Question Response

We understand that the customs clearance will be the responsibility of the Internal Security Forces of Lebanon

(stipulated on page 10 of 40), it is not feasible as indicated in CLIN 005 that Delivery shall be made on Delivery Duty

Paid (DDP) basis. Based on the SOW the order shall carry

INCOTERMS of either carry CIF Destination Seaport or

Airport Beirut, Lebanon or DDU Destination Seaport or

Airport Beirut, Lebanon. Could you, please clarify and alter

CLIN 005 or SOW?

CLIN 005 is hereby revised to require delivery to be made on FOB Destination basis to the Rafiq Hariri International

Airport in Beirut, Lebanon.

The specified delivery schedule is on or prior to February 28, 2017. XXXX request an alternative delivery schedule in order to ensure that all Export and Import Requirements and

Documentation are in place, as those would not under

XXXX’s control. XXXX respectfully request that delivery shall be no later than three (3) months after confirmation that

Import permit(s) are either in place or have been waived.

XXXX is not permitted to ship deliverables until required

Import licenses are in place, and the maritime shipping time

(at sea) to the Beirut sea port terminal is approximately 45 days.

The specified delivery schedule has been changed from February 28, 2017 to March

15, 2017.

Per the FAR clause 52.204-14, Service Contract Reporting

Requirements (Jan 2014) requirements, that is marked applicable to the subject RFQ, XXXX requires clarification as we interpret this requirement as not applicable due to the fact the subject RFQ is for supplies and the services CLIN for firm fixed services would not fall within the required threshold as the quantity is defined for supplies that require services or services are being procured in support of those supplies.

The combined synopsis/solicitation has been revised as to ensure FAR 52.204-14 is unmarked (as in being not applicable).

FAR clause 52.225-5, Trade Agreements (Feb 2016) is marked as applicable. Could you please clarify as the solicitation does not identify which CLIN Items are subject to this clause?

Per FAR 52.225-5 (b): "Unless otherwise specified, these trade agreements apply to all items in the Schedule."

On page 31 under Evaluation – Commercial Items it states that the “following factors shall be used to evaluate offers:

Technical Capability, Past Performance, and Price. It goes on to state that "Technical and Past Performance, when combined, are equal to price." Other than these references above, there appear to be no past performance references in this solicitation. Please confirm that past performance is not required. If past performance is required, please let me know what is needed.

On page 28 of the combined synposis/solicitation, FAR 52.212-1 is included by reference. Per FAR 52.212-1

(b) (10): "Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information)."

The hand held explosive detection system comes with basic accessories, such as detector cartridge with a lifetime of 3-4 months depending on frequency of usages and sampling strips that come is packs of 250, lasting depends on the number of scans. Should we include our recommendations for accessories needed for one year in the price or should we price them separately?

Any recommendations shall not be included in the price and will not be evaluated.

Since the customs clearance is handled by the Internal security Forces of Lebanon, Should we include the transportation from the airport to the US Embassy?

The vendor will be responsible for delivering all equipment to the Rafiq Hariri

International Airport, NOT the U.S.

Embassy in Beirut, Lebanon.

All equipments come with one year warranty, including site visits. Should we price maintenance for the second year, for remote support and/or full maintenance separately?

If one or more equipment already includes one (1) year warranty that is valid for

Lebanon and meets all stated requirements, please indicate that it is included in the price and for which equipment.

XXXX would like to request an extension to the subject RFQ through 11 January 2017.

The RFQ has been extended through 11

January 2017.

Would like to receive further clarifications in regards to the origin of the funds related to the above mentioned solicitation. Are the funds allocated to this project related to the US department of state funds? Would the purchase take place in the USA or through the US embassy in Beirut Lebanon?

This procurement is on behalf of U.S.

Department of State's Bureau of

International Narcotics and Law

Enforcement Affairs (INL) for use exclusively outside of the United States.

We reviewed the subject RFQ and would like to clarify if partial quotes will be accepted.

Partial quotes will be considered nonresponsive.
