PAPER AND ELECTRONIC MEDIA DESTRUCTION

QUESTIONS AND ANSWERS

1. Any proposed Award will be for the transportation and destruction of materials from SEC to a facility where the materials will be destroyed under a base plus Award, and is not for the procurement of electronic and information technology. Accordingly, the Section 508 Compliance Requirements (H.15) and IT Security training requirements (H.16 & H.17) contained in the proposal seems to be inapplicable to the scope of work to be performed. Therefore, Contractor requests that the solicitation be modified accordingly for all offerors for the sake of clarity, and that these provisions not be included in any resulting contract award, or that they more specifically be identified as “self-deleting”. If Contractor is incorrect in its determination, please advise all offerors and provide clarification regarding how the

Section 508 and IT Security Requirements will apply to the specific services being procured.

SEC Answer: Sections H.15, H.16 and H.17 is hereby deleted from the solicitation.

2. Section H.12 6010.05, Contractor Time Keeping (May 2013). Contractor is offering a firm fixed price solution on a per task basis and does not collect hourly time nor invoice on hourly time by employee. As such, will this requirement still apply? If this requirement will not apply in this circumstance, Contractor requests that the solicitation be modified accordingly for all offerors for the sake of clarity, and that these provisions not be included in any resulting contract award, or that they more specifically be identified as

“self-deleting”. If Contractor is incorrect in its determination, please advise all offerors and provide clarification regarding how the Contractor Time Keeping requirements will apply to the specific services being procured.

SEC Answer: The anticipated award will consist of both Firm-Fixed Price and Labor Hour CLINs therefore the subject clause will apply in the event the Labor Hour CLIN is utilized.

3. If possible would you please provide the typical quantities for destruction of hard drives, tapes, optical media and small form-factor electronic media per site?

SEC Answer: We have not regularly destroyed electronic media in while due to legal holds. There is no accurate estimate on this.

4. How often does the SEC typically request media destruction? (Monthly, quarterly, bi-annually, etc.)

SEC Answer: If referring to the electronic media please see response to the above Question 3. If referring to paper media please see current destruction schedule in Appendix 1 at the end of the RFQ.

5. Can you provide a breakdown of the media that needs to be destroyed onsite vs. media that can be taken offsite to be destroyed?

SEC Answer: Both destruction onsite and offsite options will be considered. One of the key factors is security throughout the process.

6. Will the SEC be responsible for the financial obligations regarding the Pre-Employment Check, Criminal History Check, Credit History Check and Background Check?

SEC Answer: Yes.

7. Do you have iPhones that will be included in this destruction?

SEC Answer: Only the data storage devices are part of the destruction scope. iPhone or computing devices are not part of the scope.

8. Can you confirm that smart phone batteries will be removed prior to destruction, or do you expect that your contractor will remove the batteries?

SEC Answer: Please see response to Question 7 above.

9. Optical media and small form-factor electronic media shall be destroyed in compliance with DIN

66399 O-5 and E-5 Security levels, respectively. Can these be destroyed offsite?

SEC Answer: Please see response to Question 5 above.

10. With regard to containers in section 3.1 – how long does the SEC anticipate to store the media before destruction?

SEC Answer: The containers will remain in the SEC facilities throughout the contract duration. The vendor is expected to empty the media content in those containers either on a regularly scheduled basis as in the case of paper or on as needed basis as to the electronic media.

11. Will the media be stored in the containers onsite at the SEC locations?

SEC Answer: Yes. Also see response to Question 10 above.

12. Can palettes be used in lieu of containers for the media?

SEC Answer: I assume the word “palettes” is a typo. Pallets cannot be used in lieu of secure containers.

13. For section 3.11 – Below is a copy of our Certificate of Destruction. Will this suffice?

SEC Answer: The example provided gives away who the vendor is so we were not able to confirm with the program office. If the vendor could provide an example without company information we can provide an answer.

14. 3.15 Contractor Personnel Clearance Requirement is it a Public Trust or just an SEC internal clearance? If Public Trust what level (Low, Moderate, or High). Are there any additional forms that need to be completed (NDA, Fair Credit Release, OF 306, etc.)?

SEC Answer: Contractors do not hold any level of security clearance. The SEC performs background investigations which determine if they are suitable to work with the Federal Government or have access to

Government space.

15. Please consider extending the due date.

SEC Answer: The SEC will extend Quote deadline date to Wednesday, August 24, 2016 NLT 1:00 pm

(Eastern Time).
