The Contractor, under this Contract, can provide applicable services to the State of Minnesota and/or CPV members, hereinafter referred to as Owner.

All policies shall remain in force and effect throughout the term of the Contract.

NOTICE TO THE CONTRACTOR:

The failure of the State of Minnesota to obtain Certificate(s) of Insurance, for the policies or renewals thereof or failure of the insurance company to notify the State of the cancellation of policies required under this Contract shall not constitute a waiver by the Owner to the Contractor to provide such insurance.

The Owner will reserve the right to immediately terminate the Contract if the Contractor is not in compliance with the insurance requirements, and the Owner retains all rights to pursue any legal remedies against the Contractor. In the event of a claims dispute, all insurance policies must be open to inspection by the state, and copies of policies must be submitted to state’s authorized agent upon written request.

Exhibit C: Specifications, Duties, and Scope of Work

The work covered under this Contract shall consist of the labor, equipment, materials, tools, transportation and incidentals necessary to perform the services, as described below.

The Lindala Closed Landfill operated from 1973 to 1990 with final cover construction completed in 2000 during which a passive gas venting system was installed. Two washouts were observed at and adjacent to manhole MH #3. Two areas of the landfill cover require reseeding due to poor vegetative growth following previous repair work. Services shall include the excavation and replacement of damaged stormwater control piping, securing piping to a manhole, reseeding of landfill cover areas, and restoration of disturbed areas. Attachment A includes figures which display the layout of the Site, identify seeding and pipe repair locations/details, and provide information on as-constructed conditions at the site.

LOCATION OF WORK: Lindala Closed Landfill (Site), 5407 County Road 3 Northwest, Annandale, Minnesota, 55302.

CONTRACTOR – A contractor for the State of Minnesota hired to perform the scope of services included in this Contract.

MPCA CONTRACTOR – A contractor for the State of Minnesota (GHD Services, Inc.) hired as MPCA’s representative to oversee and provide contract administration for the scope of services included in this Contract.

CONTACT: All inquiries, information, and coordination with the Owner relating to the scheduling of work, use of the site, and similar matters shall be directed to MPCA Contractor:

Johan Hedblom GHD Services, Inc.

900 Long Lake Rd, Ste # 200 St. Paul, MN 55112 Ph. 612-524-6839 Email: johan.hedblom@ghd.com

SCHEDULE/TIME OF COMPLETION - CONTRACTOR shall commence work upon receipt of both the executed copy of the CONTRACT and notification by the MPCA CONTRACTOR to commence work. The project shall be substantially complete by June 22, 2024. Final completion is June 22, 2024.

Substantial Completion – Defined to consist of all site work with the exception of vegetation maintenance and establishment, and certification of final off-site disposal of waste(s) if required.

Final Completion – Defined to consist of all site work, submittals, and final acceptance by STATE CONTRTACTOR for full performance of the work of this Contract.

PART 1 GENERAL

DESCRIPTION OF WORK

The Works include but are not limited to the following:

• Project startup including mobilization to the Site.

• Development, implementation, and maintenance of a Site-Specific Health and Safety Plan.

• Excavation to depth of damaged corrugated polyethylene pipe (CPEP).

• Replacement of damaged CPEP.

• Grouting CPEP to manhole connections and pipe couplings.

• Backfill of excavation and import of fill material.

• Grading of backfilled areas to maintain drainage and match existing grades.

• Site restoration and seeding of work areas.

Rev. July 2023 SWIFT Event # 2000015680

• Additional seeding of 0.22-acres shown on Figures.

• Demobilization and closeout.

EXISTING CONDITIONS

• Investigation has found that the 12-inch CPEP inlet piping failed approximately 18-feet uphill of the manhole, resulting in a washout approximately 30-inches in diameter by 30-inches in depth to the top of the damaged pipe. This piping is located above the landfill geosynthetic cover.

• A second washout is beginning to form immediately adjacent to manhole MH #3 on the downhill side.

Investigation shows that the 12-inch CPEP inlet piping and 24-inch CPEP outlet piping have collapsed at the piping penetrations into the manhole due to the load of overlying soils.

• There are two areas on top of the landfill cover totaling approximately 0.22-acres in size which were disturbed during previous settlement repair work. These areas require additional seeding due to poor growth realized following the previous work.

FIGURES

• Attachment A includes figures detailing existing conditions at the Site and repair details including the following:

o Figure 1 – Site Overview o Figure 2 – Culvert and Seeding Repairs Locations o Figure 3 – As-Constructed Manhole Details o Figure 4 – Piping Layout o Site Photos

ADMINISTRATIVE REQUIREMENTS

Mobilization and Startup

• Do not mobilize to the Site without MPCA CONTRACTOR’s prior written authorization. Ensure insurance as required by the Contract Documents is in full force.

• Perform planning and scheduling activities as necessary for the performance of the Works.

• Purchase materials and mobilize equipment, supplies, and incidentals to the Site.

• Furnish submittals as required by these Specifications.

Coordination:
