About this file
This document is a Sole-Source Determination & Justification from the Oregon Department of Fish & Wildlife (ODFW) for the purchase of two ECO-FLNTU combined fluorometer/turbidity sensors, part number ECO2.21111000CS, from Seabird Electronics. ODFW requires these specific sensors to match the data streams collected by their existing SBE19plusV2 (CTD) equipment, in order to maintain compatibility and consistency with oceanographic data collected across the West Coast. This is a sole-source purchase, as Seabird Electronics does not sell their products through secondary providers.
The estimated cost for the two sensors is $16,029.24. This purchase is part of a Sole Source solicitation for the Newport Data Logger project, which will result in a Purchase Order. The jurisdictions involved are Lincoln County and the City of Newberg. No additional details are provided regarding response dates, due dates, award dates, or contract term.

SOLE-SOURCE DETERMINATION & JUSTIFICATION
FOR SUPPLIES AND SERVICES
To: Contract Services
From: Matt Blume Date: 07-12-2022
Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275 for:
Description of Goods or Services:
• ECO-FLNTU combined fluorometer/turbidity sensors
P/N ECO2.21111000CS
Reason for Need:
We need a single meter that will sample and record data in an oceanographic industry standard. Our needs are to match data streams collected with our castable SBE19plusV2 (CTD), that is equipped with the same instrument. Our needs also must sample autonomous and unattended in a measurement platform that collects data and stores measurements on internal memory.
Single of Multiple Purchases:
This is for a single purchase of two units.
Estimated Cost:
$16,029.24
Research Leading to Determination:
Describe the Market Research that was conducted that supports the sole source purchase of the requested product or service.
We require these specific units because they match the same data stream on our casting CTD.
Seabird Electronics does not sell their products through secondary providers so a sole source purchase direct to Seabird is required.
Market Research should include the following:
• Source of the information - Internet search, trade journals, other governmental agencies, professional organizations, catalogs/industrial periodicals, etc.
• Supporting Documentation - Attach documentation or include information obtained showing comparisons of similar products or services available. List mandatory need vs capabilities and functionality of products or services researched proving that the requested product or service provider is the only product or service provider that can meet your minimum requirements.
• Compatibility - Our sampling needs to be comparable with other researchers collecting oceanographic data along the west coast. Our data needs to be comparable to an existing identical piece of equipment.
Analysis of Research / Findings of Fact:
Pursuant to OAR 125-247-0275(2)(a): Compatibility.
Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.
Pursuant to ORS 279B.075 (2)(b): Exchange of Software or Data.
Provide findings supporting your determination that the goods or services required for the exchange of software or data with other public or private agencies are available from only one source.
Pursuant to ORS 279B.075 (2)(c): Pilot or Experimental Project.
Provide findings supporting your determination that the goods or services are for use in a pilot or an experimental project.
Pursuant to ORS 279B.075 (2)(d): Other findings that support the conclusion that Supplies and Services are available from only one source may include but are not limited to considerations of:
unique design, availability, geographic location, exclusive authorized representative, cost of conversion, and warranty services.
Attach letter from the product manufacturer stating they are the manufacturer/seller of the product and have no resellers, or that they are the authorized reseller for the area in which the purchase will be made. (Note: if the product is available through multiple resellers, we can get competition between resellers.)
