2. If amendments are issued, acknowledgment of all amendments by completing blocks 15a, b, and c of the Amendment SF30.

FAR 52.212-2 -- Evaluation -- Commercial Items (Addendum).

(a) The Government anticipates award of a contract resulting from this solicitation to the responsible offeror whose quote conforms to the specifications that will be the most advantageous to the Government in accordance with FAR 13.106-2 considering three major areas: technical acceptance, past performance and price. Quotes will be evaluated by performing a comparative evaluation in accordance with FAR 13.106-2(b)(3) to determine which quote meets the lowest price technically acceptable evaluation methodology.

Lowest Price Technically Acceptable Evaluation Methodology:

Technically Acceptable is defined as: the documented capability to meet the minimum requirements of the project as specified in this solicitation and the attached specifications, including evidence of the offeror's capability to provide the items specified and the ability to meet or exceed the specified delivery schedule.

It is imperative that the offeror submit sufficient documentation and information for the Government to determine technical capability and quoted price. Failure to submit sufficient information for the Government to determine technical capability and quoted price may be cause for rejection of your quotation.

Price and Past performance will be evaluated. Offers that fail to provide a realistic pricing approach for this effort will be found not acceptable. The Contractor must demonstrate the price proposed will not lead to reduced services, reduced quality, etc., because the proposed price resulted in a loss to perform the requirements in attached Statement of Work (SOW). A price evaluation will be performed to determine the reasonableness of the quoted price. Reasonableness will be determined considering other competitive prices received and comparison to the independent Government cost estimate (IGCE) or to any other information the Contracting Officer deems useful in their discretion. The Government will look at whether a quoted price is too high, possibly indicative of capabilities that exceed those needed for successful performance of the work; and may also consider whether a quoted price is too low, since this may indicate a lack of technical understanding on the quoter's part or a performance risk associated with the quote that the agency may not be willing to accept.

Past performance will be evaluated in accordance with FAR 13.106-2. Past Performance will be rated on an “acceptable” or “unacceptable” basis. The apparent successful, prospective contractor must have “acceptable” past performance. System for Award Management (SAM.gov) exclusions list, Federal Awardee Performance and Integrity Information System, and Contractor Performance Assessment Reporting System (CPARS) shall be considered as part of the past performance evaluation process. Any past performance that is found to be “Negative”, shall result in the entire Past Performance rating as “Unacceptable”. “Negative” is defined as any CPARS past performance evaluation rated less than “Satisfactory”, any Terminations for Default/Cause, or any negative performance references will be rated as ‘Unacceptable’. Any past performance that is found to be “negative”, shall result in the entire Past Performance rating as “Unacceptable” making the overall Technical Acceptability as Unacceptable”.

Solicitation 12405B22Q0046 - Trash & Recycle Services

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)

FAR 52.212-3 Offeror Representations and Certifications-Commercial Items (Jan 2021) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.
