Justification for Sole Source Award Summary

This is a Justification for a Sole Source Award document for certain commercial items issued by the Department of Veterans Affairs, Office of Procurement Operations, Technology Acquisition Center.

The proposed action is a Firm-Fixed Price (FFP) Delivery Order issued under the General Services Administration Federal Supply Schedule Multiple Award Contract (47QSM25D0017) with Siemens Healthcare Diagnostics, Inc., located at 511 Benedict Ave., Tarrytown, NY 10591. The delivery order will provide Brand Name Siemens UniPOC Point of Care (POC) Testing Data Management System software licenses and annual support services to VA's Office of Information and Technology, Mid Atlantic Health Care Network (VISN 6). The requirement includes UniPOC and Web Results Xpress (WRX) software licenses, annual maintenance and support, middleware interfaces for covered POC instruments, software upgrades and patches, telephone and remote technical support, and standard training and consultation services. The solution supports the North Carolina UniPOC server farm (Asheville, Durham, Fayetteville, and Salisbury VAMCs) and associated Community Based Outpatient Clinics/Health Care Centers, as well as the Virginia UniPOC server farm (Richmond, Salem, and Hampton VAMCs) and associated facilities. The contract period includes a 12-month base period with four 12-month option periods, not exceeding 60 months total. The total estimated value is redacted but stated to be inclusive of all option periods.

The justification cites 10 U.S.C. 3304(a)(1) as implemented by the Revolutionary Federal Acquisition Regulation (FAR) Overhaul, VA Deviation 6.103-1(d), which permits sole source awards when only one responsible source can satisfy agency requirements. Siemens is the exclusive developer, licensor, and support provider of the proprietary UniPOC Testing Data Management System and WRX modules. The rationale emphasizes that the existing UniPOC middleware environment is fully configured, validated, and embedded in daily VISN 6 POC testing operations. Changing to a non-Siemens solution would require replacement and reconfiguration of the existing UniPOC/WRX environment, revalidation of POC data flows, accreditation-related controls, staff retraining, and interface rebuilding—creating substantial cost duplication and unacceptable risk of interruption to POC testing operations and EMR result integration necessary to maintain accreditation and patient care continuity. Market research conducted in June 2026 confirmed that Siemens Healthineers (the legal continuation of Siemens healthcare entities) is the sole source for these licenses, upgrades, and support services, with no authorized resellers or service providers. The award notice will be synopsized on the Contracting Opportunities website (SAM.gov), and the government will continue to monitor the marketplace to determine whether future competitive actions may become feasible.
