of care concerns regarding prescription dispensing through multiple pharmacy locations. The agency documented outreach to five BEP vendors in July 2025, all of whom declined participation due to the short contract duration or inability to provide required services. The emergency contract was necessitated when the previous vendor's BEP goals were denied a waiver. The Chief Procurement Officer approved the extension on January 5, 2026, following approvals from the Agency Procurement Officer on December 31, 2025 and the State Procurement Officer on January 2, 2026. Without this extension, the facility would be unable to provide vital prescription medications to veterans, creating a threat to resident health and safety.

Is there BEP participation on this contract? If no, explain why
LaSalle Home reached out to vendor, Omnicare, current vendor, to see if there were any changes since emergency started to work with BEP vendors. They stated they are not able to for the same reasons they gave on initial emergency see below.
LaSalle Home was in immediate need to provide pharmaceuticals to their residents to make sure all residents receive their prescribed medication in a timely manner. Agency reached out to Omnicare, current vendor, to ask if there was any aspect of the contract that can be provided by BEP vendors. Omnicare is not able to subcontract for reasons below:
1) Omnicare cannot utilize any wholesaler other than McKesson. While we did reach out to a BEP wholesaler previously, there is no potential for any subcontracting arrangement as Omnicare’s contract with McKesson provides McKesson is “the sole wholesale supplier” to all Omnicare pharmacy locations.
2) Unlike our competitors, Omnicare employs their own delivery drivers and has their own fleet of delivery vehicles. To the extent other pharmacies subcontract pharmacy delivery to third parties, Omnicare’s entire delivery operation is provided by their employees with no need to outsource. We have significant concerns about how a one-off third-party delivery courier used for this building could affect not only their pharmacy operation, but how it would also create challenges for staff at the facility.
3) To the extent there is any thought that Omnicare should subcontract with another pharmacy to dispense a portion of the prescriptions, Omnicare has concerns pertaining to patient safety and continuity of care. While Omnicare does work with CVS retail to dispense emergency prescriptions locally in the event the pharmacy is closed (our Des Plaines pharmacy operates 24/7/365, so this doesn’t happen often), non-emergency prescriptions are never dispensed through another pharmacy through any sort of subcontracting arrangement. Omnicare is reluctant to enter into any sort of arrangement to do so as this will, again, create confusion from the facility about what prescriptions are coming from which pharmacy, potential for prescriptions to be sent to multiple pharmacies by prescribers, challenges at the facility when reviewing invoices, challenges with pharmacy medical records, and many other patient safety, pharmacy operation and facility operation concerns.
Agencies initial efforts to secure a BEP vendor for the emergency are as follows:
Agency reached out to the following BEP vendors to see if they could take on the services we need for this emergency.

1. Provide detail about the events that led the agency to conduct an emergency procurement:
Illinois Department of Veterans Affairs - LaSalle Home is currently in an emergency contract for pharmacy services. The agency had a contract in place and a vendor from the community brought to the agencies attention that the goal changed. The previous contract had to be canceled due to BEP goals were denied a waiver which is why it is now an emergency contract. The LaSalle Home does not have an On-Site Pharmacy and needs to contract out with a vendor to ensure continued Pharmaceutical operations at the Home. The current vendor was the low price responsive bidder on B-47044, JHC Acquisition, LLC/dba Omnicare of Northern Illinois. We continued with this vendor during the emergency as the home is all set up with working with them and using their med carts, they deliver 6 days a week to the home. This emergency extension contract will be canceled when the new competitively bid contract is in place. We have submitted IFB/B-48971 to award to a new vendor for review and there will be a two-week protest period and then time will be needed for the vendor to transition the new services, expecting new services to begin around March 1, 2026. Transition to include: Bidder needs to set up all residents in their system before operation begins. Sending Face sheets and insurance information. The bidder shall provide to the Illinois Veterans’ Home Convenience Boxes that are approved by the Illinois Veterans’ Home at LaSalle Pharmacy Advisory Committee on a no charge basis until the specific content is used.

Yes No Status: under evaluation

8. What is the effect of a denial of this extension request?
The Illinois Veterans Home - LaSalle does not have an on-site pharmacy. There is neither space or staff available for a pharmacy. The only way to procure the necessary pharmaceuticals and support is through an outside vendor. Without these services we cannot provide vital Prescription medication for our veterans. This would be a threat to our veterans health and safety.
