About this file

This document is a Justification and Approval (J&A) for Other than Full and Open Competition for the procurement of a replacement Spartan Robot Controller by the Federal Bureau of Investigation (FBI).

The FBI possesses robots manufactured by REMOTEC, Inc. and requires replacement parts due to normal wear and tear. REMOTEC, Inc. is the sole manufacturer and distributor of these proprietary parts, including the Spartan controller. The FBI intends to conduct a sole source negotiation with REMOTEC, Inc. under the authority of FAR 6.302-1, as no other sources can provide the required compatible replacement part. The FBI will post a 10-day notice of intent to sole source on SAM.gov to allow for any potential responses from other vendors, though the FBI has confirmed that REMOTEC, Inc. is the only source for this requirement. The FBI needs this controller to maintain its ability to train personnel and conduct safe field operations with the highest reliability on the REMOTEC robots, which are industry standard equipment.

FEDERAL BUREAU OF INVESTIGATION

FINANCE and FACILITIES DIVISION | PROCUREMENT SECTION

JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND

OPEN COMPETITION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

IN ACCORDANCE WITH 41 U.S.C. 3304 (A) (1)

Spartan Controller Replacement 0384

1. Identification of the agency and contracting activity.

The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), has prepared this justification for other than full and open competition for a replacement Spartan Robot Controller on behalf of the Critical Incident Response Group (CIRG).

2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.

This is intended to be a one time, firm fixed price, sole source award to REMOTEC, Inc, Address: 353 JD Yarnell Industrial Parkway Clinton, TN 37716.

3. A description of the supplies or services required to meet the agency’s needs.

This requirement is to replace an existing REMOTEC, Inc. controller for the Spartan robot. The FBI possesses robots manufactured by REMOTEC, Inc. These robots require part replacement due to normal wear and tear. This is a sole source requirement, in which replacement parts must be compatible with the existing equipment.

4. The statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1, entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.

The FBI possesses robots manufactured by REMOTEC, Inc. These robots require part replacement due to normal wear and tear. These robots are proprietary to REMOTEC, Inc., and they are the only manufacturer and distributer of these parts. The Government intends to negotiate with only one source under the authority of FAR 6.302-1.

To meet agency needs, the FBI must train students with equipment and conduct safe field operations with the highest reliability. This controller will allow personnel the ability to use the robots and conduct the maintenance and repairs used during training. These robots and their parts are manufactured and supported solely by the manufacturer, REMOTEC, Inc. In the furtherance of the FBI’s mission, the controller will give the FBI the ability to train public safety bomb technicians in the correct usage of this equipment, which is industry standard.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

A Notice of Intent to Sole Source will be posted to SAM.gov for 10 days to allow potential vendors to respond to this requirement.

7. A description of the market research conducted and the results.

Knowledgeable individuals in the Government and industry were contacted regarding market capabilities to meet requirements. No other vendors were discovered who could provide this product, as it is a direct replacement part for current robotics and must integrate seamlessly with the existing equipment. In response, REMOTEC, Inc. provided a Sole Source letter confirming that they are the sole provider of this controller.

8. Any other facts supporting the use of other than full and open competition.

NA

9. A listing of any sources that expressed a written interest in the acquisition.

A Notice of Intent to Sole Source will be posted for 10 days to allow vendors to submit their capability statements, should they be able to meet the government’s requirement.

10. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

To overcome any barriers to competition, Market Research will continuously be conducted to learn of new products and vendors.
