About this file
This is a user agreement form from the Sacramento County Probation Department governing access to confidential criminal justice information systems. The form applies to employees, volunteers, affiliates, and contractors of the Sacramento County Probation Department who may access California Law Enforcement Telecommunications System (CLETS), Criminal Justice Information System (CJIS), WebKPF, Parole Leads, or Department of Motor Vehicle records. Access to this information is strictly controlled by "need to know" and "right to know" principles, meaning users must have both a legitimate business purpose and legal authority to access records. The agreement emphasizes that misuse of criminal justice information may violate multiple statutes, including Penal Code Sections 502, 11105, 11141-11143, 13300, 13302-13304, Government Code Section 6200, and California Vehicle Code Section 1808.45.
Users who sign the agreement acknowledge understanding the policies governing misuse of criminal justice accessible information and accept that violations may result in immediate dismissal from employment, termination of system access authority by the subscribing agency, county control host, Department of Justice, or FBI NCIC, and potential criminal and civil action. The form serves as a binding acknowledgment that the signatory has read and comprehends the restrictions and legal consequences associated with accessing and handling sensitive criminal justice records maintained by Sacramento County Probation Department.

SACRAMENTO JUSTICE PORTAL USER AGREEMENT FORM
USE OF CLETS - CJIS - WEBKPF – PAROLE LEADS OR ANY CRIMINALJUSTICE INFORMATION OR
DEPARTMENT OF MOTOR VEHICLES RECORD INFORMATION
As an Employee, Volunteer, Affiliate, or Contractor of the SACRAMENTO COUNTY PROBATION DEPARTMENT you may have access to confidential criminal records, Department of Motor Vehicle records, or other criminal justice information, much of which is controlled by statute. All access to California Law Enforcement Telecommunications System (CLETS) or any other type of Criminal Justice related information obtained through aforementioned applications is based on the “need to know” and the "right to know." Misuse of such information may adversely affect an individual’s civil rights, and violates the law and/or - CLETS National Crime Information Center (NCIC) - Policy.
"Need to know" means you have a legitimate business purpose in accessing the information. "Right to know" means you have legal authority pursuant to both law and Department policy to access the information. To access information the "need to know" and the "right to know" must exist at the same time.
Penal Code Section 502 prescribes the penalties relating to computer crimes. Penal Code Sections 11105 and 13300 identify who has access to criminal history information and under what circumstances it may be released. Penal Code Sections 11141-11143 and 13302-13304 prescribe penalties for misuse of criminal history information. Government Code Section 6200 prescribes the felony penalties for misuse of public record and CLETS information. California Vehicle Code Section 1808.45 prescribes the penalties relating to misuse of Department of Motor Vehicle record information. Penal Code Sections 11142 and 13303 state:
"Any person authorized by law to receive a record or information obtained from a record who knowingly furnishes the record or information to a person not authorized by law to receive the record or information is guilty of a misdemeanor."
Any Employee, Volunteer, Affiliate, or Contractor of the SACRAMENTO COUNTY PROBATION DEPARTMENT who is responsible for any CRIMINAL JUSTICE ACCESSIBLE INFORMATION misuse, is subject to immediate dismissal from employment. User misuse may result in the termination of authority to access aforementioned application systems by The Subscribed Agency, The County Control Host, The DOJ or The FBI NCIC. Violations of the law may result in criminal and/or civil action.
I HAVE READ THE ABOVE AND UNDERSTAND THE POLICY REGARDING MISUSE OF ALL CRIMINAL
JUSTICE ACCESSIBLE INFORMATION.
