Bioreactor infrastructure construction will be addressed with the successful contractor outside of this SOW.
3. Regulatory Compliance
The Contractor will comply with and assist in the surveillance of operations to support compliance with present and future regulations related to Landfill operations. Examples of the regulations include but are not limited to the following:
• Visual screening of received materials to identify potentially prohibited materials.
Screening will include evaluation of any load deemed by the gate attendants or the
Contractor as suspicious or potentially non-conforming. Periodic random load inspections will be performed as instructed by the gate attendant. Approximately five (5) random loads per month will be selected for evaluation. Load inspections will include visual assessment of the off-loaded material, documentation of findings, and recommendation to the Landfill Field Manager regarding acceptance or rejection of materials.
• Refuse will be placed in areas designated by the Owner or Owner’s Engineer in accordance with the EGLE approved plan and the current disposal area license.
• Materials requiring special handling (including asbestos) will be segregated into areas designated by SCL management.
• Regulated liquid wastes, regulated hazardous wastes, sewage, and other wastes prohibited by the Owner will not be accepted into the landfill.
• Hot ashes, embers, and any form of burning and/or smoldering refuse will not be accepted.
• No scavenging will be permitted. Separation of material for resource recovery and recycling as authorized by the Owner will not constitute scavenging.
• Solid waste originating outside of St. Clair County will not be disposed of at SCL.
4. Specific Scope of Work Required
The Contractor will perform the following services:
4.1 Solid Waste Operations
4.1.1 Solid Waste Placement
The Contractor is responsible for the proper placement and compaction of solid waste in the active work area. Solid waste will be compacted to minimize post-closure settlement and in conformance with specifications for bioreactor function as instructed by the Owner and in accordance with Section 5.2.3. Should the bioreactor system be discontinued, the Owner reserves the right to specify alternate compaction and waste placement practices.
Proper compaction will be assured by:
• Spreading and compacting of the solid waste in lifts not to exceed 10-feet thickness,
• Target compaction will achieve a ratio of not less than 2:1, with an annual target density of 1.0 tons per cubic yard. Densities will be reviewed quarterly by the Site’s third-party
Engineer for determining adjustments in target compaction based on volume and waste type,
• Implementation of approved fill sequencing plan, and
• Exceptions to these requirements include placement of certain special wastes including asbestos, potentially odorous materials and segregated demolition material which may require management separate from the daily active fill area.
4.1.2 Daily Cover
The Contractor will cover solid waste with 6-inches or more of earthen material or alternate daily cover at the end of each operating day or at more frequent intervals, if necessary, to control disease vectors, fires, odors, blowing litter, and scavenging. If clay or other low-permeability material is used as daily cover, the Contractor will scrape back the previous day's cover to allow the free movement of liquids and gases through the landfill. Any removed cover material that is no longer suitable for further use as daily cover be incorporated into the active work area in a manner acceptable to SCL.
The Owner will make daily cover soil available to the Contractor from either an outside source or from on-Site locations. Undeveloped on-Site locations may include Owner’s Northeast Borrow
Area consisting of a 72-acre parcel located adjacent to the landfill. Soils from this 72-acre parcel must be excavated and hauled to the Site by the Contractor through the entrance gate via Smiths
Creek Road. Materials obtained by an outside source will be delivered by others, however the
Contractor will be responsible for stockpile management.
The Contractor will stockpile sufficient daily cover material to meet the needs of the landfill during inclement weather. Daily cover stockpile will be maintained at a quantity sufficient for not less than three days of operations when using soils and will be managed to control run-off and erosion in a location approved by the Owner.
Currently, SCL relies primarily on use of approved alternative daily cover materials including scrap auto headliner material and/or authorized petroleum contaminated soils received as waste streams. Alternate daily cover will be used in the active area with clean soils used on outside slopes. Alternate daily cover will be staged and managed in accordance with the Site Alternate
Daily Cover Management Plan.
The Owner reserves the right to change the approved alternate daily cover used at the Site.
Alternative cover materials must be approved in writing by the EGLE and the contractor may not utilize unapproved waste materials as cover. The Contractor will use current or future approved alternate daily cover as directed by the Owner, at no additional cost to the Owner unless otherwise agreed.
The Contractor will verify the adequacy of the daily cover at the end of each workday and include a visual assessment of daily cover in the monthly housekeeping inspections. Documentation of daily and monthly cover inspections will be maintained by the Contractor for inclusion in the
Facility Operating Records.
4.1.3 Maintenance of Active Area
The Contractor will maintain all areas around the active area and provide necessary screens and/or fences to minimize blowing debris as described in Section 4.3.3.4.
The active work area will be sloped, graded, and provided with drainage facilities to prevent the collection of standing water. Stormwater that has the potential to contact refuse will be directed to the leachate collection system and prevented from entering the stormwater system.
The Contractor will protect all constructed but uncovered and/or unfilled portions of certified liners and leachate collection systems from deterioration or damage. Protection generally consists of maintenance of the minimum 1-foot layer of approved leachate collection sand over the cell geosynthetics.
4.1.4 Surveying
The Contractor will be responsible for elevation survey control of all active disposal areas of the landfill to ensure compliance with applicable rules, regulations, and approved final grades. Survey data will also include three dimensional coordinates to identify the vertical and lateral extent of work areas including asbestos disposal pits. The data may be used to identify waste locations, elevations of lifts, and determination of compaction achieved in performance of this SOW. Waste grade tolerance accurate to within 6-inch vertical elevation is deemed suitable for this purpose.
Survey control will be based on a waste-staking plan and fill model provided by the Owner. The contractor will provide labor, equipment, and any other required materials for all layout, interim and as-built surveys of the waste. At a minimum, one (1) landfill compactor must be equipped with real time Global Positioning System (GPS) equipment and associated software provided by the Contractor.
4.1.5 Leachate
The Contractor will inspect the landfill for leachate outbreaks during the routine Site inspections, outlined in Section 8. All leachate outbreaks will be reported to the Owner and repairs initiated by the Contractor within twenty-four (24) hours of identification, or sooner if the risk of environmental contamination is imminent. Imminent risk of environmental contamination includes the forecast of precipitation within twenty-four (24) hours.
Repair methods for leachate outbreaks are dependent on size, location and severity. Corrective measures may include, but are not limited to, removal of cover soils, installation of drainage aggregate to redirect leachate into the landfill, repair of cover soils, or placement and compaction of additional cover soils. Leachate outbreak repairs will be conducted with the concurrence of the Owner and noted in written inspection reports for inclusion in the Facility Operating Record.
The Contractor will immediately notify the Owner of any leachate outbreak potentially resulting in impact to stormwater which will determine any responses beyond physical repairs. Reporting a release of leachate associated with an outbreak, should it be required, will be the sole responsibility of the Owner.
Currently, SCL is permitted for leachate recirculation, however the Site is not implementing this practice. Should the practice be re-instituted, SCL will issue a change order to the Contractor to include this work in the SOW.
The Contractor will not be responsible for cleaning/sewer jetting of the leachate collection system under this SOW, nor for the removal of leachate from the Site.
4.2 Special Waste Handling Requirements
4.2.1 Asbestos Waste Management
4.2.1.1 Improper Containerization
The Contractor will notify the Owner immediately if friable or potentially friable asbestos containing waste material (ACWM) received at the active area is not properly containerized in leak-proof containers or other packaging or if visible emissions are identified during disposal.
4.2.1.2 Disposal of Friable and Non-Friable ACWM
SCL policy is to manage both friable and non-friable ACWM under the requirements of 40
CFR 61.154. The Contractor will manage friable and non-friable ACWM in the following manner:
• Restrict disposal to a designated disposal area, determined by the third-party engineer, away from vehicle traffic,
• Multiple loads of ACWM may be disposed of in a single designated area to minimize distribution throughout the landfill,
• Materials with visible emissions during off-loading may be wetted by the Contractor using a water wagon or other water source from an upwind direction. Any load observed to have visible emissions will be reported to the Owner immediately and documented as a discrepant load. Discrepant asbestos loads will not be re-loaded onto the delivery vehicle once off-loaded,
• Promptly cover ACWM with at least 6-inches of soil before it is compacted or otherwise run over by heavy equipment in a manner that prevents asbestos fibers from being released into the air or tracked to a location outside the designated area,
• Record the 3-dimensional disposal location and volume of ACWM received as described in 4.14,
• Provide ACWM survey records to the Owner prior to moving to a new disposal area,
• Personnel must be trained in asbestos waste handling in accordance with the federal
National Emission Standard for Hazardous Air Pollutants (NESHAP) program and
Occupational Safety and Health Administration regulations, and
• Ensure personnel wear appropriate PPE during asbestos waste handling operations if applicable under OSHA requirements.
4.2.2 Odorous Waste Management
The Contractor will notify the Owner immediately of odorous waste streams and will record handling procedures for each type of such odorous waste streams identified.
• Odorous waste must be covered with a minimum of six inches of soil or alternative odor-controlling cover as soon as practical, but no longer than 30 minutes of offloading,
• Application of odor neutralizing agents, as directed by the Owner, must be applied when necessary, and
