The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision- Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

UTILIZING
FAR Part 13.5 – Simplified Acquisition Procedures
The services being sought under this requirement are for a qualified vendor to provide technical support for national educational technology leadership activities. These efforts aim to expand safe, innovative, and research-based approaches for using artificial intelligence and other rapidly advancing technologies to support teaching and learning in both K-12 and higher education.
The Government is seeking to build on the Office of Education Technology (OET) priorities which include but are not limited to the following: 1) Emerging Trends and Technology; 2)
Digital Inclusion; and 3) Ecosystems.
To provide the highest quality of services, this contract requires requisite knowledge, skills, and abilities in all of the following areas:
• Current educational technology policy, practice and research, including developing guidance and resources for the safe, effective, and equitable use of artificial intelligence and other emerging technologies by educators at both the K-12 and higher education level.
• Writing, editing, positioning and messaging high-level, complex and technical content in the field of educational technology, with a particular focus on educational technology policy.
• Research and evaluation methodologies, including secondary data analyses and systematic literature reviews, in the field of educational technology.
• Identifying, convening, gathering input from, and partnering to achieve mutual goals with policymakers, practitioners, and product and services providers on activities designed to leverage educational technology to transform and improve teaching and learning.
The contractor shall be responsible for carrying out all phases of work associated with the major activities under this firm-fixed price contract. The contractor is required to provide the services described in the performance work statement (PWS). This requirement will be solicited utilizing the procedures at FAR Part 13.5 on an unrestricted basis.
Period of Performance and Contract Type
The base period of performance is twelve-months. There are four option periods of twelve months each. It is anticipated that this Contract shall be awarded as a performance-based, firm-fixed-price.

The U.S. Department of Education (Department) is issuing this Request for Quote (RFQ) under Sam.Gov under FAR Part 13.5 Simplified Acquisition Procedures on an unrestricted basis. The North American
Industry Classification System (NAICS) code for this requirement is 611710, Educational Support
Services, the size standard is $24M. The Department intends to award a single fixed priced contract as a result of this RFQ. The period of performance will consist of one twelve-month base period and four twelve-month option periods.
Funds are not presently available for this Contract. The Department’s obligation under this Contract is contingent upon the availability of appropriated funds from which payment for Contract purposes can be made. No legal liability on the part of the Department for any payment may arise until funds are made available to the Contracting Officer (CO) for this Contract and until the Contractor receives notice of such availability, to be confirmed in writing by the CO.
This is a Simplified Acquisition Procedures (SAP) process under FAR Part 13.5. The procedures in FAR
Subpart 15.3 do not apply to this acquisition. The use of this SAP process does not obligate the Department to determine a competitive range, conduct discussions with any contractors, solicit proposals or revisions thereto, or use any other source selection techniques associated with subpart 15.3.
Quote Affordability: The Department seeks quotes with a total evaluated price of less than
$3,300,000.00, this amount is inclusive the 52.217-8 Option Period. Offerors should not interpret this figure as a ceiling (or as a floor) on quotes; rather, this information is provided as a courtesy to prospective offerors. The Department may select a quote for award with a price below, at, or exceeding this figure if it finds that quote provides the best value and funds are available.
The offeror’s quote must be submitted electronically. The quote must be received by the Department before the quote submission deadline. Quotes must remain valid for a period of 60 days after quote submission. It is the responsibility of the offeror to allow adequate time to submit the quote’s files before the quote submission deadline. Offeror must have an active registration with the Department’s System for
Award Management, SAM.gov, at time of quote submission.
The Department's preference is to evaluate quotes and award a Contract without exchanges with the offerors. However, the Department reserves the right to engage in exchanges with all offerors. The
Department may reject any or all quotes if such action is in the public interest and waive informalities and minor irregularities in quotes received.
The quote must be received at or before September 3, 2024, by 10:00 AM EDT. Quotes must be submitted electronically to the Points of Contact listed below:

The quotes shall consist of four (4) Volumes. The volumes are: (1) Executive Summary, (2) Technical
Quote, (3) Past Performance, and (4) Price/Business Quote.
Offerors shall submit all information that the offeror wishes to have considered with the initial quote. The quote shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiation of the validity of stated claims. The offeror shall present the information in sufficient detail for effective evaluation of the offeror’s quote against the evaluation criteria. The offeror shall not simply rephrase or restate the Government’s requirements. The offeror shall assume the Government has no prior knowledge of its capabilities and experience. Offeror’s quotes with vague statements such as “will comply,” “noted,” and “understood,” etc. represent weakness upon their use. The quotes shall address the requirements and not simply repeat the language of the PWS.
The offeror shall submit documentation demonstrating their approach for satisfying the requirements of this request for quote. The Government will base its evaluation on the information presented in the offeror’s quote unless stated otherwise. The offeror shall describe its quote, through the use of graphs, charts, diagrams and narrative, in sufficient detail for the Government to understand and evaluate the nature of the approach. The offeror is encouraged to exercise independent judgment with respect to the best methods of attaining the objectives of this contract.
It is understood that the quote will become part of the official contract file; therefore, it will not be returned.
The Government is not obligated to pay any cost for the preparation and submission of a quote. The
Contracting Officer is the only individual who can legally commit the Government to the expenditure of

public funds in connection with this acquisition. The Government is not obligated to pay any cost for the preparation and submission of the quote.
QUOTE SUBMISSION REQUIREMENTS
1. The offeror’s quote must include all information requested and must be submitted in accordance with these instructions. The quote must be compliant with the requirements as stated in the
Performance Work Statement (PWS). Quotes found to be deficient will not be evaluated any further and removed from consideration as they meet the definition of Unsatisfactory. Each offeror’s quote will be evaluated to determine compliance with the RFQ requirements, including terms and conditions, representations and certifications, and technical requirements (quote instructions, quote submission requirements, quote content requirements). Unsatisfactory quotes will be ineligible for award and may not have their business volume evaluated.
2. The offeror’s quote is presumed to represent its best efforts to respond to the RFQ. All inconsistencies, whether real or apparent, between the conveyed performance and price must be explained in the quote. The evaluation will be based on an assessment of the information submitted in the Offeror’s quote and other evaluation information available to the Department. It is imperative that the quote innovatively addresses the requirements in the PWS and does not simply repeat the language of the PWS. All assumptions will be evaluated as part of the individual factor to which they apply. The Department reserves the right to reject any quote that includes any assumption(s) or conditions that impact or affect satisfying the Department’s requirements.
3. Award on Initial Responses: The Department anticipates selecting the best-suited contractor from initial responses, without engaging in exchanges with contractors. Contractors are strongly encouraged to submit their best technical solutions and price in response to this RFQ.
4. Comparative Analysis: Following receipt of responses, the government may perform a comparative analysis (comparing contractor responses to one another) to select the contractor that is best suited to fulfill the requirements, based on the contractors’ responses to the factors outlined in this RFQ and their relative importance.
5. Exchanges with Best-Suited Contractor: Once the Department determines the contractor that is the best-suited (i.e., the apparent successful contractor), the Department reserves the right to communicate with only that contractor to address any remaining issues, if necessary, and finalize a contract with that contractor. These issues may include technical, past performance and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Department, the Department reserves the right to communicate with the next best-suited contractor based on the original analysis and address any remaining issues. Once the
Department has begun communications with the next best-suited contractor, no further communications with the previous contractor will be entertained until after the contract has been awarded. This process will continue until an agreement is successfully reached and a contract is awarded, or the solicitation is cancelled if no satisfactory quote is found.
6. Content Requirements. All information must be confined to the appropriate Volume. Proprietary information must be clearly marked as such. Each Volume of the quote must consist of a Title Page
(Title of the Volume), Table of Contents, and the narrative or information being requested within the instructions to offerors. Appendices must have a Title Page (Name of Appendix, i.e., Appendix 1, Appendix 2). The cover of the quote and the header of each volume page should contain the title

“National Educational Technology Leadership Activities”.
7. No pricing information shall be in any volumes other than, Volume 4, Price/Business Quote. The technical quote will NOT contain any reference to specific prices, but resource information (e.g., staff hours) shall be included so that the offeror’s understanding of the scope of the work may be evaluated by the Technical Evaluation Panel (TEP).
8. Each volume shall be submitted separately in accordance with the table below. Each volume shall be written on a stand-alone basis so that its contents may be evaluated with no cross-referencing to other factors or volumes of the quote. The use of hyperlinks in the quote is prohibited except within the table of contents. Quotes must adhere to the page count limitations below.
9. Each file name submitted shall be with the Volume number first, then the Volume Title/Description, then NETLA, and lastly the company name which may be abbreviated. For example, “Vol 1
Technical NETLA Company Name”.
10. Contents of files must print on Letter 8 ½” by 11”. The technical quote shall be submitted searchable PDF format. The quote should be written no less than single spaced in no smaller than
12-point font for text, Times New Roman font, 10-point font or larger for tables, and 10-point font or larger for graphics. Margins should be no smaller than 1 inch on all sides.
11. The technical quote must be limited to a total of 30 double spaced pages. The page limit excludes only the cover page; the table of contents; resumes (Appendix 1); letters of commitment from consultants and key personnel (Appendix 2), Quality Control Plan (Appendix 3) and Staff Loading
Chart (Appendix 4).
Appendix 1:
In Appendix 1, the offeror shall include resumes for all except clerical staff. Each resume is limited to five (5) pages and shall share a common format an organization. Resumes will not count toward the overall technical quote page limit. Resumes shall follow the formatting restrictions described above.
Appendix 2:
In Appendix 2, the offeror shall include letters of commitment from all proposed consultants and key personnel not currently employed by the offeror shall be included, if applicable. Each letter shall be signed by the staff member and shall indicate that the staff member is committed to begin work should the offeror be awarded this order. The letter shall state that all negotiations regarding salary and benefits have been finalized and agreed upon. Letters of commitment shall not count toward the overall page limit of the technical quote.
Appendix 3:
In Appendix 3, the offeror shall include a chart identifying the name and the staff proposed to work on this contract and indicate for each person named: proposed task assignments, the relationship between past experience and proposed task assignments; and the percentage of time to be allocated to this contract and to other federal and non-federal contracts, including outside consulting assignments.
Appendix 4:
In Appendix 4, the offeror shall include the Management Plan. The plan should demonstrate how well the offeror will manage performance risks and ensure that all deliverables are timely, complete, and free of errors. The Management Plan shall include the roles and responsibilities, PAGE 21 OF 97 91990024Q0085 titles and names of the Offeror’s management team, including those subcontractors and consultants who will be members of the management team.
Appendix 5: The examples of previous work (as applicable) included in Appendix 5 demonstrate vendor’s ability to carry out the requirement successfully.

Volume 2 - FACTOR I – Technical Qualifications of Proposed Staff
In assessing the Technical Qualifications of Proposed Staff, the Department will evaluate the extent to which the proposed personnel have specialized subject matter knowledge and expertise in educational technology and demonstrated relationships with key constituents and organizations in the educational technology field. Potential offerors with proposed staff without the requisite knowledge and expertise will not be considered.
The Project Director must possess subject matter expertise and demonstrated work experience (high-level, minimum of 10 years) in all of the following functional areas, and senior researchers/technical staff must possess subject matter expertise and demonstrated work experience (high-level, minimum of
5 years each) in all of the following functional areas:
• Current educational technology policy, practice and research, including developing guidance and resources for the safe, effective, and equitable use of artificial intelligence and other emerging technologies by educators at both the K-12 and higher education level.
• Writing, editing, positioning and messaging high-level, complex and technical content in the field of educational technology, with a particular focus on educational technology policy.
• Research and evaluation methodologies, including secondary data analyses and systematic literature reviews, in the field of educational technology.
• Identifying, convening, gathering input from, and partnering to achieve mutual goals with policymakers, practitioners, and product and services providers on activities designed to leverage educational technology to transform and improve teaching and learning.
Evidence of a relationship between the background/experience of proposed staff to the specific tasks to be performed will be evaluated and must be described in detail in the quote. A list of possibly relevant items in the resumes of proposed staff will not be sufficient, as the U.S. Department of Education will make no assumptions if vague or incomplete information is provided. In addition, examples of corporate experience used to demonstrate the expertise and experience of proposed staff should identify proposed staff by name, including the nature and scope of their work responsibilities relative to the examples provided. Reasonable allocation of staff to tasks in keeping with their expertise will be evaluated, as well as, assurance of commitment and vitae for all staff, subcontractors and consultants.
The quote shall include a chart summarizing the expertise and experiences relevant to this contract for key personnel. The chart shall identify by name the staff proposed to work on this contract and indicate for each person named: proposed task assignments; the relationship between past experience and proposed task assignments; and the percentage of time to be allocated to this contract and to other federal and non-federal contracts, including outside consulting assignments. The Project Director will commit at least one third of his/her time to the project (unless a lesser amount of time is adequately justified).
For all except clerical staff, resumes shall be provided showing each person's educational background, including specifications and degrees held, and relevant professional experience. The resumes shall clearly show the relation between each person's relevant qualifications and the tasks to be performed.

Resumes shall also be provided for any proposed subcontractor or consultant personnel, as well as letters of agreement confirming the tasks on which they will work. ED may request to review relevant publications of key staff at any time during the negotiations.
The availability and commitment of proposed staff will be evaluated on the extent to which the:
● Proposed allocation of personnel resources and personnel time in relation to the work to be accomplished is reasonable; and
● Assurances of commitment provided for the proposed staff, including consultants and subcontractors are reasonable.
Factor II – Soundness of Technical Approach
The Technical Approach section shall present the vendor's plan for implementing the requirements of the PWS, organized by task and sub-task, describing in detail, the work to be performed and the methods to be used. Each task shall be presented under its separate heading, with exactly the same numerical designations and in the same order as used in the scope of work. In addition to describing the procedures that will be used to complete each task, the vendor shall indicate any anticipated issues and problems and how each will be addressed and resolved. Vendor shall include a detailed work plan. If applicable, the vendor should include examples of previous work that demonstrate their ability to carry out the requirements of the PWS. In assessing the Technical Approach, the Department will evaluate the extent to which:
● The proposed technical approach provides a comprehensive and quality solution to achieving the
Department’s goals/objectives, as outlined in PWS, in a timely manner.
● The proposed detailed work plan clearly describes how each task element of the PWS will be accomplished and how the stated results will be achieved.
● The Offeror has identified performance risks and anticipated barriers to accomplishing the PWS task elements and has proposed viable approaches to mitigate any such performance risks and/or barriers.
● The examples of previous work (as applicable) included in Appendix X demonstrate vendor’s ability to carry out the requirement successfully.
Factor III - Management Plan
The Offeror shall describe procedures for managing work under this contract to ensure its successful completion on schedule and within budget. The management plan shall include procedures for controlling expenditures and producing reports of expenditures by staff and tasks; procedures for controlling the quality of the work and the deliverables produced; and procedures for early identification and resolution of potential problems.
In addition, the Management Plan shall include the roles and responsibilities, titles and names of the
Offeror’s management team, including those subcontractors and consultants who will be members of the management team.
The Department will evaluate the extent to which the proposed Management Plan:
