About this file

This is a Performance Bond document for the City of Meriden's B027-10 Merimere Water Tank Rehabilitation project located at 568 Reservoir Avenue, Meriden, Connecticut. The project encompasses the rehabilitation of the Merimere Water Storage Tank (MWST), a 55-foot diameter tank with a capacity of 560,000 gallons originally constructed in 1964. The scope of work includes removal of existing coating systems, weld seal repairs, surface preparation, application of new NSF-certified coating systems, concrete foundation (chime) repairs, installation of a new roof vent, and modification of the exterior shell to roof ladder. The bond serves as a guarantee that the selected contractor will promptly and faithfully perform all work in accordance with the contract terms and conditions, with the surety liable for completion costs up to the bonded amount if the contractor defaults.

The performance bond establishes a two-year statute of limitations for claims filed by the Owner and specifies that the surety may remedy defaults by either completing the contract as originally specified or obtaining bids from responsible parties to complete the remaining work. The project is funded through the Environmental Protection Agency, which requires compliance with Federal Labor Standards Provisions and Davis-Bacon and Related Acts prevailing wage requirements. The bond requires the contractor and surety to be jointly and severally liable for the full performance of all contractual obligations, with the surety waiving notice of any alterations, defaults, or contract extensions made by the Owner. No right of action exists for any party other than the City of Meriden or its successors.
