STATEMENT OF WORK

Activated Shield Wall Disposal - LLRW

I. BACKGROUND

The National Institute of Standards and Technology (NIST) has a requirement for processing and disposal services for steel shield walls containing wax and steel shot. The shield walls were used as neutron experiment shields (approximately 145,000lbs.) which are classified as Low Level Radioactive Waste (LLRW). The shields are below 10CFR61.55 Class A limits. NIST has a U.S. Nuclear Regulatory Commission (USNRC) “Radioactive Materials License” (SNM-362) and USNRC “Reactor License” (TR-5), and is authorized to possess by-product material in any chemical and/or physical form.

The materials for disposal conforms to acceptance criteria for the suggested methods of waste processing.

II. SCOPE OF WORK

a. The Contractor shall provide services for loading, transportation, processing and disposal of steel and wax neutron experiment shielding.

b. The characteristics (http://www.nrc.gov/reading-rm/doc-collections/cfr/part061/part061-0056.html) of the LLRW to be provided for disposal are as follows:

1. The LLRW consists of 32 shield walls of different shapes and sizes that consist of a steel shell containing wax and steel shot. The items as a collective weigh approximately 145,000 pounds. Very low level internal contamination and/or activation, if any, with external contact dose rate less than 0.15 mr/hr. The items do not contain RCRA- hazardous materials. The activation product contained is primarily the Co-60 isotope. (see Chart 1 under Attachments)

III. SPECIFIC TASK REQUIREMENTS

a. The Contractor shall furnish the necessary personnel, material, equipment, services, and facilities to perform these requirements. Multiple shipments are expected.

1. The Contractor shall provide for processing and preparation for shipments of the types of LLRW identified in Section II b 1. indicated above (http://www.nrc.gov/reading-rm/doc-collections/cfr/part061/part061-0055.html), in suitable containment, such as full enclosure, tarped and/or shrink wrapped.

2. The Contractor shall provide for LLRW processing, volume reduction, shipping and burial document preparation, transport to burial site and burial.

3. The Contractor shall provide transportation of the waste materials (http://ntl.bts.gov/DOCS/hmtg.html) to the proposed burial and processing site(s), to include all shipping, truck, and container transport charges. This shall include any charges associated with the contract carrier driver during transport and loading while detained at the NIST facility, to include overnight expenses and demurrage charges where applicable.

4. The Contractor shall choose the method of waste processing. The method must conform to all proposed waste site acceptance criteria and comply with NCR 61.55 Waste Classification and 61.56 Waste Characteristics.

5. The Contractor shall make the appropriate arrangements for loading the shield walls onto the trucks for transport. NIST personnel will not be available to load the materials.

6. The Contractor shall make the appropriate arrangements and provide a shipping agent at the NIST facility during shipments to certify compliance with all state and federal transportation requirements. The Contractor’s agent shall complete the following forms: NRC Forms/Manifests: NRC-540 “Uniform Low-Level Radioactive Waste Manifest – Shipping Paper” and NRC-541 “Uniform Low-Level Radioactive Waste Manifest – Container and Waste Description, using NIST-supplied data. The TPOC will provide the required data to the contract recipient’s shipping agent via email, one (1) week prior to the proposed shipment date. Data will be provided at least one week prior to the proposed shipment date.

7. The Contractor shall adhere to all applicable federal, state and local regulations pertaining to the shipment(s), processing, and burial of the LLRW. Exact dates and times for scheduling of proposed shipments shall be coordinated with the Technical Point of Contact (TPOC), the Contractor and any shipping agents or carriers involved with the shipment(s). The exact date of shipments shall be mutually agreed upon by the Contractor and NIST and shall occur NLT December 31, 2016.

8. The Contractor shall provide documentation of qualifications for any person involved in the preparations for shipment(s) and transport of LLRW from the NIST facility, including Dept. of Transportation (DoT) hazmat training certifications, commercial driver’s license(s) and medical certification(s) for the carriers and agents as required by regulation. Necessary documentation shall be provided at least two days prior to the scheduled shipment date.

9. Contractor shall provide a copy of all completed documents, to include all labels and forms required by U.S. DoT Hazardous Materials Regulations, 49CFR171-180 inclusive, including shipping papers, emergency response plan, security plan, and a shipment survey form\

10. The Contractor shall provide and affix all required placards to the transport vehicle as required by 49CFR171-180.

11. The Contractor shall provide and affix all required package labels, and shall mark all packages, as required by 49CFR171-180.

IV. DELIVERABLES AND DUE DATES

Prior to departure of any hazardous materials shipments from the NIST facility, the Contractor shall provide a copy of all completed documents, to include all labels and forms required by U.S. DoT Hazardous Materials Regulations, 49CFR171-180 inclusive, including shipping papers, emergency response plan, security plan, and a shipment survey form.

Using data furnished by the TPOC (NIST Reactor Health Physics), the Contractor shall provide a completed and signed copy of the current Form 540/541 with the Block 9 (Consignee signature acknowledging waste receipt) to NIST, certifying receipt of the LLRW at the vendor facility listed on the current Form 540/541 within (1) week of receipt of the shipment(s).

The Contractor shall provide quarterly processing and disposal status updates thereafter until all LLRW has been properly disposed of. Updates shall be provided in a Word Doc and shall be delivered to the TPOC via email and a paper copy. Updates shall document current disposition of the materials required. The Updates shall be delivered to the TPOC each quarter after the shipment has been completed.

The Contractor shall provide notification of final disposition of the LLRW to the TPOC within 30 days of the completion of all transfers, processing and disposal. Notification shall be in writing. Updates shall be provided in a Word Doc and shall be delivered to the TPOC via email and a paper copy. Updates shall document current disposition of the materials required.

The Contractor shall allow NIST to verify and copy the driver’s Commercial Driver’s License (CDL) and current safety training certification card.

V. PERIOD AND PLACE OF PERFORMANCE

The period of performance for the services and shipment reflected herein, should occur within 60 days after award, and shall proceed directly to the processor as an exclusive use shipment. Since this is an exclusive use shipment, the shipment must proceed directly to its destination without any stopovers with an exception allowed for bathroom and food breaks. No other cargo is permitted to carried with this shipment.

Performance shall be conducted at the NIST Gaithersburg, MD facility and the Contractor’s processing and burial facilities.

When performing work at NIST, the Contractor shall comply with all NIST requirements and instructions while on site. The Contractor shall provide names and required information to the TPOC, via email, at least (2) business days prior to arrival at NIST to allow for adequate time for visitor registration.

Work shall be performed at the NIST Gaithersburg Campus, between the hours of 8:00 AM to 5:00pm, EST, Monday-Friday.

VI. CONTRACTOR’S MINIMUM QUALIFICATIONS

The Contractor must be a licensed radioactive waste broker, must provide commercial transport vehicles using licensed drivers and must provide licensed rigging crew for the performance of the required services. All health and safety requirements for transport of hazardous materials shall be met.
