ADDENDUM NO. 1

CONTRACT DOCUMENTS FOR: July 13, 2026 Hammocks Beach State Park Cow Channel Dredging Hammocks Beach State Park, Swansboro, NC

SCO ID #: 06-06920-03A

ACE Project #: 25001

ATTENTION ALL BIDDERS:

The following items shall take precedence over drawings and specifications of the above named project, and shall become part of the contract documents. Any original item in the specifications or indicated on the drawings not herein specifically amended, voided, or suspended shall remain in effect. Failure to acknowledge receipt of this Addendum will result in the bid being deemed non-responsive.

The bidding date REMAINS THE SAME: Wednesday July 22, 2026, 3:00 PM

The following questions were submitted by prospective bidders to Andrew Consulting Engineers during the bidding period. The responses below constitute the official interpretation and clarification of the Contract Documents.

RESPONSE TO QUESTIONS:

Question No. 1 The Channel Marker detail on Sheet C-501 specifies an embedment depth 20 feet below the bottom surface. Please confirm whether this 20-foot embedment is a minimum required depth or a fixed design depth, and whether the contractor may terminate driving at practical refusal if adequate bearing resistance is achieved at a lesser depth

Response:

• Channel marker piles shall be installed to the required embedment depth shown in the Contract Documents.

• If refusal is encountered prior to achieving the required embedment, the Contractor shall notify the Engineer.

Question No. 2 Construction Note 2 on Sheet C-102 requires that beach access be via designated access road only and prohibits disturbance of dunes or vegetation. The project requires transport of earthmoving equipment to Bear Island for beach grading and berm construction operations, which must be accomplished by barge given that water-access is the only option. Please identify the designated barge loading point on the Hammocks Beach State Park mainland side and the designated barge unloading point on Bear Island. If no designated points have been established, please advise us how the contractor should plan for equipment access.

Response:

• The anticipated access locations are the existing State Park boat ramp on the mainland and the existing barge landing adjacent to the ferry dock on Bear Island.

• The Contractor shall coordinate access with the Owner and Park Staff prior to mobilization.

• The Contractor shall be responsible for all means and methods and shall comply with the Contract Documents and permit requirements.

Question No. 3 The contract documents require pre-dredge and post-dredge bathymetric surveys of Cow Channel for acceptance and payment purposes under Section 312000. Sheet C-102 establishes specific design grades, slopes, and a 200-foot transition taper zone that the contractor is required to achieve. Please advise: (a) whether a pre-construction survey of the existing Bear Island beach profile is required prior to commencement of placement operations, and if so, who is responsible for performing it; (b) what survey deliverable, if any, is required to document final placement grades for designer acceptance of the beach placement work; and (c) whether the absence of a pre-construction beach Response:

Response:

• A pre-construction beach survey is available to the awarded Contractor.

• No additional beach survey deliverable is required by the Contract Documents.

• Final acceptance of the beach placement work will be based on compliance with the

Contract Documents.

• The Engineer may perform surveys or request additional verification, if necessary, to confirm compliance with the Contract Documents.

Question No. 4 “Notice to Bidders”/ “General contractors submitting bids on this project must have license classification for Unlimited Building Contractor”.

Is it acceptable for the contractor to have the following license and still be able to bid on this project?

• General Contracting

• Limitation: Unlimited

• Classification: S (Marine Construction)

Response:

• It is the responsibility of each bidder to possess the appropriate North Carolina General Contractor's license required for this project. Questions regarding the applicability of a contractor's license classification should be directed to the North Carolina Licensing Board for General Contractors.

Question No. 5 General Conditions of the Contract / Page 31 / g / “……. In addition, the contractor shall provide the owner with a complete instructional video (media format acceptable to the owner) on the operation, maintenance, care and adjustment of all equipment and special construction elements. Please confirm that you are NOT referring to the Contractors owned dredging equipment regarding this requirement.

• It does not apply to the Contractor's temporary construction equipment or dredging equipment utilized to perform the Work.

• The requirement applies to equipment and special construction elements incorporated into the completed Project and turned over to the Owner.

Question No. 6 General Condition of the Contract / Page 37 / Article 34 / b / “Such coverage for completed operations must be maintained for at least two (2) years following final acceptance of the work performed under the contract.

Please remove this requirement as there will be no permanent structures to ensure for this project. Once the project is completed and accepted, at that point in time, the Contractor should not be required to hold this additional insurance for this duration of time.

Response:

• This is a standard condition of the State of North Carolina State Construction Office contract. We do not have the authority to edit the state contract. The Contract Documents shall remain unchanged.

Question No. 7 General Condition of the Contract / Page 37 / Article 34 / c / “Property Insurance (Builder’s Risk/Installation Floater) Please remove this requirement as there are no permanent structures to ensure this requirement.

Response:

• No change. The Contract Documents shall remain unchanged.

Question No. 8 Sec. 011000-2 / 1.5 / B / Work Restrictions Will the contractor be allowed to operate on a 24-hour / 7 day per week schedule?

Response:

• The Contractor can operate on a 24-hour, 7-day-per-week schedule, unless subsequently otherwise directed by regulatory authorities.

Question No. 9 Form of Proposal / Pg. 2 of 4 The bid form is extremely confusing on how it is currently structured. You list this project as a “Lump Sum” bid, however you then go back and include an “Add/Deduct Schedule” which includes all the necessary bid items which could of just been included in a standard bid form with unit pricing which would neglect the need for a lump sum price. We are unsure of the intent in structuring the bid form in this way.

Please elaborate in detail in how this bid form is supposed to function and why a standard bid form was not utilized for this project when all the bid items are already included in the Add/Deduct Schedule.

• The Base Bid shall remain a Lump Sum bid.

• The Add/Deduct Schedule is provided for evaluation of potential scope changes and does not modify the Lump Sum Contract.

• Bidders shall submit the Base Bid and all requested Add/Deduct items.

Question No. 10 Bid Form Sec. 012200-1 / 1.2 / “Unit price is a price per unit of measurement for materials, equipment, or services, or a portion of the Work, added to or deducted from the Contract Sum by appropriate modification, if the scope of Work or estimated quantities or Work required by the Contract Documents are increased or decreased.”

Being that you have an Add/Deduct Schedule in which you include dredging per CY, if it is found that the dredge template has more than 42,000 Cy’s of material to be dredged, will that additional yardage be paid for under the Add/Deduct Schedule?

Response:

• Payment shall be in accordance with the Bid Form and Contract Documents.

• Payment for additional quantities, if authorized, shall be made only through an executed Change Order in accordance with the Contract Documents.

Question No. 11 Sec. 012600-2 / 1.4 / A / “Allowance Adjustment: See Section 012100 “Allowances” for administrative procedures for preparation of Change Order Proposal for adjusting the Contract sum to reflect actual costs of allowances.

Section 012100 is not a part of the provided specifications. Please advise.

Response:

• The reference to Section 012600 has been revised. See the enclosed revised specification section included with this Addendum.

Question No. 12 Sec. 312000-2 / 2.3 / A / “……. Deposits shall be made above the high-water line in confined areas to allow solids to settle within. Direct discharge into any existing body of water or wetland is strictly prohibited.” Plan Drawing C-102 / A4 Bear Island Beach Profile View

When considering the language that is detailed in the first referenced statement above, then comparing that to Plan drawing C-102, you are only allowing the contractor to place material within an approximate 20’ wide area when taking into account placing material above the high water line and staying a safe distance away from the existing sand dunes. This doesn’t allow the Contractor to position their discharge pipeline and also utilize a D6 dozer to move the material within the beach template. If this is indeed the intent on the proposed construction of this project, then this would not be a buildable project based on your specifications and plan drawing requirements.

Is the evaluation detailed above in which the Contractor needs to stay within the described limits the intent of this project?

• Temporary containment methods are the Contractor's responsibility.

• Temporary containment shall comply with the Contract Documents and permit requirements.

• The final beach profile shall conform to the grading limits shown on the Contract Documents.

Question No. 13 Plan Drawing C-102 / A4 Bear Island Beach Profile View

The design and construction sequence of the “Temporary Berm” is not feasible for this project. You are stating that the Contractor must construct a 25’ wide x 12’ tall berm in the ocean and maintain this berm prior to ever placing dredged material. Your existing mean high-water line is currently shown at 92’ and your proposed berm is showing being constructed at 0’ to 25’. There is no possible way in which to maintain this berm without the ocean immediately taking it away come the next high tide cycle. Industry standards typically have the contractor maintaining a temporary berm during active dredging operations which prevents the dredged material from going straight into the ocean, and instead, allows the material to follow this berm allowing the material to settle out prior to reaching the ocean.

This process is constantly changing based on current tide conditions in which the contractor must adapt to the changing conditions of the placement area.

Is the intent of this requirement to help manage the loss of material on the beach placement site by maintaining a lateral berm along the beach placement area, or will the current design shown on the referenced plan drawing be mandatory? If the intent is to build this project as currently designed, then knowing this would prevent us from bidding on this project due to this concept not being possible.

Response:

• The lead distance, configuration, and sequencing of the temporary berm shall be determined by the Contractor as part of the Contractor's means and methods.

• The temporary berm may be constructed and advanced in accordance with the

Contractor's construction sequence and accepted construction standards and practices.

Question No. 14 Sec. 312000-2 / 2.2 / B / “Side slopes are a requirement of this contract.”

Will there be payment made for side slopes?

Will the side slopes also have a 1’ tolerance?

Response:

• Side slopes are included as part of the required work shown on the Contract

Documents.

• Payment shall be in accordance with the Bid Form and Contract Documents.

• Construction tolerances shall be in accordance with the Contract Documents.

Question No. 15 Sec. 312000-2 / 2.2 / B / “Side slopes are a requirement of this contract.”

To achieve the required side slopes, a hydraulic dredging contractor must over swing the toes to achieve the required grade in which the side slopes will naturally fall to an angle of repose.

Is the Contractor allowed to overswing the toes of the dredge box to achieve the required 3:1 side slopes and clear the dredge template?

Response:

• The Contractor shall determine the means and methods necessary to achieve the required dredge template and side slopes.

• All work shall conform to the limits shown on the Contract Documents and comply with applicable permit requirements.

Question No. 16 Sec. 316219-1 / 1.2 / 2 & a /

• “Additional payment for pile lengths in excess of that indicated, and credit for pile lengths less than that indicated, is calculated at the unit prices stated in the Contract, based on net addition or deduction to total pile length as determined by Designer and measured to nearest foot.

• “Piles will be measured based on the actual linear feet of piles incorporated in the work.

Please confirm that the piles are NOT going to be measured for payment based on the length of the piles. The bid form states that 40’ piles are to be used for this project which is what would be purchased. It cannot be assumed that if a pile needs to be 38’, that a credit of 2’ would be returned on that bid item. The pile is already purchased, and you cannot return a 2’ section of a pile to the manufacturer for credit. We just need clarification that the Contractor will be paid for each pile per the contract unit price that is successfully installed and approved.

Response:

• Channel marker piles shall be furnished and installed in accordance with the Contract

Documents.

• Payment shall be made per each completed and accepted channel marker installation, in accordance with the Bid Form.

Question No. 17 Sec. 015000-2 / 3.2 / A / “……special construction equipment travel corridors will be established for this use, and instruction shall be issued for their use. Use of these corridors must be fully enforced.”

Plan Drawing C-102 / Bear Island Service Road

Upon completion of the site visit, it was observed that the Bear Island Service Road is a chip-n-seal road which was placed on top of the geomembrane barrier material. There are a lot of concerns as to how well this road would hold up while utilizing rubber-tired equipment to string our pipeline down this road and onto the beach.

Please provide the specs on this road regarding how it was constructed. (Ex. What kind of base is under the road, how many inches to asphalt is currently there, was this road constructed per the DOT standards)

What is the weight limit for this service road?

If this road was not built utilizing a DOT spec, then who would be responsible for the repair of this road if in fact damage was done to the road due to the use of a rubbered tire piece of equipment and the damage was NOT done due to negligence of the contractor?

Response:

• The Contractor shall be responsible for protecting existing facilities and Owner property during construction.

• No specifications or construction documents of the existing road are available.

• Any damage resulting from the Contractor's operations shall be repaired or restored in accordance with the Contract Documents. The project team will review the condition of the road prior to construction activities in order to document this condition.

Question No. 18 Sec. 015000-2 / 3.2 / B / “Use designated areas of Owner’s existing parking areas for construction personnel.

Please detail where the provided parking lot is located at for the contractors’ crews to utilize for parking.

Response:

• The Contractor can utilize the maintenance yard for construction personnel parking, subject to Owner approval.

• Any additional parking locations shall be proposed by the Contractor and approved by the Owner prior to use.

Question No. 19 015000-3 / 3.3 / C / 6 / “permanent vegetation of the areas that have been disturbed, shall be re-established as rapidly as possible”

Is there any known seeding to be performed at the beach placement site as the project is currently constructed? If so, please elaborate.

Response:

• See the enclosed list of approved seeding.

Question No. 20 Plan Drawing C-101/ Survey Data

When was the hydrographic survey performed for the dredge template.

Could you please provide the xyz files for the hydrographic survey?

Response:

• Refer to Sheet C-101 for the hydrographic survey date.

• The hydrographic survey XYZ files can be provided to the awarded Contractor after contract award.

• An updated pre-dredge hydrographic survey will be completed by the Owner prior to the commencement of construction.

Question No. 21 312000-3 / 2.5 / A / “The cross sections and grades established and shown on the plans shall be considered to be pre-dredging existing grade.

A new pre-dredged survey would need to be performed by the Owners/Engineers to provide existing conditions of the proposed dredge template. It cannot be expected for the contractor to perform this work without knowing the quantity of available material existing in the dredge box regarding payment purposes. The dredging contractor would expect to be paid for the current existing yardage removed from the proposed dredge box.

Will a new pre-dredge survey be performed prior to the commencement of this project? This would be something that needs to be performed closer to the start date prior to dredging operations taking place.

Response:

• An updated pre-dredge hydrographic survey will be completed by the Owner prior to the commencement of construction. The Owner will also conduct a post-dredge hydrographic survey.

• The Contractor shall perform the required pre-dredge and post-dredge surveys in accordance with the Contract Documents.

Question No. 22 Plan Drawing C-102 / Beach Survey Data

When was the survey performed for the beach placement area?

Could you please send out the xyz data for the beach placement area?

Question – How will the contractors Mob/demob line item be paid? Generally, all dredging contacts are structured with 60% of the Mob/demob line item being paid upon the commencement of dredging with the remaining 40% being paid upon final demobilization.

Response:

• The beach survey was conducted in May 2025.

• The beach survey XYZ data can be provided to the successful Contractor following contract award.

• Mobilization/Demobilization payment shall be in accordance with the Bid Form and Contract Documents.

Question No. 23 Sheet C-102 / A4

The plan drawings show a typical cross-section for the beach to be approximately 130’ wide with 5’ of average fill over a distance of 3000’. This volume equates to 72,000 Cys with zero loss factor consideration.

Please explain the approach anticipated in advancing the material both East and West of the beach access stairs and ramps. 72,000 Cys over 3000’ is 24 Cys per running foot resulting in only 1750’ of beach being completed based on the 42,000 Cyd bid quantity again assuming zero loss.

Response:

• The area shown on the Contract Documents was intentionally developed with additional placement capacity to accommodate variations in dredged material quantities and field conditions.

Question No. 24 Supplementary general conditions / “The Contractor shall commence work under this Contract upon written Notice to Proceed from the Designer/Owner.”

Supplementary general conditions / “Beneficial oceanfront placement operations shall only be performed during the authorized environmental work window of December 1 through April 15

Since this project is being bid 5 months prior to the projects start date due to the environmental window, we would expect that upon notice of award, that the contractor could go ahead and begin submitting submittals to prevent any unnecessary delays to the start of the project.

Will the Designer/Owner allow a reasonable amount of time for the contractor to provide the required submittals prior to the Dec. 1st start date?

When are the permits expected to be acquired for this project?

What daily reports (if any) will be required for submittal during acting dredging operations?

Response:

• Submittals may be submitted following Notice of Award and prior to Notice to Proceed.

• Environmental permits are anticipated prior to commencement of construction.

• Regarding daily reports, refer to Article 14 – Construction Supervision and Schedule of the Contract Documents.

Question No. 25 Please confirm that the ferry service is not in operation during the construction season

Response:

• Public ferry service is scheduled to be closed during the authorized construction window.

Question No. 26 Can drones be used for photo documentation during operations?

Response:

• Drone operations shall comply with applicable FAA regulations and Owner requirements.

• The Contractor shall submit a flight operations plan for Owner review and approval prior to conducting drone operations.

Question No. 27 Why do COW Channel Markers appear to be backwards? Shouldn’t red be on the right returning from Bear Island.

Response:

• Cow Channel is intentionally marked in accordance with the U.S. Coast Guard Aids to

Navigation System.

• The direction of buoyage for this channel is established based on its connection to the regional navigational system, not solely on travel to or from Bear Island.

• As a result, when traveling from Bogue Inlet toward the Intracoastal Waterway (ICW), the red aids to navigation are on the left side of the channel.

• Although this differs from the typical "red, right, returning" expectation, the existing channel markers are correctly installed and maintained in accordance with the U.S.

Coast Guard designated direction of travel.

Question No. 28 Sec. 017300-3 / 3.3 / Surveys

General Conditions / Pg. 19 / Article 14 / e / “The Contractor shall, employ an engineer or a land surveyor licensed int eh State of North Carolina to lay out the work and to establish a bench mark in a location where same will not be disturbed and where direct instruments sights may be taken.”

The survey requirements for this project are not clear as to who is responsible for handling the various surveys that may be required for this project. It appears the specifications are more generalized verse, being project specific for the work that needs to be completed.

Please detail what surveys are required by the Contractor, and what surveys will be handled by the Engineer. (Ex. Who handles – Pre & Post hydrographic surveys of the dredge template, Pre & Post surveys of the beach placement area, Property Surveys, etc.) Any surveys that are required by the Contractor, please make sure that proper detail is included as to what those survey requirements are.

Please confirm that the Contractor is being paid “In the Cut” which payment will be calculated from an updated before dredge survey of the dredge template and compared to an after-dredge survey detailing the amount of yardage removed from the cut.

Response:

• The Owner will perform updated pre-dredge hydrographic survey prior to construction. The Owner will also conduct a post-dredge hydrographic survey.

• The Contractor shall provide all construction layout and survey services required to complete the Work. The Contractor will not be paid for work outside the template.

• Payment shall be in accordance with the Bid Form and Contract Documents.

Question No. 29 Plan Drawing C-102 / C4 & C3

Typically there are buffers put in place in which the Contractors are not allowed to work within a certain distance of any fixed structures due to the nature of work that is being performed and trying to protect these areas from damage.

Is there a buffer in which the Contractor needs to stay away from the fixed structures such as the wooden Beach Access Stair & Ramp?

Is the Contractor expected to place material under the wooden beach access stars and ramp?

If so, to what extent is this work to be completed, and with what approved methods.

Are there any staging areas that will be provided to the Contractor to utilize for (Fueling operations, pipe fusion, dredge & equipment launch, crew parking, etc.)?
