Source Selection Information – See FAR 2.101 and 3.104

SOLE SOURCE JUSTIFICATION
1. Identification of Agency and Contracting Activity.
The requiring activity is Explosive Ordnance Disposal (EOD) Group Two, Little Creek, Virginia; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting Department.
2. Description of the Action Being Approved.
This is a sole source action for the provision of local civilian range support services that are currently performed under Contract N0018916D0024. Contract N0018916D0024 was awarded 14 May 2016 on a competitive basis as a firm fixed-price contract to Academi Training Center, LLC, not a small business;
the existing contract expires on 30 April 2021.
3. Description of Supplies/Services.
The objective of this requirement is to acquire the service of a Contractor who will provide the required ranges which include shooting, and demolition. EOD Group TWO requires a low to no impact all-inclusive training support solution for the operational EOD team attending. All training ranges must be located within 50 miles of Joint Expeditionary Base Little Creek/FT Story, Virginia area. The Contractor shall provide all labor, materials, facilities, equipment and medical support including but not limited to all qualified staff where applicable or necessary to support training administered by EOD Group TWO personnel. Specific ranges and their estimated annual quantity, include the following: one-hundred and seventy-one (171) small arms range days, forty-eight (48) demolition range days, thirty-two (32) underwater demolition range days, thirty (30) advanced demolition range days, twenty-one (21) urban training area range days, thirty-one (31) modular training facility days, and twelve (12) shipboard and container stock range days.
The resultant contract will be funded with FY21 Navy Operations & Maintenance (O&MN) appropriations. The base period funds are currently available. Additionally, Task Orders will be funded utilizing O&MN appropriations of the fiscal year in which the Task Order is issued. The following chart details the estimated price for the overall effort (inclusive of 52.217-8):
4. Statutory Authority Permitting Sole Source.
The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority.
Academi Training Center, LLC is the only company within 50 miles of the command capable of providing the required range services. Academi Training Center, LLC has successfully completed the required services for the past five years. The predecessor contract was solicited as full and open competition;
however, only one quote was received and awarded to Academi Training Center, LLC. Up to date market research, as detailed below, revealed that Academi Training Center, LLC is the only company currently capable of providing the requested services due to their unique requirements such as providing underwater demolition ranges, along with the specific type of facilities required for EOD Group TWO to successfully perform their training requirements. No other range within 50 miles can provide the required facilities to support the mission needs. EOD Group TWO has confirmed the requirements as stated in the Performance Work Statement (PWS) are the minimum requirements to meet the Government’s needs.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.
Market research was performed using a myriad of resources to include a review of previous acquisitions for the same or similar requirements, discussions with the requiring activity and internet searches including the System for Award Management (SAM), GSA Advantage, and Seaport-NXG.
Market research revealed that current contract (N0018916D0024) was solicited as full and open competition; however, only one quote was received. In order to ascertain a more accurate and current representation of industry capability for this requirement, the Contract Specialist posted a sources sought notice to beta.sam.gov from 14 January 2021 to 05 February 2021. One (1) response was received and was analyzed by the Technical Representative at EOD Group TWO. The Requiring Activity reviewed the information provided by the firm that responded to the sources sought notice to ascertain if the responder is capable of meeting the Government’s minimum needs. Based on this review, the Requiring Activity determined that the responder does not possess the technical capability to perform the required tasks. Therefore, they were determined not capable. The contracting team reviewed the response to the Sources Sought Notice and concurred with the results.
In addition to the sources sought, the Contract Specialist contacted three local ranges located via the SAM research tool, to identify if they maintained the capabilities to perform the requested services. All three vendors responded that they could not perform the requested services.
Furthermore, market research has determined that the incumbent contractor, Academi Training Center LLC, can meet the government’s minimum needs.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the services covered by this Justification will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVSUP FLCN has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLCN will assess whether competition for future requirements is feasible.
