This requirement does NOT apply to recyclables (materials, excluding hazardous waste, which have been separated from trash/debris and which may be recovered as useful materials) or hazardous materials (defined in 40CFR243.101). This applies to an open top dumpster at HST for construction debris to be removed and recycled.
The Contractor shall furnish and maintain all necessary containers and dumpsters, except those listed under Government-Furnished Equipment on page 45. Equipment and PM frequencies are listed under Government-Furnished Equipment on page 45. PM/repairs are defined as services required to prevent/repair a breakdown or failure of container/compactor equipment or to put equipment or systems back into service after a detected breakdown or failure. Contractor shall accept full responsibility for mechanical, hydraulic and electrical operation and maintenance, upkeep, reliability, sanitation, and safety during the entire period of the contract; this includes operation and maintenance while still under warranty. All PM/repairs shall be performed in accordance with the manufacturer’s guidelines/instructions/specifications. The first working day of each month the Contractor must submit a PM report (hard copy) to the COR detailing any PM performed the previous month; the report also shall include date and time, identification of the specific equipment and its location.
(b) Maintenance Repair Monetary Limitations - The total dollar value for each repair will be determined by a COR estimate for labor, parts, and materials at the manufacturer’s published prices or his invoice cost, whichever is less. Special handling such as supplier delivery and premium freight require advanced approval of the COR.
(c) First $500 - The Contractor shall be responsible under CLINS 0007, 1007,2007, 3007, and 4007 for the first $500 of total costs (total of labor, parts, materials, equipment, and if necessary, subcontract trade and professional services) applicable to each repair regardless of the number of occurrences of such repairs. Furthermore, repairs shall not be combined in order to bring the total cost over $500.
(d) Authorization for repairs in excess of $500 - The Contractor shall submit to the COR for approval a cost proposal based on costs as defined in above. The Contractor shall perform repairs whose total cost is in excess of $500 upon prior receipt of a duly executed fixed price RWA (Reimbursable Work Authorization) or delivery order (DOS Form 1089). For example, if the total repair cost $800, the RWA or delivery order will show $800 as the total cost, $500 as the Contractor’s responsibility, and $300 as the net amount to be paid to the Contractor. If the COR determines that the repair is of an emergency or urgent classification, the COR may verbally authorize the repairs, and the Contractor shall submit the next working day a cost proposal to the COR for approval. The COR shall confirm in writing no later than the next working day any verbal order. DOS reserves the right to furnish to the Contractor, any or all parts and/or materials required for any reimbursable repair. If the reimbursable repair work is to be totally or partially performed by a subcontractor, the Contractor shall obtain and provide to the COR three competitive subcontracting bids, unless three subcontracting bids are not practicable under the particular circumstances.
(e) Repair Performance Period - If a compactor becomes inoperative, the Contractor shall notify the COR immediately; the Contractor shall provide a qualified mechanic at the site to repair the equipment within four (4) hours. If repairs cannot be completed within sixteen (16) hours from the time the malfunction was first reported, the Contractor shall replace the equipment, at no cost to the Government, until repairs can be made. If unusual circumstances would preclude the completion of repairs within the required time, the Contractor shall notify the COR in writing of the reasons why the repairs cannot be completed within the required repair performance periods. If the stated reasons are justified as being beyond the control of the Contractor and outside the specified terms and conditions of the contract, the Government will allow more time for the completion of repairs on a case-by-case basis. If the stated reasons are not justified as being beyond the control of the Contractor, and are within the specified terms and conditions of the contract, the Government may award the work to be completed by a another Contractor. In such a case, the Contractor will be billed by the Government for the work.
(f) Repair Dollar Category: The decision as to which dollar category (up to $500 or in excess of $500) that each repair falls into will be made by the COR. In the event of a dispute, the Contractor may appeal the COR's decision to the CO. The Contractor shall proceed diligently with the performance of the repair, pending resolution of the appeal. All appeals claims will be processed in accordance with the "Dispute Clause" of the contract.

(b) All stake body trucks used to pick up loose debris shall be clearly marked with the truck bed's volume in cubic yards.
(c) All equipment necessary for the performance of the services under the contract must be available for inspection prior to commencement of the contract and ready for use at the designated DOS locations on the first day of service. DOS shall reserve the right to inspect any equipment at any time.
(d) Contractor may be required to furnish a list and location of equipment to be used in the performance of the contract.
(e) Government owned containers such as boxes, cans, trash carts, etc. shall not be removed from the premises.
(f) Maintenance of Equipment
