(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

452.204-70 Modification for Contract Closeout (DEVIATION JUL 2022)
Upon contract closeout for contracts utilizing Simplified Acquisition Procedures (SAP) according to FAR 13:
(a) If unobligated funds in the amount of $1,000 or less remain on the contract, the Contracting Officer (CO) shall issue a unilateral modification for deobligation. The contractor will receive a copy of the modification but will not be required to provide a signature. The CO shall immediately proceed with contract closeout upon completion of the period of performance, receipt and acceptance of supplies or services, and final payment.
(b) If unobligated funds of more than $1000 remain on the contract, the CO shall issue a bilateral modification for deobligation. The contractor will receive a copy of the modification and will be required to provide a signature. General Information
Project Scope:
Modoc National Forest is purchasing 375 Ton (750,000 lbs.) of 6 string rectangle bales of grass hay AND 375 Ton (750,000 lbs.) of 6 string rectangle bales of Alfalfa. Totaling 750 TON (1,500,000 lbs.)
Bale size should not exceed 6 string bale rectangle bales.
Product Description:
Acceptable varieties of Grass Hay include, Meadow, Blue, Timothy, Orchard, Brome, and alfalfa.
Triticale or wheat hay is NOT acceptable. Hay shall be suitable for feeding to wild horses. Hay shall be well cured. Hay shall be free of dust, mold, foreign material, thistle or Prickly herb, "cheat" grass, foxtails, corn stalk, bearded grain, and other awns (spikelet's) or any other weed or grass not considered healthy forage for horses. Hay less than 6-inches in length and re-baled hay is not acceptable. Product does not need to be certified.
Approximate size of 6 string bale shall be 4 ft. W x 4 ft. H x 8 ft. L and approximate size of 3 string shall be 18 in. W x 18 in. H x 36 in. L.
Round bales are not permissible. Bales shall be uniform lengths; ragged bales shall not be accepted. Bales with loose twine or broken bales shall not be accepted.
Animals being Fed: The hay will be fed to Wild Horses at Double Devil Wild Horse Facility.

Double Devil Wild Horse Corrals 1430 County Road 74 Alturas, CA 96101.
All deliveries shall be coordinated with the Contracting Officer Representative (COR), Charlene Johnston. The COR is responsible with coordinating with the contractor on a monthly basis the specified needs of each delivery.
Deliveries shall be monthly and incremental unless specified differently by the Contracting Officer Representative (COR).
Vendor is responsible for delivering, unloading, and stacking the hay. The hay will be unloaded and stacked on a solid surface within the Double Devil Wild Horse Corrals or in the hay barn.
The vendor is expected to bring adequate equipment to complete the unloading and stacking of the hay in a safe and organized manner. Stacks that are uneven and/or leaning will be re-stacked by the vendor at no additional charge.
To determine quantity; each load shall be accompanied by certified weight slip, empty and loaded.
Delivery Date:
Initial delivery shall begin later than June 1st, 2024 (06/01/2024) and continue at least monthly until the total tonnage has been delivered.
Deliveries can be made 7 days a week, between the hours of 8:00 a.m. to 4:30 p.m.
The government reserves the right to change Delivery schedule depending on the number of horses and storage capacity at the corrals and/or if agreed to by all parties.
Directions: From Alturas, CA; travel West on Highway 299 approximately 3 miles, turn left onto County Road 73 (AKA Barnes Grade/Crowder Flat Road), Continue on County Road 73 for 2.5 miles, just before the pavement ends, turn left onto County Road 74, towards Devils Garden Conservation Camp (Signs for both the Corrals and Camp present near the roadway), Continue approximately 2 miles down County Road 74, and turn right at the Double Devil Wild Horse Corrals Sign.

52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(1) The Government will determine responsibility by analyzing whether the apparent successful Quoter complies with the requirements of FAR 9.1 including:
(i) Have adequate financial resources to perform the contract, or the ability to obtain them;
(ii) Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments.
(iii) Have a satisfactory performance record. A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history;
(iv) Have a satisfactory record of integrity and business ethics;
(v) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and mailto:Joshua.Williams2@usda.gov safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors.
(vi) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them; and
(vii) Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
(2) To be determined responsive, a responsive quote must comply in all material respects with the solicitation. Examples of solicitation requirements that could determine responsiveness include:
(i) acknowledgement of amendments (if any);
(ii) completed representations and certifications; and
(iii) Quoters not furnishing prices for each item listed in the Schedule requiring a unit price. If the quoter fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. Should any mathematical check made by the Government show a mistake in the extended amount quoted the corrected unit price extension shall govern. If a quoter omits both the unit price and the extended amount or estimated amount for any item, its quote shall be declared nonresponsive and therefore ineligible for award. Pricing must be submitted for all items.
(3) The following factors shall be used to evaluate quotes:
(i) Price Factor: Quoters shall provide pricing on Schedule of Items. The Government intends to assess price to determine realism and reasonableness (reflective of the Quoters understanding of the work and ability to perform the work).
(ii) Technical Capability/Past Performance: Quoters shall respond to this factor in a format of the offerors choosing.
Technical Capability: Technical capability is a measure of the degree to which the vendor presents their understanding of the requirements and the challenges of this project as well as their ability to mitigate those challenges and complete the project as specified.
The narrative response to the technical approach should be in as much detail as the quoter considers necessary to fully explain their proposed technical approach or method. The technical approach should reflect a clear understanding of the nature of the work being undertaken and an understanding of the acceptable quality level. The narrative need not be lengthy but shall at a minimum address the following information:
Quoters shall provide as part of their quote, the specifications of the Grass Hay and Alfalfa being offered along with the delivery readiness time frame.
The Government will determine the acceptability of each quote on a pass or fail basis considering the following factors:
1) A quoter takes exception to the any of the terms and conditions of the RFQ, including attachments;
2) A quoter is not currently registered in the System for Award Management (SAM) by the closing date of the solicitation;
3) A quoter cannot be verified as a Small Business as shown in SAM or other proof as submitted by the quoter; and
4) An incomplete quote that lacks sufficient information for the government to perform a technical evaluation to determine acceptability.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products or Commercial Services. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
Nothing in the prohibition shall be construed to—
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services".
(d) Representation. The Offeror represents that—
(1) It ☐ will, ☐ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that—
It ☐ does, ☐ does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services.
The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures. (1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment—
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
(ii) For covered services—
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.
