About this file

This justification document provides rationale for a sole source award of a federal contract for spill response training services. The justification cites the incumbent contractor's extensive experience and specialized knowledge of the required on-water training, as well as the complexity of the contract and potential duplication of costs and delays from transitioning to a new provider at this stage. Market research identified only the incumbent service-disabled veteran-owned small business as possessing the necessary technical capability to perform the tasks. The contracting officer determined the incumbent's quoted price to be fair and reasonable based on price analysis and past performance evaluation. Future requirements will be competed to the maximum extent practicable.

Justification for Award:

(1) As this final transition period nears completion, there is a reasonable expectation that award to a business other than LRS Gryphon JV would result in substantial duplication of costs that would not be recovered through competition and create unacceptable delays in training. Based on Naval Safety and Environmental Training Center specific transitional needs, LRS Gryphon JV is found to be the only service-disabled veteran-owned small business concern capable of providing the required services in accordance with FAR 19.1406, permitting a sole source award when the contracting officer does not have a reasonable expectation that offers would be received from two or more service-disabled veteran-owned small business concerns.

(2) Past experience and historical knowledge of training in hazardous spill response, specifically on-the-water training make them the most suitable candidate to continue the work.

(3) Complexity of the Contract: The contract has proven to be more complex than initially anticipated, requiring specialized knowledge and resourcefulness to complete all the deliverables and meet the objectives effectively, especially with on-the water training. LRS Gryphon JV's proved to be skilled at resolving critical issues quickly that, otherwise, would have placed additional burdens on the Echelon II, Naval Safety Command.

LRS Gryphon JV's has proven their competence, expertise, and capacity to deliver the training requirements effectively. Their technical proficiency, knowledge of the training, and successful record of accomplishment make them the most suitable candidate to continue the work. This follow-on contract will enable Naval Safety and Environmental Training Center to leverage LRS Gryphon JV’s, existing expertise, knowledge of the contract, and established working relationships to provide quality education and training for military and civilian Navy and Marine Corps Personnel, both afloat and ashore, in the areas of occupational safety, environmental protection and emergency management.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any. Market research was conducted by the Contract Specialist in conjunction with Naval Safety and Environmental Training Center to identify possible sources with the capability to meet the Government's needs. Four vendors responded to the Source Sought Notice (including one SDVOSB). The requiring activity reviewed all provided information to ascertain whether any of the respondents were capable of meeting the Government's minimum need for this procurement. Based on that review, a determination was made that only one of the respondents possessed the technical capability (LRS Gryphon JV ) to perform the required tasks and meet the Government's minimum need. Therefore, the market research indicates that there is only one SDVOSB, LRS Gryphon JV, capable of satisfying the requirement.

7. Determination of Fair and Reasonable Cost. A determination of fair and reasonableness of price will be based on the Contracting Officer's price analysis of the contractor's quote and a comparison of previous pricing history in accordance with FAR 13.106-3. Additionally, an assessment ofLRS Gryphon JV's past performance will be completed utilizing the System for Award Management (SAM). The method of evaluation used is solely within the discretion of the Contracting Officer. The contracting officer anticipates that the cost to the Government will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition. This acquisition is a non-competitive follow-on to a contract previously awarded on a non-competitive basis. As such, and in accordance with DFARS 213.S0l(a), there is a requirement to include additional documentation required by DFARS 206.303-303-2(b) (i) and follow the procedures at PGI 206.304(a) (s-70).

IAW DFARS 206.303-2(b)(ii) and PGI 206.304 (a)(S-70), a source sought notice was issued on l 0 July 2023.

Based on the review, the Requiring Activity determined that none of the respondents other than LRS Gryphon JV possesses the technical capability to perform the required tasks.

Furthermore, IAW DFARS 213.501 (a) (i), a copy of the previous justification was included in the review package to assist the approving authority in determining whether the planned actions to remove any barriers to competition cited on the previous- justification were completed. The contracting officer reviewed the previous justification that stated actions to remove barriers to future competition would include synopsis of the requirement and public availability of the justification to promote competition for future requirements. The contracting officer confirmed these actions were completed. As such, the planned actions to attempt to remove the barriers to competition cited on the previous justification have been completed. The circumstances requiring the acquisition being conducted pursuant to FAR 13.501 (a) remain unchanged. Any subsequent follow-on requirements will be handled on a case-by-case basis. Market research will be conducted for any future requirements to determine if there are any potential sources for competition.
