PROSPECTIVE OFFEROR’S CERTIFICATION:

By expressing interest in this project, you are acknowledging that your company is able to reach compliance with the following highlighted requirements included in the solicitation document:

Business Licenses to Work in Australia: In accordance with DOSAR 652.242-73 AUTHORIZATION AND PERFORMANCE (AUG 1999), offeror certifies that it will provide, with its proposal, written certification of authorization to operate and do business in Australia.

Offeror certifies that it will provide information that clearly shows that it is able to work in Australia. If applicable, offeror further certifies that it will be responsible for any entry or work visa issues and requirements and will provide a clear discussion in which a risk mitigation plan is clearly identified.

Irrevocable Letters of Credit (ILCs): Offeror agrees that it will submit with its proposal a letter from the financial institution confirming its ability to obtain the ILCs. The requirement at proposal submission stage is an assurance letter regarding offeror’s ability to obtain ILCs and not the ILCs themselves. Offeror certifies that, upon contract award, it will present to the Contracting Officer acceptable ILCs from a financial institution providing a total of 40% of the contract value.

When submitting a proposal, the failure to provide 1) evidence of authorization to operate and do business in Australia and 2) acceptable assurance on offeror’s ability to obtain ILCs may result in the proposal being found technically unacceptable and removed from the competition without further discussions.

Solicitation and award will be subject to the laws and regulations of the United States of America.

This requirement is being competed utilizing full and open competition procedures.

The Contract Specialist for the administration of this contract is Hartmut Christe, tel. +49 69 7535 3343, email Christeh@state.gov.
