About this file

This is a Justification for Other Than Full and Open Competition document from the Federal Bureau of Investigation (FBI) for procuring a specialized microspectrophotometer. The FBI intends to sole-source a CRAIC 2030PV PRO UV-VIS-NIR Microspectrophotometer to CRAIC Technologies, Inc., a small business located in San Dimas, California. The instrument is for the Trace Evidence Unit and includes advanced features such as UV-VIS-NIR spectral range (200-1,000 nm), transmission and fluorescence illumination, polarization capabilities, and NIST traceable standards.

Key procurement details include a one-time, firm-fixed-price contract under the simplified acquisition threshold. The FBI has previously purchased microspectrophotometers from CRAIC Technologies in 2008 and 2010 and requires this new instrument to replace aging equipment. The solicitation allows other vendors to demonstrate capabilities by 9:00 AM EST on July 24, 2025, via email. CRAIC is deemed the sole responsible source due to unique technical specifications, being the only US-based manufacturer of microspectrophotometers, and ability to provide on-site customer service without international complications.

FEDERAL BUREAU OF INVESTIGATION

PROCUREMENT SECTION

JUSTIFICATION FOR OTHER THAN FULL

AND OPEN COMPETITION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH

TITLE 41 U.S.C 3304(A)(1)

Less Than the Simplified Acquisition Threshold, ($250,000.00)

Requisition Number: SHOP-PR-25-001308

Date: July 11, 2025

Estimated Contract Dollar Value: $________________

1. Identification of the agency and contracting activity.

The U.S. Department of Justice, Federal Bureau of Investigation (FBI), Procurement Section (PS), National Acquisition Programs Unit (NAPU), has prepared this justification for other than full and open competition for a single microspectrophotometer instrument on behalf of the Trace Evidence Unit (TEU), Scientific Analysis Section (SAS), Laboratory Division (LD).

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

The proposed action is to award a one time, sole-source, open-market, firm-fixed-price contract to CRAIC Technologies, Inc., (CAGE Code 3B3B0), 948 N. Amelia Avenue, San Dimas, California, 91773 to acquire a turnkey UV-VIS-NIR microspectrophotometer with 200 – 1,000 nm spectral range, Transmission and Fluorescence illumination, polarization capabilities, and NIST traceable standards for verifying microspectroscopy performance.

CRAIC Technologies, Inc. is a small business.

3. A description of the supplies or services required to meet the agency’s needs.

The FBI’s mission is to protect and defend the United States against terrorist and foreign intelligence threats, to uphold and enforce the criminal laws of the United States, and to provide leadership and criminal justice services to federal, state, municipal, and international agencies and partners; and to perform these responsibilities in a manner that is responsive to the needs of the public and is faithful to the Constitution of the United States.

Requisition Number: SHOP-PR-25-001308 Version 1.0 Page 2 of 6

The Trace Evidence Unit (TEU) supports the investigative priorities of the FBI and law enforcement community by providing scientific examinations of physical evidence in the areas of hairs, fibers, fabric, cordage, soil, glass, geological materials, building materials, and skeletal material.

Microspectrophotometry measures the color of fibers and is a mandated part of the technical procedure for fiber comparisons.

The FBI purchased an MSP 121 microspectrophotometer from CRAIC Technologies July 2010.

The FBI purchased a QDI 2010 microspectrophotometer from CRAIC Technologies March 2008.

The QDI 2010 is no longer operational, and the MSP 121 computer is failing and cannot be upgraded, (currently operating on Windows 7 with CRAIC software that is required to operate the MSP 121). By purchasing a new CRAIC 2030PV PRO UV-VIS-NIR Microspectrophotometer instrument, the FBI can take parts from the MSP 121 and QDI 2010 and use them on the new instrument, (e.g. objectives with quartz components). Therefore, these components do not have to be purchased as part of the new instrument. The new instrument is planned to replace both the QDI 2010 and MSP 121. CRAIC is the only American based Microspectrophotometer (MSP) company that will meet the needs of TEU and be able to provide on-site customer service over the instruments lifespan without having to bring a foreign national into FBI space or deal with lengthy time differences to make service calls.

The current standard operating procedure (SOP) for microspectrophotometry includes utilizing CRAIC microspectrophotometers which have been in use at the FBI Laboratory for almost two decades. Upon completion of the on-site installation task, the 2030PV PRO can be validated for use in casework in less than one week.

The following individual items combine to make the single microspectrophotometer instrument:

CRAIC Technologies is the only manufacturer of microspectrophotometers that is based in the USA.

Federal law imposes several restrictions requiring federal agencies to acquire items that are produced or manufactured in the United States (U.S.). The Buy American Act of 1933 (BAA) requires the United States government to prefer U.S. made products in its purchases. The BAA and implementing regulations in the FAR provide a two-part test for determining if a product qualifies as a domestic product: (i) the item must be manufactured in the United States, and (ii) more than 55 percent of the cost of all the component parts is also manufactured in the United States.

Requisition Number: SHOP-PR-25-001308 Version 1.0 Page 5 of 6

The FAR provides various waivers and exceptions to the BAA: Inconsistent with the public interest;

Domestic non-availability; Unreasonable cost; Resale by Commissary; Information technology (IT) that is a commercial item; and Application of the Trade Agreements Act (TAA).

On 1/25/2021, the President directed several changes with respect to the implementation of “Made in America Laws” under Executive Order 14005. As a result, the Office of Management and Budget (OMB) has created a Made in American Office (MIAO), within OMB. The MIAO will review procurement non-availability waivers to the Buy America Act (BAA) and the Jones Act.

9. Any other facts supporting the use of other than full and open competition.

See section 5 above.

10. A listing of any sources that expressed a written interest in the acquisition.

A synopsis will be posted on the SAM.gov website. This synopsis will give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of technical capabilities and cost information.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

The FBI will continue to conduct market surveys and research available through industry shows and technology releases in the form of papers and journals. This will be used to identify potential sources for subsequent acquisitions. If potential sources are identified, it will be necessary to submit to both extended compatibility and validation studies if the products are to be added to the TEU laboratory process. The FBI Laboratory holds itself to the highest standards within the forensic community and ensures that any technology used is proven, tested technology.
