SOLE SOURCE JUSTIFICATION

1. Identification of Agency and Contracting Activity.

The requiring activity is NCTAMS LANT Pensacola Division, N94; Pensacola, Florida. The contracting activity is Naval Supply Systems Command (NAVSUP) Fleet Logistics Center (FLC) Norfolk.

2. Description of the Action Being Approved.

This is a sole source action for the provision of Cable Maintenance support services that are currently performed under Contract N7027222P0020. Contract N7027222P0020 was awarded 21 September 2022 on a sole source basis as a firm fixed-price contract to BellSouth Telecommunications; the existing contract expires on 24 September 2023.

3. Description of Supplies/Services.

The purpose of this contract is to provide maintenance support to telecommunications voice and data circuits beyond the established demarcation sites utilizing existing facilities. Contract scope includes resolving troubles, and provide minor repairs and maintenance services (e.g., replacing pedestals, repairing termination blocks, running jumpers, replacing patch cables, changing out splice cases, placing cable stubs, hand-pulling inner-duct and cable, and repairing damaged cables that can be hand-dug or in manholes, etc.) for the base telephone cabling infrastructure. The quantity of user requirements may vary throughout the length of this contract at no additional cost to the Government. The contract includes the BellSouth Telecommunications owned telephone cabling and infrastructure referred to as CESL-177. The proposed contract will include a base period beginning 25 September 2023 through 24 September 2024 with four option years and includes up to an additional 6 months of service if required by the Government in accordance with (IAW) FAR 52.217-8.

The resultant contract will be funded with FY23 Navy Operations & Maintenance (O&M,N) appropriations. These funds will be provided prior to the award. Options will be funded utilizing appropriations (O&M,N) of the fiscal year in which the option year is exercised.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 41 U.S.C. 1901, Simplified acquisition procedures - a sole source acquisition using simplified acquisition procedures for the acquisition of commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority.

Approximately 90% of all telecommunications cables of the outside cable plant have been owned by BellSouth Telecommunications since 1920 and the remaining 10% is owned by the Government. The cables have unlimited longevity if properly maintained.

In a letter from for BellSouth Telecommunications (Attachment I), BellSouth Telecommunications does not permit third parties, which are not under their direct control, to service their cables. As such, BellSouth Telecommunications will not allow the Government to directly contract with a third party. The Government confirmed on 15 December 2022 that the content of the letter is still accurate.

The Government cannot infringe upon BellSouth Telecommunication’s property rights and could be held liable for any damages that occur to the infrastructure as a result of any actions taken by the Government or a third-party. In addition, BellSouth Telecommunications is not responsible for making any repairs due to damages caused by the Government or a third party.

Any competitive solicitation and subsequent award to a Contractor other than BellSouth Telecommunications would result in a substantial duplication of cost to the Government, that could not be recovered through competition; as that Contractor would have to either a.) remove and install cables across the installation; or b.) purchase the telecommunications infrastructure from BellSouth Telecommunications.

a. To remove and install new cables would require the replacement of over 6,000 cable lines at

Corry Station, Saufley Field and Naval Air Station (NAS) Pensacola sites. Replacing these cables would not only be time consuming, but would also create a disruption of service throughout all locations.

b. The Government previously considered purchasing the infrastructure from BellSouth

Telecommunications; however, ultimately decided against it due to the cost.

c. Pursuant to the statutory authority and supplemented with the preceding rationale, it is recommended and in the best interest of the Government to make a sole-source award to BellSouth Telecommunications as the sole proprietor of Corry Station, Saufley Field, and NAS Pensacola cable infrastructure.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a Description of Market Research, if applicable, and a List of Interested Sources, if any.
