About this file
This is a Section 3 Clause document establishing compliance requirements for the County of Sacramento Department of General Services' Request for Qualifications for On-Call Architecture and Engineering Prime Consultants. The clause mandates that all contractors and subcontractors comply with Section 3 of the Housing and Urban Development Act of 1968 (12 U.S.C. 1701u) and HUD's implementing regulations in 24 CFR Part 75. Contractors must ensure that employment and economic opportunities generated by HUD-assisted projects are directed to low- and very low-income persons, particularly HUD assistance recipients. All contractors are required to notify labor organizations and post notices at work sites describing Section 3 preferences, minimum hiring numbers, job titles, apprenticeship and training availability, position qualifications, and the anticipated project start date. The clause must be included in all subcontracts, and contractors cannot subcontract with firms found in violation of 24 CFR Part 75 regulations.
The benchmark requirements established by HUD mandate that 25 percent of total labor hours on covered projects be performed by Section 3 workers, with an inclusive 5 percent of total labor hours performed by Targeted Section 3 workers. Contractors must certify compliance with these benchmarks and provide monthly reporting and documentation. Non-compliance with Section 3 regulations may negatively impact contract performance evaluations, affecting eligibility for future County contract opportunities. For Indian housing assistance projects covered under Section 7(b) of the Indian Self-Determination and Education Assistance Act, preference and training opportunities must be given to Indians, and contract awards must prioritize Indian organizations and Indian-owned Economic Enterprises to the maximum extent feasible while maintaining Section 3 compliance.
