SOLE SOURCE JUSTIFICATION AND APPROVAL

1. Identification of Agency and Contracting Activity:

The U.S. Department of State’s Office of Acquisition Management is planning to establish a five-year Blanket Purchase Agreement for SIG Sauer Legacy P229R and P239 9mm pistols (with a spare parts program) on behalf of Diplomatic Security, Defensive Equipment and Armored Vehicle Division (DS/PSP/DEAV),

2. Nature and/or description of the action being approved:

The action being approved is the award on a sole source basis of a new Blanket Purchase Agreement (BPA), with an ordering period of a base year and four option years, pursuant to the procedures at FAR 13.303 Blanket purchase agreements (BPAs) and FAR 13.501, Simplified procedures for certain commercial items.

3. Description of the supplies or services required to meet the Agency's needs:

It is required that the SIG Sauer (legacy) P229R and P239 pistol models be purchased for issuance to agents who will be assigned to domestic and overseas posts. This will enable the agents to provide continued protection and security for personnel. Additionally, continued safe travel and protected movement is required for high level U.S. Embassy and Consulate officials while traveling overseas, and for Ambassador level officials serving in international organizations working to restore and maintain economic and social stability.

4. Statutory Authority:

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1).

The regulatory authority is FAR 13.501, Simplified Procedures for Certain Commercial Items.

5. Demonstration that the proposed contractor's unique qualifications or nature of the acquisition requires use of the Authority cited: Under the Diplomatic Security and Antiterrorism Act of 1986, the Bureau of Diplomatic Security has a broad range of responsibilities that include the protection of personnel and facilities, both domestic and abroad.

The DS Special Protective Equipment Review Board (SPERB) has approved only the Legacy SIG Sauer Legacy P229R pistol for standard duty use by all Special Agents within DS. The SPERB has also approved only the SIG Sauer P239 for alternate duty carry in specific situations. No other pistols are approved for duty carry by DS Special Agents.

6. Description of efforts made to ensure that offers were solicited from as many sources as practicable: Only the Legacy SIG Sauer Legacy P229R pistol has been approved by the SPERB for standard duty use by all Special Agents within DS. The SPERB has also approved only the SIG Sauer P239 for alternate duty carry in specific situations. Therefore, no other sources are eligible for consideration at this time.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The U.S. Department of State has procured the Sig Sauer Legacy P229 and P239 pistols before and has prior pricing records to reflect fair and reasonable pricing.

8. A description of the market research conducted and the results or statement of reasons a market research was not conducted: Only the Legacy SIG Sauer Legacy P229R pistol has been approved by the SPERB for standard duty use by all Special Agents within DS. The SPERB has also approved only the SIG Sauer P239 for alternate duty carry in specific situations.

Therefore, no additional market research was conducted.

9. Any other facts supporting the use of other than full and open competition: Without the requested weapon the Diplomatic Security Service will be unable to provide the proper level of security and protection. The SIG Sauer Legacy P229R 9mm, and 239 pistols are unique systems that our armorers have been certified to repair and that the agents have been trained to use. The U.S. Department of State is unable to utilize multiple pistol systems at one time. The requested weapon is what Diplomatic Security agents are trained to use during their initial training period.

The economic impact to the U.S. Government for using other items than what is requested would be great and would involve the retraining of all agents in the field including purchasing all new weapons systems to issue to the various mission locations abroad. SIG Sauer is the sole manufacturer of the Legacy P229R/P239 systems. Additionally, only the Sig Sauer Legacy P229 pistol (with rail) and the P239 pistol referenced in this justification will meet the Government’s need and there are greater benefits of higher quality weaponry and warranty issued directly from the manufacturer.

The weapon system described above is to be utilized by the agents assigned to overseas posts.

The vendor states that the lead time on these items is 30 days from the date of order and no other source could provide the Legacy P229R /P239 models in such a timely manner. The P229R/P239 units are needed as soon as possible, so it is imperative that this be treated as circumstances permitting other than full and open competition.

10. A listing of sources, if any, that expressed in writing and interest in this acquisition:

N/A

11. A statement of the actions, if any, the Department may take to remove or overcome any barriers to competition before any subsequent acquisition for these supplies or services:

No actions have been taken take to remove or overcome any barriers to competition since no other manufacturer can provide the Legacy P229R and P239 models. The Bureau of Diplomatic Security conducts an ongoing evaluation program that identifies, tests, and evaluates weapons that might be used in real world operations. The Firearms Policy Review Board (now called the Special Protective Equipment Review Board) reviews the results and approves the use of new weapons. In the future, should DS identify weapons that provide specific improvements that might increase our ability to better protect personnel in the field; the FPRB will consider that weapon or system for use in the field.
