COMBINED SYNOPSIS / SOLICITATION

Lead Acid Batteries for USCG Patrol Boats

Notice for Filing Agency Protests

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an

Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable

Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting

Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent

Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program.

Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted electronically to OPAP@uscg.mil and the Contracting Officer or by hand delivery to the Contracting Officer.

Election of Forum. After an interested party protests a Coast Guard procurement to the

Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.

The Government will evaluate equally, as regards time of delivery, quoters that propose delivery of each quantity within the applicable delivery period specified above. Quoters that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when a quoter proposes an earlier delivery schedule than required above. If the quoter proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of quoter mailed, or otherwise furnished to the successful quoter, results in a binding contract. The Government will mail or otherwise furnish to the quoter an award or notice of award not later than the day award is dated. Therefore, the quoter should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate a quoter that proposes delivery based on the

Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the proposed delivery date is later than the required delivery date, the quoter will be considered nonresponsive and rejected.

IX. EVALUATION CRITERIA

Quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below.

The following factors shall be used to evaluate quotations:

Factor 1 – Technical

Factor 2 – Past Performance

Factor 3 - Price

EVALUATION METHODOLOGY

The Government will award one (1) requirements contract to the quoter determined to provide the best value on the basis of all non-price and price related factors. The evaluation of quotes submitted in response to this solicitation shall be conducted utilizing the tradeoff process to obtain the best value to the Government. As part of the tradeoff determination, the technical and past performance factors will be evaluated utilizing confidence ratings in which quoters will be ranked. Price analysis will be performed by comparing the total evaluated price, including all ordering periods, of all technically acceptable quote submissions. The technical and past performance factors are significantly more important than price and the Government may award to other than the lowest priced quote based on the technical and past performance ratings.

Rating Definitions:

FACTOR 1: TECHNICAL

Written Technical Plan:

Demonstrate your ability to provide delivery, pick-up and disposal of lead acid batteries in the widest geographical territory possible. Describe how you will meet the requirement identified in the Attachment 3, Statement of Work.

1) Responses must include a detailed written plan addressing all aspects of the logistics methods proposed to meet the service requirements described below, and in the areas listed on Attachment 2, USCG Patrol Boat Homeport Battery Service Areas:

a) Vendor performed delivery, pick-up and disposal of lead acid batteries in normal logistics network areas.

b) Vendor performed packaging/unitization and direct drop shipment of batteries to remote service areas for routine and emergency orders to all locations.

Batteries proposed as equal to those listed on the CLIN must meet the salient physical, functional, or performance characteristics of the brand name item to be acceptable to the USCG.

Failure to submit acceptable alternatives in accordance with the performance specifications listed on the Attachment 4, Battery Specifications will be rated technically unacceptable.

Attachment 2, USCG Patrol Boat Homeport Battery Service Areas:

All lines in all columns must be filled out in accordance with the instructions found on

Attachment 2, along with a company official’s signature, title, and date. Vendors must be capable of providing vendor performed lead acid battery delivery, pick-up and disposal services to a minimum of 44 of the individual geographic service areas identified on Attachment 2 within specified lead times identified on the delivery schedule. Vendors who demonstrate the capabilities and propose to cover more service areas than the required minimum will be rated higher.

Warranty:

The minimum warranty and replacement requirement for this contract is a 24 month unconditional non-prorated replacement guarantee. Warranties that provide a guarantee exceeding 24 months will be rated higher. Less than a 24 month unconditional replacement will be rated technically unacceptable.

Delivery Schedule:

Failure to conform to the required delivery schedule will be considered unacceptable and not considered for award. A more favorable delivery schedule will be rated higher.

FACTOR II: PAST PERFORMANCE:

a. Provide up to three (3) Contract Performance Assessment Report System (CPARS) past performance assessments for relevant work performed within the past three (3) years from the solicitation closing date. In order to determine that the CPARS assessments are for relevant work performed, the contractor shall provide the following information (two (2) page limit for each assessment):

i. Contract/Order Number and Project Location

ii. Period of Performance

iii. Total Contract/Order Value (Original and Final)

iv. Contracting Officer Name, Phone Number & E-mail

v. Contract/Order Description, including how many batteries supplied annually

vi. Contract/Order Type (FFP, IDIQ, Requirements, Cost Type)

b. Past performance will be considered relevant if it is for supplying of lead acid batteries for the USCG, federal, state or local government or private contracts. In evaluating past performance, general trends in performance will also be considered. References other than those provided by the Quoter may be used by the Government to obtain additional information that will be used in the evaluation of the quoter’s past performance such as government databases and internal organization resources. You may provide information on problems encountered during the performance of any contract/order and any corrective actions made.

In the case for which there is no information on past performance or where past performance information is not available, the quoter may not be evaluated favorably or unfavorably. In this case, a performance confidence rating of "Neutral" will be assigned. For this requirement a

"Substantial Confidence" or "Satisfactory Confidence" past performance rating is worth more than a "Neutral" past performance rating.

FACTOR III – PRICE:

The price shall be evaluated to determine fairness and reasonableness. Provide prices for all

CLINS for all ordering periods. All prices on Attachment 1, SCHEDULE OF SUPPLIES –

CLIN shall be FFP and shall indicate FOB Destination as referenced in FAR 52.247-34 (NOV

1991). The total of all CLINS shall be added together to arrive at an aggregate total.

The vendor shall provide their proposed FFP for each CLIN in accordance with the instructions on Tab 1, by filling in the individual unit costs on Tab 2 of Attachment 1, SCHEDULE OF

SUPPLIES – CLIN. The vendors input in Column F will serve as the firm-fixed unit prices the vendor is obligated to honor under this contract for all ordering period(s).

For all battery shipping, pick up, and disposal to areas the contractor identifies as remote on

Attachment 2, USCG Patrol Boat Homeport Battery Service Areas, the Government shall reimburse the contractor for actual shipping costs in the form of a modification at the task order level.

Award may be made without any type of discussions.

X. FAR 52.212-3 OFFERER REPRESENTATIONS AND CERTIFICATIONS –

COMMERCIAL ITEMS (NOV 2021) applies to this solicitation and is incorporated by reference. Quoters must include a completed copy with its submission and must be registered in

SAM.gov to receive award.
