FAR 52.212-2, EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

Evaluation will be based on the LOWEST PRICE TECHNICALLY ACCEPTABLE (LPTA) method. “Technically Acceptable” shall consist of meeting all of the acceptability standards/non-cost factors. In order to achieve the “Acceptable” rating the Quoter must achieve a Pass (P) rating as opposed to Fail (F) rating for each of the TWO (2) non-cost factors (Technical Capabilities (all elements) and Relevant Past Performance). Failure to achieve a Pass rating for all of the factors shall result in “Unacceptable” as opposed to “Acceptable” overall rating. Quotes will be evaluated for acceptability but not pointed scored or ranked using the non-cost/price factors.

The following acceptability standards/ non-cost factors will be used to evaluate the offers received:

FACTOR 1 - TECHNICAL CAPABILITIES

Technical acceptability will be based on the Offeror’s ability to clearly demonstrate an understanding of the requirements outlined in the RFQ and how its approach successfully accomplishes the minimum requirements and key performance task areas described in the Performance Work Statement (PWS). The approach shall fully address the following areas:

1. Approach to accomplishment of tasks defined within the requirements as detailed within the PWS. The Government will focus on whether the Offeror has proposed an overall plan, methods, procedures and resources that are capable of accomplishing the requirements. Special resources, such as subcontractors, to obtain knowledge, skills and/or materials required to perform each of the tasks shall be addressed.

2. Training and Experience. The Offeror shall be trained and experienced in the performance of preventive maintenance services on Nasatka Maximum Security Barrier Equipment. Offeror’s experience will be determined by acceptable past performance.

3. Key Personnel. The Offeror shall provide resumes for all technicians potentially assigned to this award.

4. Technician Education and Experience. All maintenance shall be performed by qualified technicians specifically trained to work on hydraulic/electric barrier systems. Technicians shall have a minimum of 3-years’ experience working on Nasatka Maximum Security Barrier Equipment.

Provide at least three (3) Relevant Past Performance references under contracts or efforts (currently being performed or performed within the past five years) that are of a similar, directly related scope, magnitude and complexity to that which is described in the PWS. Quoters MUST submit their Relevant Past Performance references on the attached “Past Performance Reference Information Sheet”. Offeror shall not submit relevant past performance for completed DOC/OSY contracts. Where sub-contracting arrangements are proposed, an additional maximum of three (3) projects/contracts within last five

(5) years for the subcontractor or other partner shall be submitted. For each submitted project/contract, the Quoter shall include references with current points of contact (telephone number and email address. An evaluation of relevance will be done for no more than three (3) projects submitted by the Quoter. The Quoter is therefore cautioned to submit only its three most relevant efforts. If the Offeror submits more than three projects for consideration, only first three as displayed within the quote from front to back will be considered.

The Government may verify past performance information. The Government may contact some or all of the references provided, as appropriate, and may collect information through questionnaires, telephone interviews and existing data sources to include but be not limited to Past Performance Information Retrieval Systems (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Contractor Performance Assessment Reporting (CPARS), or other databases. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. This past performance information will be used for the evaluation of past performance.

The evaluation team will review this past performance information and determine the quality and usefulness as it applies to the performance competence assessment.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
