JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

1. Identification of Agency and Contracting Activity: The U.S. Department of State’s

Office of Acquisitions Management (A/LM/AQM) is conducting this acquisition on behalf of the

Defensive Equipment and Armored Vehicle Division (DS/C/PSP/DEAV) of the Bureau of

Diplomatic Security (DS).

2. Nature and/or description of the action being approved: This justification and approval is for the award of a purchase order for commercial items for the procurement of

Toyota Land Cruiser 200 units on a brand-name only basis.

3. A description of the supplies or services required to meet the Department’s needs

(including the estimated value): DOS intends to acquire twenty-nine (29) Toyota Land Cruiser

200s. DEAV has requested the procurement for world-wide deployment at U.S. posts.

4. An identification of the statutory authority permitting other than full and open competition: 41 U.S.C. 1901 (a)(2) as implemented by FAR 13.501(a)..

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: The Toyota Land 200 is the only brand that meets the Government’s needs for a mid-size sport utility vehicle with a right hand drive option and support low profile appearance which compliments operation security concerns. In addition, the LC 200 can be supported by local Toyota dealership for field maintenance reducing overall program risks.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: A FedBizOpps notice will be publicized as required by

FAR 5.2, along with a copy of the solicitation for all interested parties to review this opportunity.

As required by FAR 5.207(c)(16)(i), the agency shall consider all proposals submitted by responsible sources in response to the FedBizOpps posting.

7. A determination by the Contracting Officer that the anticipated cost to the

Government will be fair and reasonable: The Contracting Officer will include a statement of price reasonableness in the contract file based on a comparison of the proposed price with prices found reasonable on previous purchases.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted: The Government has conducted informal market research online and concluded no other potential competitor can meet this requirement.

9. Any other facts supporting the use of other than full and open competition: GSA’s

AutoChoice system will not be utilized for this requirement because some of the vehicles are right-hand drive as well as OCONUS-spec for overseas usage. The U.S. Department of State

(DoS) received a waiver from GSA, which authorizes DoS to purchase the base vehicles directly from the awarded armoring contractor as part of the order.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:

N/A

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: This J&A for other than full and open competition will be published on FedBizOpps with the solicitation. The Government will continue to check the marketplace to see if other armor vehicle manufacturers are able to offer similar solutions for future competitive opportunities.

TECHNICAL AND REQUIREMENTS CERTIFICATION (FAR 6.303-2(c))

I certify that all supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification are complete and accurate.
