STATEMENT OF WORK (SOW)

PERSONAL ASSISTANCE SERVICES (PAS)

1. SCOPE

The contractor shall provide qualified personnel to provide Personal Assistance Services (PAS) for Fleet Readiness Center Southeast (FRCSE) personnel. The contractor’s PAS personnel and FRCSE personnel will be co-located and may be at either one of the FRCSE facilities in Florida on Naval Air Station Jacksonville and Cecil Commerce Center, Jacksonville, in addition to the personal residence of the FRCSE personnel at times of telework.

2. BACKGROUND

2.1 The U.S. Equal Employment Opportunity Commission (EEOC) regulations implementing Section 501 of the Rehabilitation Act of 1973, the law that prohibits the federal government from discriminating in employment based on disability, require that as part of the obligation to engage in affirmative action, federal agencies provide PAS to individuals who need them because of certain disabilities. The EEOC regulations implementing the Rehabilitation Act in the Federal sector are found at 29 C.F.R. §1614.203.

2.2 While Federal agencies are generally prohibited from expending appropriated funds on personal expenses for employees, the restrictions do not apply to services that the government is legally required to provide, such as those required under the Rehabilitation Act. It is the Department of the Navy’s policy to provide PAS to its employees in accordance with the regulations, absent undue hardship on the agency. Navy commands can use independent contractors to provide PAS.

2.3 PAS are services that help individuals who, because of targeted disabilities, require assistance to perform basic activities of daily living, like eating and using the restroom. PAS allow such individuals to enjoy the opportunity and independence offered by paid employment. Federal agencies must provide PAS to employees who have targeted disabilities unless doing so would impose an undue hardship on the agency.

2.4 “PAS" is defined in the regulations as "assistance with performing activities of daily living that an individual would typically perform if he or she did not have a disability and that is not otherwise required as a reasonable accommodation, including, for example, assistance with removing and putting on clothing, eating, and using the restroom." The regulations do not attempt to list every activity that might constitute PAS. PAS do not include helping individuals with disabilities perform their essential job functions. In addition, PAS do not include performing medical procedures (e.g., administering shots) or medical monitoring (e.g., monitoring blood pressure).

3. REQUIREMENTS

3.1 PAS. as required herein, shall consist of contractor personnel who aid one or more FRCSE employees in performing activities of daily living in the workplace as defined in the EEOC regulations. A list of specific activities that have been identified as those for which assistance is required at this time are provided in the attached Table 1. Though, not every activity that may constitute required PAS is listed on this table.

3.2. One (1) FRCSE employee will require PAS for each entire workday.

3.2.1 PAS may be required at times when the FRCSE employee is working outside their normal working hrs. Based upon historical data, sixteen hours (16) of support will be required monthly.

3.2.2 PAS are not required when the employee requiring such services is off duty. The contractor will be notified through an agreed upon notification process (e.g., phone, email, etc.) when services are not required.

3.3 The contractor’s PAS personnel will be assigned to a FRCSE employee by the Government Point of Contact (GPOC). Consistent with the EEOC regulations, the contractor’s PAS personnel may be assigned to more than one FRCSE employee during the workday.

3.4 PAS will be provided in various settings such as an office setting, conference room, training room, and industrial workspaces, as well as a home telework setting. Sitting more than six (6) hours should be expected.

3.5 The contactor’s PAS personnel shall be trained in the proper use of Personal Protective Equipment (PPE) for eye, ear, and foot hazards. Appropriate PPE will be furnished by the Government in accordance with Section 4 below for work performed in the industrial spaces. Such work may involve exposure to moving objects, noise, dust/debris, confined spaces, and industrial machinery.

3.6 The contractor shall be required to comply with the training, determination of competency, and initial and annual validation requirements of Florida Statute §393.506 with respect to the administration of medication (see Table 1) by an unlicensed direct service provider. This requirement shall not apply to the contractor’s PAS personnel who is a family member or friend of the FRCSE employee receiving the service and who provides medication assistance without compensation, as permitted by Florida Statute §464.002(1), to that employee when in a non-duty status.

3.7 The contractor’s PAS personnel shall arrive to perform services on time. The contractor shall have alternate PAS personnel in place if/when their regular personnel is/are unable to perform services.

3.8 The contractor shall be responsible for the competency and conduct of their own personnel and for taking disciplinary actions with respect to their employees. The removal from the job site of contractor personnel shall not relieve the contractor of the requirement to provide personnel to perform the specified tasks outlined in this SOW.

3.9 The Government reserves the rights to deny access to any contractor employee to enter FRCSE if their presence would be detrimental to the FRCSE’s mission or performance of work in this SOW.

The Government reserves the right to require removal of any contractor employee from the job site who endangers persons or property or whose continued presence is inconsistent with the FRCSE mission. In such cases, the GPOC will advise the contractor of the reason for requesting an employee’s removal from the worksite or withdrawing his/her authorization to enter the installation.

3.10 The contractor’s PAS personnel shall not release any non-public information obtained via their services at FRCSE to any entity not directly engaged in providing services under this contract without prior written approval of the GPOC.

4. GOVERNMENT-FURNISHED EQUIPMENT (GFE)

The Government will furnish appropriate PPE when required, to include safety glasses, hearing protection devices and steel toe safety shoe covers.

5. PERIOD OF PERFORMANCE

Base Period:11 July 2024 - 10 July 2025
Option 1:11 July 2025 - 10 July 2026
Option 2:11 July 2026 - 10 July 2027
Option 3:11 July 2027 - 10 July 2028
Option 4:11 July 2028 - 10 July 2029

6. WORK SCHEDULE

FRCSE core business hours are 0600 to 1530, Monday through Friday. FRCSE employees have the flexibility of choosing to work a straight 8-hour workday schedule, Monday through Friday or work an alternate Compressed Work Schedule (CWS) wherein workdays are 9 hours on Monday through Thursday, with one Friday an 8-hour workday and the other Friday off. Therefore, on a CWS within a two-week pay period, one week is a 44-hour work week and the other week is a 36-hour work week. This is excluding federal holidays, installation closure, FRCSE shutdowns, severe weather closure, and furlough periods. The FRCSE employee requiring PAS may choose to be on either a straight 8-hour workday schedule or CWS so the contractor PAS personnel must align their days and hours of work to exactly align with the FRCSE employee they are assisting. After hours’ support will be required to support urgent FRCSE personnel that require PAS assistance to prevent loss of capability, production, damage to equipment, and/or have the potential for causing injuries to personnel.
