This document is a transcript of the pre-proposal conference for Invitation for Bid (IFB) Solicitation No. SW-1-3-20-R issued by the Maryland Department of Transportation State Highway Administration (MDOT SHA). The solicitation is for the purpose of providing temporary lab and field technicians to the MDOT SHA Office of Materials Technology to perform materials, soil aggregates, asphalt, concrete, steel, pavement markings, and other materials testing and inspections in support of SHA construction projects. The contract will be for a three-year base period with two one-year option periods. Written questions are due by October 29, 2021, and proposals are due by November 9, 2021 at 2:00 PM local time. Multiple awards will be made to the most qualified and cost-effective firms.

The solicitation includes a 25% Minority Business Enterprise (MBE) participation goal. The incumbent contractors were V.E. Engineering ($6,534,529) and Apollo Professional Solutions ($8,169,175.42). Successful bidders must have a minimum of three years of comparable testing and inspection service experience. The state estimates needing approximately 15-20 technicians per year across various disciplines to support the contract. Bidders are encouraged to carefully complete all required forms, as mistakes on MBE and bid submission forms are considered non-curable.

All questions should be submitted via email. SHA will 1 respond to all written questions in the form of an addendum 2 which will be posted on eMaryland Marketplace Advantage for 3 all vendors who have received the IFB and or have requested an 4 additional correspondences. 5

Minority Business Enterprises and veteran-owned small 6 business enterprises are encouraged to respond to this IFB. 7

The MBE goal and form submission. An MBE 8 determination goal of 25 percent (25%) has been set for this 9 project. I would like now to ask our OEO MBE representative 10 to provide any details as it relates to the 25 percent (25%) 11 goal an MBE form submission after which we will answer any 12 questions vendors may have. 13

MR. EDWARDS: Okay, good morning. This is Carey 14

Edwards out of OEO. For the goal of 25 percent (25%), it is 15 definitely up to the participants to make sure that they are 16 on track to reach that goal. If there's any issues that will 17 hinder them from hitting that goal, they need to let folks 18 know ahead of time so that we can make adjustments. And 19 that's pretty much the basis of the goal for this contract. 20

Once the participants are established, you know, then we can 21

And Litigation Support

(301) 379-6607 be more specific in terms of the directives that are asked of 1 you on this particular contract. So, I'll open up the floor 2 for any questions that any vendor may have. 3

MR. OLANYA: Do you have any questions our vendors? 4

MS. BELL-SMITH: Hi, this is Michelle Bell-Smith with 5

First Choice and I do have a question. Will the MBE be 6 allowed to self-certify or are we required to bring in another 7

MBE to meet that goal? 8

MR. EDWARDS: I'm sorry, you got jumbled. Can 9 you repeat the question? 10

MS. BELL-SMITH: Will the MBE be allowed to self- 11 certify to meet the goal or will they need to bring in another 12

MBE or other MBE to satisfy it? 13

MR. EDWARDS: All right. They need to be certified 14 before they can even work on the project. 15

MS. BELL-SMITH: That is correct. So, if an MBE 16 submits a bid can they use themself as the MBE or do they need 17 to bring in an additional MBE? 18

MR. EDWARDS: Well, that would depend. I mean if they 19 need another MBE to help with it based off how you guys won 20 the bid then you can. But if based off of how you won the 21

And Litigation Support

(301) 379-6607 bid and you're supposed to complete the project then you're 1 supposed to complete the project. 2

MS. BELL-SMITH: Okay. So, an MBE can use themself as 3 the MBE? 4

MR. EDWARDS: Yes. 5

MS. BELL-SMITH: Thank you. 6

MR. JOHNSON: Hello, Carey, Mr. Edwards, this is Joe 7

Johnson, Division Chief. 8

MR. EDWARDS: Yes. 9

MR. JOHNSON: I have a question for you. 10

Are there any specific instructions on how a vendor should 11 request a wavier? 12

MR. EDWARDS: A waiver for what particular purposes? 13

MR. JOHNSON: For subcontracting? I see there was 14

Form E for requesting waivers. Are there any specifics for 15 that form just in case someone doesn't know how to fill it 16 out? 17

MR. EDWARDS: No, there's no specifics, but if 18 there's, you know, any questions that come up, then definitely 19 direct it to the project engineer or contact, you know, myself 20 or my office. 21

And Litigation Support

(301) 379-6607

MR. JOHNSON: Sounds good, sir thank you. We will 1 use you as the contact. Thank you. 2

MR. EDWARDS: Yep, not a problem. 3

MR. CHISHOLM: All right, Carey. This is Damien 4

Chisholm of OPCM. I just wanted to clarify based on the 5 vendors’ question. So, if a vendor bids and that vendor is 6 an MBE, they can perform 100 percent (100%) of that 20 percent 7

(20%) goal on the project? 8

MR. EDWARDS: Yes. The vendor can, yes. I think 9 what some folks are talking about is if they are the prime. 10

You know there's issues where the prime -- if the prime is 11 also an MBE, then the prime can do a percentage of the goal. 12

But if you're a straight vendor, you know, a subcontractor on 13 the project, you know, then you're responsible for your area 14 that you're going to utilize on the project. Does that make 15 sense? 16

MR. CHISHOLM: Yes, I think there was some confusion 17 when the vendor asked their question that the term “prime” 18 wasn't used. So, a prime can or cannot perform 100 percent of 19 that 20 percent (20%) goal? 20

MR. EDWARDS: As long as the prime is also an MBE. 21

And Litigation Support

(301) 379-6607

Okay, there are some cases where the prime, you know, is an 1

MBE. And so, when they're acting as the prime, you know, they 2 are acting as the prime, but if there are certain duties that 3 they can perform as an MBE they can perform a certain 4 percentage of that. Okay. And so, once a contract gets 5 solidified, then, you know, you can determine the certain 6 percentage that they could possibly do by being an MBE as 7 well. Now does that make sense or you need further 8 clarification? 9

MR. CHISHOLM: That does. If the vendor who asked the 10 question needed any further clarification, I would recommend 11 following up to Mr. Edwards’ response. But I do understand. 12

Do you know what that percentage is that the prime can perform 13 of the goal? 14

MR. EDWARDS: No, not -- no. It would definitely 15 depend on that contract at that time once everything is set to 16 paper. But it's definitely not a -- they can’t perform 100 17 percent of the goal. They cannot perform 100 percent of the 18 goal. 19

MR. KORPE: Excuse me. I have a question -- comment. 20

Can I interject? 21

And Litigation Support

(301) 379-6607

MR. EDWARDS: Yes. 1

MR. KORPE: Okay this is Satish Korpe, Potowmac 2

Engineers. I think to go further clarification on what you're 3 saying is they may perform more work than the goal. But that 4 will not be counted. Only up to 50 percent of the sub-goal 5 will be counted. There are sub-goals in this contract also. 6

And that's what I think we're talking about unless there are 7 no sub-goals. Are there are sub-goals? 8

MR. EDWARDS: Right now, I don't see it. All I see is 9 a 25 percent (25%) total goal. I don’t see -- 10

MR. KORPE: Sure. 11

MR. EDWARDS: -- the sub-goals here. 12

MR. KORPE: Right. The certified MBE may perform 13 more than 12 percent (12%), which is half of 25 so then half, 14 they may perform 15. So, they'll be only counted as an MBE up 15 to 12.5. So, they will have to get other firms, small firms 16 to participate for the remaining goal. That's my 17 understanding. Is that correct? 18

MR. EDWARDS: Once again, I would need to see the 19 actual participants and then that percentage of the goal as 20 divided up amongst that goal because right now, I don't see -- 21

And Litigation Support

(301) 379-6607 all I see is 25 percent (25%). I don't even see, you 1 know, the subcontractors and the percentage goal or the make-2 up of what they're going to be doing on this project. 3

MR. KORPE: Yeah. (Indiscernible) for clarification. 4

MR. EDWARDS: Right. So, this is -- right now, the 5 vendors are looking to put in their bid. Let's just say the 6 primes are looking to put in their bid for this particular 7 project and then they're going to be talking to subs to 8 actually do some of the work on the project. Is that where we 9 are at this point? 10

MR. KORPE: Yes, but will you advertise the names of 11 the primes like planholders what you call them and the primes 12 who are interested to submit and primes who are small business 13 who are interested. Okay. All right. Thank you. 14

MR. JOHNSON: Hi, Mr. Edwards, Joe Johnson again. I 15 don't believe there’s a sub-goal. I believe there's a 25 16 percent (25%) MBE goal. 17

Patrick, as we move through the meeting and when we're 18 discussing topics see if you can display the IFB and probably 19 the MBE forms as we discuss these items. Thank you. 20

MR. KORPE: Remember we are only on phone call we 21

And Litigation Support

(301) 379-6607 cannot see the display. So, I'm not sure how we can see your 1 display. 2

MR. JOHNSON: Thank you, sir. But for those of us 3 that are in the office they can see these documents, it 4 probably would be best to display these as well. Thank you. 5

MR. AKISETTY: I see that it is in the attachment 6 that is on the screen. Mr. Korpe, I think actually report to 7 the RFP. It is in the Attachment E. 8

(Pause). 9

MR. JOHNSON: Patrick, please continue if there’s no 10 more questions for Mr. Edwards. 11

MR. CHISHOLM: Hi, Patrick. If you’re talking 12 you’re on mute. 13

MS. KOOPMAN: Hi, Patrick. This is Kerrie. I think 14 you’re on mute still. 15

(Pause). 16

MR. JOHNSON: Okay, everyone. It seems like we’ve 17 lost Patrick for a moment, so I'm going to pick up where he 18 left off at. Patrick left off with the MBE goals and form 19 submission. Mr. Edwards was polite enough to answer those 20 questions. 21

And Litigation Support

(301) 379-6607

Moving on to Invitation for Bid IFB submission 1 process. The bids will only be submitted electronically via 2 eMaryland Marketplace. You must submit to eMaryland 3

Basis of Award. Multiple awards will be made to the 21

And Litigation Support

(301) 379-6607 firm whose qualifications and bid price is to be the most 1 advantageous to the state. 2

Contract duration. This is a three-year contract 3 period with two one-year option periods. In 2017, two 4 contracts were awarded to the incumbents V.E. Engineering in 5 the amount of $6,534,529.00. The second contract was awarded 6 to Apollo Professional Solutions in the amount of 7

$8,169,175.42. 8

Bidder’s Qualifications. The successful bidder must 9 have a minimum of three (3) complete and consecutive years of 10 successful testing and inspection service performance 11 comparable in the scope, type, size, magnitude and complexity 12 for reference as required in the IFB. 13

Scope of work. The Maryland Department of 14

Transportation State Highway Administration is issuing this 15 solicitation for the purposes of providing temporary lab and 16 field technicians to the Maryland Department of Transportation 17

SHA, Office of Materials and Technology to perform materials, 18 soil aggregates, asphalt, concrete, steel, pavement markings, 19 and other materials, testing and inspections in support of SHA 20 construction projects in the field or laboratory settings. 21

And Litigation Support

(301) 379-6607

At this point before I open the floor up for comments 1 and questions, I would like to offer the Office of Material 2 and Technology to give an overview of the scope of work, 3 specifications (indiscernible). 4

MS. KOOPMAN: Good morning. This is Kerrie Koopman 5 from the Office of Procurement and Contract Management. I 6 believe Joe was allowing the Office of Material and 7

Technologies the floor to discuss any qualifications at this 8 time. 9

MR. FREMPONG: Thank you. This is Eric Frempong from 10 the Office of Materials Technology, the Director for Material 11

Quality. I will invite Chandra Akisetty to proceed with an 12 overview of the scope of works. 13

MR. AKISETTY: Good morning, everyone. 14

The contract scope was listed in Section 2 of the 15 contract. Many of you are on the phones, so you can't see I 16 shared my screen. Probably you can see it in the RFP too. 17

This purpose of this contract is to provide the 18 temporary lab and field technicians who work at the OMT to 19 work for OMT. And this is primarily to work in the soils and 20 aggregate concrete, asphalt, and structural materials areas. 21

And Litigation Support

(301) 379-6607

And we have a requirement for laboratory technicians who work 1 in the lab here for us and we have a requirement for the field 2 technicians who goes to the field and do the inspections and 3 bring the material collections and do the material collections 4 and all that stuff through this contract. That is the primary 5 purpose of it, but exactly all the requirements are listed in 6 the RFP. We know previous levels of technicians in the scope 7 from level one to level four. And based on the experience of 8 the technician and qualifications of them, we will request 9 usually what kind of technician we need to work for us. And 10 we want the contractors to provide the resumes within a week 11 and then we will do the interviews and select the candidates 12 for it. So, that is it basically for the scope. 13

And those who commute, who goes to the job sites, they 14 have to use their own vehicle and their own cell phone and 15 their own computer devices. We don't state one provide 16 anything to them. And it's the responsibility of the 17 contractor to provide all these safety devices and those 18 things you need to work. And if they have to take any 19 trainings, it is also contractors’ responsibility to provide 20 training for them -- training required, and state will not do 21

And Litigation Support

(301) 379-6607 any of those things. But, for the travel and all that stuff 1 state will reimburse for the mileage. They do for the work 2 but not for the commute. So, that is the basically scope of 3 the -- primarily that is the basic scope and now Sejal wanted 4 to say something. Sejal. 5

MS. BAROT: Yes, yes. Give me one second. So, if 6 you, yes, if you can, can you Chandra -- thank you for 7 responding to that. I think you pretty much covered and I 8 don't think so there are any major changes to what was in the 9 previous contract. But, just can you bring that screen and 10 give them the exact reference so they know just in case? That 11 would be great. I know that so if you can give them the exact 12 reference and share that page that would be great. 13

(Pause). 14

So, everybody while Chandra is looking for that 15 information, I think we can continue and once he has it ready 16

-- Chandra, you can take your time -- I think we can continue 17 with that, and Chandra will share. Okay. 18

MR. OLANYA: Yeah vendors, this is a time you can 19 ask as many questions as possible. So please feel free to 20 utilize this opportunity. 21

And Litigation Support

(301) 379-6607

MR. BEAVER: This is David Beaver on the call from 1

Apollo. I did have a question with regard to bid bonds. Is 2 that going to be a requirement for this re-bid? I’m finished 3 speaking. 4

MR. OLANYA: David, may you please repeat that 5 question again? 6

MR. BEAVER: Sure. Again, David Beaver with Apollo. 7

Is there going to be a bid bond required for this re-bid? I'm 8 finished speaking. 9

MR. OLANYA: Chandra, do you mind responding to this? 10

MS. KOOPMAN: This is Kerrie from MDOT SHA. I don't 11 believe there are any bond requirements however we can clarify 12 that in the addendum. 13

MR. BEAVER: Thank you. I saw that it was removed or 14 not present in the Table of Contents. So, I just didn't know 15 if that was maybe an oversight or something. 16

MS. KOOPMAN: Understood. We will confirm. Thank 17 you. 18

MR. KORPE: I have a question. This is Satish 19

Korpe. Can I -- hello? 20

MR. OLANYA: Yes. 21

And Litigation Support

(301) 379-6607

MR. KORPE: Can I ask a question, okay? 1

MR. OLANYA: Yes, go ahead. 2

MR. KORPE: My question is in the final analysis, how 3 many firms will be selected? Multiple firms contract as I 4 heard. How many there will be? 5

MR. OLANYA: I believe it is two, but Chandra can 6 clarify on that too. 7

MR. AKISETTY: Yeah, it is two, two contractors. 8

MR. KORPE: Okay, thank you. 9

MR. AKISETTY: And to answer the previous question 10 that’s on the screen, this project does not involve bonding 11 requirements. Yeah, and referring back to the scope, it's in 12 the Section 2. 13

MR. BEAVER: I was referring to a bid bond not bonding 14 requirement. 15

MR. FREMPONG: So, this is Eric Frempong, OMT. 16

With regards to Mr. Korpe’s question, a response in Section 17

2.1.3. about the number of awards that will be made by the end 18 of the contract. I am done speaking. Section 2.1.3. 19

MR. JOHNSON: Good morning, Patrick. This is Joseph 20

Johnson, Division Chief. I will answer the question about 21

And Litigation Support

(301) 379-6607 bonding. A bid bond is not required for this project. Thank 1 you. I'm done speaking. 2

MR. OLANYA: Thanks Joe for clarifying. 3

MS. BAROT: Yeah, thanks for clarifying because I 4 thought that the (indiscernible) from previous contracts I was 5 surprised but thank you. 6

MR. OLANYA: You have any more questions? 7

MS. WALTERS: Hi, this is Abby Walters from V.E. 8

Engineering. Can you tell us why this was put out for re-bid? 9

MR. OLANYA: Joe Johnson, you -- 10

MR. JOHNSON: -- Good morning. No, we can't answer 11 that question. It was in the best interest of the state to 12 cancel the -- reject all bids. Thank you. I’m done speaking. 13

MR. KORPE: Question. Do you have any estimated 14 number of technicians in each area that you may be needing, 15 any predictions for coming years? 16

This is Satish Korpe, Potowmac Engineers. My 17 question is do you have any predictions or estimates of number 18 of technicians needed each year for the next three years in 19 each area of the project as far as field and so forth? 20

MR. AKISETTY: Yeah, this is Chandra from OMT. To 21

And Litigation Support

(301) 379-6607 answer your question, we need roughly around, you know, 15 to 1

20 technicians altogether each year to work in all the 2 disciplines, all material quality side either field or in the 3 lab. And the number could vary depending on our requirements. 4

MR. KORPE: Thank you. 5

MR. OLANYA: At this point, if there is no other 6 questions, I encourage you vendors to reach out in case of any 7 questions that may arise during the course between now and the 8 time you submit. We submit all the questions via email. 9

Again, my email address is Polanya@mdot.maryland.gov where 10 we'll try to address them with an addendum. 11

MR. JOHNSON: Hi, Patrick, Joe Johnson, Division 12

Chief. I just want to express the importance to the vendor 13 community of properly completing the MBE forms and the bid 14 submission forms, those two type of documents. Mistakes on 15 those documents are deemed not curable. So please, if you 16 have questions about how to complete either form, please 17 contact your procurement officer and good luck to you. Thank 18 you. 19

MR. OLANYA: Thank you, Joe. And there are detailed 20 instructions, you know, before each form. There are detailed 21 mailto:Polanya@mdot.maryland.gov
