About this file

This document is a Justification for Other Than Full and Open Competition (J&A) for a non-competitive lease agreement for parking spaces in North Charleston, South Carolina. The Naval Facilities Engineering Systems Command Southeast (NAVFACSYSCOM SE) seeks to lease 100 parking spaces from Navy Land Partners, LP to support the Naval Information Warfare Center (NIWC) Atlantic at Building 198. The lease will be for an initial one-year term with four one-year renewal options, with an estimated total rental value of $285,000, and a contingency-adjusted value of $327,750.

Market research determined that Navy Land Partners is the only responsible source, as the parking lot is immediately adjacent to Building 198 and provides safe, convenient access for employees. The current annual rent is expected to increase from $25,000 to $57,000 due to local redevelopment and re-zoning. The lease is justified under 10 U.S.C. § 3204(a)(1) for "only one responsible source" because no other suitable parking areas were found in the vicinity that meet NIWC Atlantic's operational requirements. The lease is supported by approvals from the Commanding Officer of NIWC Atlantic, Naval Submarine Base Kings Bay, and Commander, Navy Region Southeast.

1. CONTRACTING ACTIVITY.

Naval Facilities Engineering Systems Command Southeast (NAVFACSYSCOM SE).

2. DESCRIPTION OF THE ACTIONS BEING APPROVED.

This justification authorizes the NAVFACSYSCOM SE Real Estate Contracting Officer (RECO) to negotiate and execute a non-competitive lease agreement with Navy Land Partners, LP to succeed Lease N69450-18-RP-00040 for an initial one-year term, with four, one-year renewal options, under reference (a). The need is for 100 parking spaces to serve Naval Information Warfare Center (NIWC) Atlantic, at Building 198, Noisette Boulevard, North Charleston, SC.

The 100 parking spaces requirement has been approved by the Commanding Officer, Naval Information Warfare Center Atlantic; Commanding Officer, Naval Submarine Base Kings Bay Georgia; and Commander, Navy Region Southeast (CNRSE).

3. DESCRIPTION OF THE REQUIREMENT AND ESTIMATED VALUE.

NIWC Atlantic occupies Building 198 in North Charleston, SC under a long-term lease with the City of North Charleston, SC. The Building 198 lease does not include sufficient parking for NIWC Atlantic employees, resulting in a continuing need for 100 parking spaces to serve NIWC Atlantic operations at Building 198, Noisette Boulevard, North Charleston, SC. NIWC Atlantic analyzed the requirement for this additional parking and concluded the parking is required to avoid significant impairment of their operating efficiency.

The estimated rental for the total term of the succeeding lease, which consists of an initial one-year term and four, one-year renewal options, is $285,000.00. Permitting for a 15% contingency allowance, the value of this J&A is $327,750.

RE/00168

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

10 U.S.C. § 3204(a)(1), only one responsible source.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY.

Navy Land Partners, LP is the only responsible source for this requirement. To effectively support NIWC Atlantic’s needs, the parking spaces must be located within close proximity and safe walking distance to Building 198 at Noisette Boulevard, North Charleston, SC. Market research identified the incumbent property immediately adjacent to Building 198, and one parking lot across the street. The second lot is located across a busy street from Building 198 and does not meet NIWC Atlantic’s efficiency of operations requirement, as employees would be required to cross a busy street in a non-pedestrian area of the City. No other suitably sized parking areas in the vicinity of Building 198 were available for lease. There is no indication that competition exists for this lease requirement. The absence of any competition, as indicated by the market research, leaves the incumbent lessor the only responsible source to meet the Navy’s needs. These factors justify negotiating and executing a succeeding lease with Navy Land Partners, LP under the cited statutory authority for other than full and open competition.

6. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICAL.

There are no other feasible vendors. Market research in the required vicinity showed there are no other properties available that can satisfy NIWC Atlantic’s requirement.

7. DETERMINATION OF FAIR AND REASONABLE COST.

Under the most recent lease, the Navy paid $25,000 annual rent. The Navy’s appraisal found redevelopment in the local area and re-zoning of the incumbent property for mixed-use development has increased the potential rental value of the property to $57,000 per year.

The RECO will make a fair and reasonable price determination based on the appraisal and market research and will use the appraisal to guide negotiations for the rent.

8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION.

The market research concluded a competitive solicitation would not be feasible to support NIWC Atlantic’s requirement for parking in the vicinity of Building 198. There are no feasible actions to remove or overcome barriers to competition, as the current location is the only space to provide adequate parking in a safe and efficient vicinity to Building 198.
