About this file

This is a sole-source justification letter from the Missouri Department of Transportation regarding a sound system upgrade project. The department has determined that Mod Comm LLC is the only source capable of providing a replacement for the existing system due to proprietary supply constraints and an expedited implementation timeline. The installation and upgrade work must be completed between December 7th and December 18th. The contract period commences upon Notice of Award and extends through June 30, 2026, with provisions for two optional one-year renewal periods. Interested parties or those with questions regarding this procurement should contact Logan Wilbers at logan.wilbers@modot.mo.gov.

No additional pricing, funding source, or set-aside information is provided in the available documentation. The justification for sole-source procurement is based exclusively on the proprietary nature of the supplies and the compressed delivery schedule required to meet the department's operational needs.

From: Logan M. Wilbers To: Logan M. Wilbers Subject: FW: Single Feasible Source Confirmation Date: Monday, October 5, 2026 10:51:00 AM

From: Tom Johnson <tjohnson@modcomm.com> Sent: Friday, October 2, 2026 11:14 AM To: Jennifer L. Jorgensen <Jennifer.Jorgensen@modot.mo.gov> Cc: Olmedo Herrera <Olmedo.Herrera@modot.mo.gov>; Cheryl Vautrain <cvautrain@modcomm.com> Subject: Single Feasible Source Confirmation

Hi Jennifer, I’m sending this note to formally confirm ModComm’s role as a Single Feasible Source (SFS) for your streaming systems associated with Council Room 100, the Open Meeting system, and Committee System portable packs.

ModComm designed, fabricated, and performed the original build‑out of these systems beginning in 2012 with the first iteration of Council Room 100. We subsequently provided major updates and upgrades in 2019 and 2021, and completed ADA‑compliant enhancements in 2025. Our scope has included all programming, network integration, device provisioning, and custom signal‑flow architecture. Since installation, ModComm has provided all service, updates, firmware changes, and hardware upgrades.

The system’s logic, routing, automation layers, and operational workflows were engineered specifically for your environment. All documentation, schematics, programming structures, and configuration standards used throughout the facility are proprietary to ModComm.

These systems were also purpose‑built to integrate seamlessly with Buscomm Liberty’s Meeting Recorder (LMR), requiring specialized knowledge of both platforms and their interdependencies.

Because of this history and the depth of custom engineering involved, no outside vendor would possess the required understanding of the underlying design, programming framework, or operational dependencies to safely modify, expand, or support the system.

Attempting to do so without our involvement would introduce significant risks, including system instability, compatibility issues, and loss of critical functionality.

For these reasons, ModComm is the only feasible source for continued support, upgrades, and expansion of the existing system architecture.

If you need additional detail for procurement or internal documentation, I’m happy to provide it.
