DLA Troop Support Subsistence usti c tion n Appro A or r n e or u e uire ent

1. Defense Logistics Agency (“DLA”) Troop Support, Subsistence Supply Chain, is the contracting activity.

2. The action being approved is the ability to solicit for DLA requirements for speci c brand name items, while also permitting submission of “or equal” items that are able to be determined equal to the brand name items.

3. This acquisition will be issued as a Request for Quotations (RFQ) for certain supplies required to meet DLA’s needs. These required items are as follows: 1) Vulcan, 6 Gal Steam Kettle, K6ETT-7 (1 each), 2) Cleveland, Tilt Skillet, SGL-40 (3 each), 3) Alto-Shaam, Combi Oven, CTP20-20G (2 each), 4) Avantco, Case Refrigerated Carousel, BCR15 (7 each), 5) 5’ Cold Bar Serving Line (1 each), 6) Vulcan Deep Fryer, 1TR65A-2 (1 each), 7) True, 4 Shelf Freezer, GDM-23F-HC~TSL0127 (2 each), 8) True, Pass Thru Cabinet, TA2HPT-2S-2S (1 each), 9) Vulcan, Cooker/Steamer, (1 each), 10) Cleveland, 20 Gallon Tilting Kettle, KET-20- T (1 each), 11) Vulcan, 10 Burner Range, 60SS-10BP (1 each), 12) Hobart, Meat Slicer, EDGE 14-11(2 each), 13) Hobart, Convection Oven, HEC5 (4 each), 14) Garland, 6 Sealed Burner Range with Oven, SS686 (1 each), 15) Vulcan, 6 Burner Gas Range, 36C-6BP (1 each).

Further, the awardee will be required to meet installation requirements that include the installation of the new item(s) as well as removal and disposal of any replaced items.

FAR 6.302-1 (c)(2), provides that “Brand-name or equal descriptions, and other purchase descriptions that permit prospective contractors to o er products other than those speci cally referenced by brand-name, provide for full and open competition and do not require usti cations and approvals to support their use.” However, Section 888(a) of the National Defense Authorization Act for Fiscal Year 2017 (Pub. L. 114-328), as implemented by DFARS 206.302-1(c)(2) and 213.501(a)(ii), requires this usti cation and Approval in order to use brand name or equal descriptions

5. The Hawaiian Islands have unique electrical standards that di er from other CON S locations. The above equipment, or equal, is required in an e ort to reduce issues with voltage compatibilities.

The Name brand equipment, or equal items, are required as they are tested and proven to work reliably with the local voltage speci cations, ensuring optimal performance and reducing the risk of electrical issues or damage. This compatibility is crucial for maintaining the e iciency and safety of dining facility operational needs.

This applies to all items under this acquisition.

The items being procured are publicly available commercial items, this acquisition is being issued as brand name or equal in an e ort to solicit o ers form as many sources as is practicable by allowing the consideration of alternate “or equal” items. This usti cation will be made available for public inspection with the solicitation, redacted as necessary, in accordance with FAR 6.305(c). A notice will be publicized as required by Subpart 5.2 of the

FAR.

7. As the contracting o icer, I hereby determine that the anticipated cost to the Government will be fair and reasonable, .

9. There are no additional facts supporting the use of Brand Name or Equal requirements.

DLA Troop Support does not own or have access to approved military speci cations for items required by the customer. The items are not in association with a National Stock Number (NSN).

11. In an e ort to overcome barriers to competition, the solicitation for these items will allow for submission of items that are equal to the brand name items. Technical data packages for o ers of alternate items will be sent to the customer in order to determine acceptability.

12. As the contracting o icer, I hereby certify that this usti cation is accurate and complete to the best of my knowledge and belief.
