1. GENERAL OVERVIEW

This solicitation is issued as a Two-Phase Design-Build procurement in accordance with Federal Acquisition Regulation (FAR) 36.3. Phase I is a Request for Qualifications (RFQ).

Proposals will be evaluated in Phase I to determine which offerors will submit proposals for Phase II. A maximum number of three (3) offerors will proceed to Phase II. Phase II is a Request for Proposal (RFP). Phase II RFP will be issued to only those successful offerors determined to be the most highly qualified from Phase I. One firm-fixed-priced (FFP) contract will be awarded using competitive negotiation.

This solicitation is for the RFQ phase (Phase I) of the design-build (DB) renovation project of Building 3 at the National Institute of Standards and Technology (NIST) located in Boulder, Colorado.

2. DESCRIPTION OF THE PROJECT

NIST is currently making significant improvements to its 64 year old Boulder campus. NIST seeks to convert Building 3, built in 1951 and consisting of approximately 18,000 square feet, to new office, laboratory and supporting spaces for approximately 105 scientists and staff.

The project may include full demolition of Building 3, or partial demolition with limited renovation, and new construction as needed to meet the program requirements. The project will also require site improvements to landscaping, sidewalks and parking.

The newly renovated Building 3 will serve as the headquarters of the Communications Technology Laboratory (CTL), a newly formed Organizational Unit (OU). The planned size of the re-purposed Building 3 is approximately 25,000 usable square feet (usf), corresponding to 41,000-43,000 gross square feet (gsf). When re-purposed, Building 3 will house laboratories and offices for the CTL. The proposed laboratories are dry labs, accommodating computer stations, servers and desk-top equipment. Office space will be developed in a flexible open office arrangement, including meeting rooms, employee amenities, and building service spaces for functional and code requirements. The building will also be used for occasional workshops. The completed project is expected to provide comfortable and functional interior spaces and supporting spaces, improve energy efficiency and sustainability, and result in an architecturally superior facility that will enhance the appearance of the NIST campus.

For informational purposes only: The Colorado State Historic Preservation Office (SHPO) is currently reviewing the project design concept and has not yet finalized its review.

3. GENERAL PROCEDURES/REQUIREMENTS

PRELIMINARY REVIEW

Proposals shall describe the capability of the offeror to perform the requirements of the Solicitation. Proposals should be specific and complete in every detail. Proposals should be

PAGE 11 OF 95 SB1341-15-RP-0019

prepared simply and economically, providing a straightforward and concise description of capabilities to satisfactorily perform the requirements. Proposals should include page numbers, be practical, legible, clear, and coherent. In order to effectively and equitably evaluate all proposals, the Contracting Officer must receive information containing sufficient detail to allow review and evaluation by the Government. Proposal clarity, organization, and cross-referencing are mandatory. Failure to submit and organize proposals as requested may adversely affect an Offeror's evaluation.

4. INTRODUCTION - NOTICE TO OFFERORS

This section is designed to provide the offeror with instructions to complete and deliver a complete competitive proposal in response to this RFP. The selection procedures to be used will be a two-phase approached in accordance with FAR Subpart 36.3. The two-phase selection procedure authorized under 41 U.S.C. 3309 allows offerors to submit information related to specialized experience, technical competence, capability to perform, past performance, teaming arrangements and/or other information requested in phase one. Based on information submitted in phase one, the Government will select no more than three (3) of the most highly qualified offerors to advance onto Phase II in the competition and are subsequently invited to submit complete technical and price proposals. All proposals must be complete and timely to be considered.

4.1. Acquisition Method Overview

The method of acquisition for this procurement considers the “Best Value” continuum, wherein a Best Value source selection process will be utilized in accordance with the FAR 15.101. Award will be made to the proposal that represents the best value to the Government as determined by the Government using the tradeoff process. This process permits the tradeoffs among cost/price and non-cost factors and allows the Government to accept other than the lowest priced proposal or the highest technically rated offer.

The evaluation and tradeoff process are subjective in nature. The offer determined to be the Best Value may not be the lowest price or the highest technically rated offer. The decision will involve a comparison and trade-off analysis of the combination of non-price strengths, weaknesses, and risks; the evaluated cost/price offered in each proposal, and judgment as to which proposal provides the best combination. As a result offerors must provide their best proposal with all required information in the required format.

Information provided must be complete, clear and legible to obtain the best evaluation rating possible.

Award of one Firm Fix Price (FFP) DB construction contract requiring delivery and installation is contemplated for this acquisition.

4.2. Relationship

The degree of success of this project will depend largely upon the nature of the relationship between the Contractor and the Government. The Government’s intent is to work with the Contractor as an integrated team with common goals of improving

PAGE 12 OF 95 SB1341-15-RP-0019

quality, improving productivity, achieving cost savings, and achieving other economies and efficiencies across the full spectrum of performance. To the greatest degree possible, the Government intends to adopt commercial practices to accomplish these goals. The Government will provide the Contractor maximum flexibility to determine specific work methods that satisfy the requirements in the contract. The Government expects the Contractor to take customer preferences into consideration, participate with the Government in continuous improvement activities (such as optimizing the phasing of the effort), and proactively address risks and challenges to project success. The Government also intends to work with the Contractor to devise and implement processes that are appropriate for this DB project, that maximize efficiency, and provide the Government insight into project progress without an undue level of Government oversight.

4.3. Contract Cost Ceiling Limitation for Design and Construction Costs

4.3.1. The design and construction costs will be subject to the funds available for this project. The maximum award price amount (current maximum funds budgeted) for design and construction is $17,559,234. The Government will not consider award to an offeror based on a price proposal which exceeds the target award amount of $17,559,234.

4.3.2. Offerors are under no obligation to propose/meet the maximum price amount of

$17,559,234. This is a best value source selection utilizing price and non-price tradeoffs.

4.3.3. Award of a contract is subject to the availability of funding. Funding is currently not available for this project; however, funding is budgeted for the project and is expected to be available for the time of award.

4.4. Solicitation process

4.4.1. The solicitation process is known as the “Request for Proposals” (RFP).

Interested firms (referred to as “offerors”) may submit certain specified performance capability proposals, demonstrating their capability to successfully execute the contract resulting from this solicitation. The Government will evaluate the performance capability proposals in accordance with the criteria described herein.

The Government will evaluate the proposals, in accordance with the criteria described in the solicitation (Evaluation Factors for Award), and award a FFP DB construction contract to the responsible offeror whose proposal conforms with all the terms and conditions of the solicitation, and whose proposal is determined to represent the overall best value to the Government considering all factors and price.

The proposal must describe the capability of the Offeror to perform the work, PAGE 13 OF 95 SB1341-15-RP-0019 describe the Offeror’s understanding of the requirements contained in the solicitation and set forth full, accurate, and complete information as required by the RFP.

4.4.2. Oral Presentations:

Phase II of the RFP process requires each offeror to conduct an oral presentation.

The Government anticipates conducting oral presentations at the National Institute of Standards and Technology (NIST) Boulder Campus, 325 Broadway, Boulder, CO 80305.

4.4.3. Offerors will not be participating in a sealed bid procurement process under this acquisition method. Issuance of this RFP does not constitute an award commitment on the part of the Government.

In the event of any conflict between the soft copy and the hard copy, the hard copy submission shall take precedence and will be the material upon which the Government bases its evaluation and ultimately its decision.

5.8. Confidential Information

The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contractor qualifications and proposals submitted to Federal agencies. If an offeror’s submissions contain information that they believe should be withheld from such requestors under FOIA on the grounds that they contain “trade secrets and commercial or financial information” [5 USC§552(b)(4)], the offeror should mark its submissions in the following manner:

• The following notice should be placed on the title page: “Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act. Material

PAGE 17 OF 95 SB1341-15-RP-0019

considered privileged or confidential on such grounds is contained on page(s)

5.9. Limitations in Contracting

The Architect-Engineering (A-E) design firm that prepared the performance requirements documents is excluded from participation on this project. To prevent a conflict of interest, contractors submitting responses to this RFP are prohibited from teaming, partnering, subcontracting or engaging in any other business relationship regarding the Building 3 Renovation project with the following firm:

Metropolitan Architects and Planners, Inc.

1505 Prince St STE 200 Alexandria, VA 22314-2874 United States

DUNS: 944258086

CAGE Code: 1FER5

6. SOURCE SELECTION PROCEDURES

The acquisition will utilize a two-phased DB selection process in accordance with (IAW) FAR Subpart 36.3. Phase I of the solicitation will be a RFQ in which all potential sources are able to submit proposals demonstrating their qualifications including past performance, technical competence and overall capability.

Phase I involves all non-price factors. Factor 1 is rated as Pass / Fail. All other non-price factors are considered of equal importance. Following evaluation of Phase I proposals, the Government will select up to three of the most highly qualified contractors to participate in Phase II of the source selection process.

Phase II of the solicitation will involve a RFP which will require the submission of both a price proposal and a technical proposal each of the Phase II offerors. The technical proposal requirements involve a complete design solution to satisfy the requirements of the RFP. The design solution shall include proposed construction methods, phasing, and timelines.

This procurement will utilize the target award method whereby the RFP will state the maximum dollar amount of $17,559,234 as the maximum award amount.

This action will utilize the procedures of FAR Part 15 – Contracting by Negotiation. The CO will utilize the best value continuum of FAR 15.101. The tradeoff process will be used to IAW FAR 15.101. Source selection procedures will be utilized as set forth in FAR 15.3 to

PAGE 18 OF 95 SB1341-15-RP-0019

select firms using the best value tradeoffs method. The Government may award to other than the lowest priced offeror or other than the highest technically rated offeror based on best value determination, in the best interest of the Government. The tradeoff process applies specifically to Phase II which involves both non-price factors and price.

Phase II will include the evaluation of both price proposals and non-price/technical proposals. Phase II will also include oral presentations by each of the offerors for Factor 1 – Technical Approach. The Government will first evaluate non-price proposals. Following the completion of the evaluation of non-price proposals, the Government will evaluate price proposals. The Government will then combine the results of the technical proposal evaluation and the price evaluation and make a best value award determination.

The Government intends to make an award without discussions; however, reserves the right to establish a competitive range and conduct discussions, if deemed necessary, following the evaluation of initial proposals at either or both of Phase I and Phase II.

7. PHASE I - REQUEST FOR QUALIFICATIONS (RFQ)

Factor 1 - Bonding Capacity (Pass/Fail) Factor 2 - Technical Approach (Composition and Management of Proposed DB Team) Factor 3 – Experience (Construction and Design) Factor 4 - Past Performance (Construction and Design)

Factor 1, Bonding Capacity is rated on a Pass/Fail Criteria. All other factors are of equal importance. A failure in Factor 1 renders the overall Phase I proposal as non-selectable to proceed to Phase II.

8. PHASE I – REQUEST FOR QUALIFICATIONS (RFQ) SUBMITTAL

INSTRUCTIONS AND EVALUATION FACTORS FOR AWARD

Phase I submissions shall consist of a non-price proposal only. DO NOT SUBMIT PHASE II FACTORS WITH PHASE I. All Phase I submittals shall be included in a two-, four-, or six-part folder, classification folder, or equivalent with a tab for each factor.

8.1. Evaluation Criteria: Phase I – Request for Qualifications (RFQ)

8.1.1. Factor 1, Tab A – Bonding Capacity

Proof of Bonding Capacity (Pass/Fail Criterion) – Offerors must demonstrate the ability to achieve a performance bonding capacity at a minimum amount of $17.6 million for the project.

Submittal Requirements

Offerors shall submit a letter from the Offeror’s surety stating the surety’s commitment to bond the Offeror at a minimum of $17.6 million for the project.

PAGE 19 OF 95 SB1341-15-RP-0019

The Offeror shall submit a total of seven (7) copies of the letter. Note: An actual bond is not required.

Basis of Evaluation

The Surety letter will be evaluated to ensure that the offeror has the ability to obtain a minimum bonding value of $17.6 million for the project, if awarded. The proposal will be rated for this factor as a Pass or Fail. Failure to demonstrate the ability to meet the minimum bonding capacity for this project is a deficiency in the proposal which renders the proposal as unawardable.

8.1.2. Factor 2, Tab B – Technical Approach

The composition and management of the firms proposed as the DB team for this contract will be evaluated in this factor.

Submittal Requirements

Provide a narrative describing the proposed primary construction firms and primary design firms for this contract and the rationale for proposing this arrangement. Provide the role, responsibilities, and contractual relationships between the various firms (see FAR subpart 9.6). The narrative shall also include an organizational chart that clearly identifies the lines of authority between the entities. If the experience of a significant subcontractor is being claimed in Factor 3, the firm must be named in the above narrative and organizational chart.

The technical approach narrative shall be limited to five (5) double-sided pages (or ten (10) single-sided pages) including the organizational chart. The information requested in below is not included in this page limitation.

In addition to the narrative, the Offeror shall submit a signed copy of a joint venture (JV) agreement, partnership agreement, teaming agreement, or letter of commitment for each member of the Offeror’s team identified above (e.g., JV partner, partner, team member, subcontractor, parent company, subsidiary, or other affiliated company, etc.).

Basis of Evaluation

The assessment of the Offeror’s technical approach will be used as a means of subjectively evaluating the capability of the Offeror to successfully meet the requirements of the RFP via the proposed DB team.

PAGE 20 OF 95 SB1341-15-RP-0019

8.1.3. Factor 3, Tab C - Experience

Submittal Requirements: The Offeror shall submit the following information:

Construction Experience:

Submit a maximum of five (5) construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as a Design Build or Design Bid Build project valued at $10 million or more, involving new construction or renovation of a building involving architectural, civil, structural, electrical and mechanical (plumbing, HVAC, fire suppression system) work types. The offeror may submit relevant experience from a subcontractor or other teaming member that they propose to use; however, the offeror must also submit a signed copy of a JV agreement, partnership agreement, teaming agreement, or letter of commitment for the subcontractor or teaming member.

Projects submitted for the Offeror shall be completed within the past seven

(7) years of the date of issuance of this RFP.

A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather Offerors should submit the work performed under a task order as a project.

The attached Construction & Design Experience Project Data Sheet (RFP Attachment A) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design. If the Offeror is a JV, relevant project experience should be submitted for projects completed by the JV entity. If the JV does not have shared experience, projects shall be submitted for each JV partner. Offerors who fail to submit experience for all JV partners may be rated lower. Offerors are still limited to a total of five (5) projects combined.

If an Offeror is utilizing experience information of affiliates / subsidiaries / parent / Limited Liability Company (LLC) / Private Limited Company (LTD) member companies (name is not exactly as stated on the SF 1442), the proposal shall clearly demonstrate that the affiliate / subsidiary / parent firm will have meaningful involvement in the performance of the contract.

The Offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offer must provide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract.

Design Experience:

Submit a maximum of five (5) design projects for the design team that best demonstrates design experience on relevant projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a relevant project is further defined as a Design Build or Design Bid Build project valued at $10 million or more, involving new construction or renovation of a building involving architectural, civil, structural, electrical and mechanical (plumbing, HVAC, fire suppression system) work types.

Projects submitted shall be completed within the past seven (7) years of the date of issuance of this RFP. For design-build projects, the design portion of the contract shall have been completed within the past seven

(7) years of the date of issuance of this RFP.

A project is defined as a complete design effort performed under a single task order or contract/subcontract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather Offerors should submit the work performed under a task order as a project.

The attached Construction & Design Experience Project Data Sheet (Attachment A) is MANDATORY and SHALL be used to submit project information. If the same project is being used to demonstrate
