STATEMENT OF WORK

BACKGROUND:

Supply Chain challenges are not unique to VA. Due to the COVID-19 pandemic, we are experiencing the same challenges as every other hospital and hospital system in the country and the world. However, the magnitude of this global pandemic has provided the opportunity for some improvements. Prior to this pandemic, VA embarked on a supply chain transformation program designed to build an efficient and effective medical supply chain to maximize value to clinical customers and deliver real-time analytics capability to support fast and accurate enterprise decision making. Now, more than ever, this work is essential, and building resiliency in VA’s supply chain will ensure we stay prepared to meet our mission. Per Dr. Richard Stone, before the Committee on Veteran’s Affairs United States Senate, “VA must increase the amount of critical medical materiel each VAMC must maintain. Each VAMC must maintain 60 days of critical materiel including PPE. They were required to maintain 30 days of stock on hand before this change”. It is our intent to procure a Warehouse Management Service (WMS) solution that will enable our staff to continue our current workload.

1. GENERAL REQUIREMENTS

1.1 Contractor shall furnish all necessary labor, equipment, services and supervision required to render a complete WMS. Responsible for the pick-up, storage and distribution of Medical/Surgical supplies in support of Central Texas VA Health Care System at Temple: Olin E. Teague Medical Center, 1901 S. Veterans Memorial Drive, Bldg. 206, Temple, Texas 76504.

All supplies must be stored in a clean, uncluttered, and temperature/humidity-controlled environment free of rodents. Contractor site should be open and available to CTX to visually inspect to ensure compliance and security of all VA medical supplies. Contractor shall be ready to coordinate and receive initial storage of medical supplies within 10 days of award. The Contractor shall conduct a walk-through with the Contracting Officer's Representative (COR) or designee within 5 days of award to establish communication and provide Point of contact information.

1.2 Contractor shall be responsible for all management and supervision of the contract work.

Contractor and/or on-site supervisor shall be available at all times when the contract work is in progress, to receive notices, reports or requests from the COR. Contractor shall provide in writing to the Contracting Officer (CO) prior to the contract starting date, the name, telephone number and address of onsite supervision and/or project management.

1.3 Contractor shall provide complete WMS services for an average of 6 pallets, with expansion capabilities up to a maximum of 10 pallets per pickup. At a minimum the warehouse should measure 5,000 square feet to 8,000 square feet in dimension, should be equipped with a backup generator and multiple power sources. The Medical/Surgical supplies being stored may change based on the protocol set by the Center for Disease Control and Prevention (CDC), Veterans Health Administration (VHA) and, Central Texas VA Healthcare System and/or product availability.

2. SCOPE OF WORK

2.1 The warehouse facility shall be owned or leased by the contractor and shall be located within a 32-mile radius of the Olin E. Teague Veterans Medical Center located at 1901 S.

Veterans Memorial Drive, Temple, Texas 76504.

2.2 Contractor shall be responsible for relocating supplies from the current location.

2.3 Contractor shall comply with all applicable Federal, State, local and industry safety, i.e., OSHA, Department of Labor (DOL), and health standards, regulations and statutes pertaining to the operation of the warehouse and/or distribution of commodities identified or associated with this Statement of Work.

2.4 Contractor's facility shall meet all industry standards for fire alarm and suppression system for the commodities being warehoused. Facility shall also have individual 24/7 monitored alarm access and lockable doors.

2.5 Per VHA Directive 1761, warehouse storage location must have a stable environment without extreme changes in temperature and humidity. Items stored within these locations must comply with temperature and humidity requirements in accordance with manufacturer specifications. Heating, Ventilation, and Air Conditioning (HVAC) units that supply ventilation air to Logistics expendable supply storage locations are permitted to operate as originally designed, meeting codes and standards at the time of design/construction. VA Medical/Surgical Supplies shall be segregated by a cage or other defining material for quick identification purposes. Supplies shall be stored at a temperature/humidity-controlled environment not to exceed 78 (degrees) Fahrenheit and a humidity range of 20% to 60%. Temperature and humidity must be monitored on a daily basis.

2.6 Contractor shall maintain a real time electronic database of all medical supplies and PPE stored and cross reference this data with VA IFCAP numbers. Information shall contain item description, stock number, case quantities on hand, packaging multiples, vendor information, quantity per pallet, and pallet count.

2.7 Contractor shall provide full access for VA personnel for warehouse inspection during normal business hours (8:00AM - 4:30PM, Monday - Friday). In addition, access via individual keyed entry to the supply and products shall be available 24/7.

2.8 Contractor shall provide delivery of Medical/Surgical Supplies from the warehouse facility to the medical facility listed in this SOW. These deliveries will not be on a recurrent basis; the deliveries will be needed in emergency and non-emergency cases and as needed and requested by the VA. The warehouse will not require staff to man 24/7; the warehouse is required to be checked twice a week on Tuesday’s and Thursday’s by COR or appointed designee. During an emergency, supplies shall be delivered within 2 hours after notification, 7 days a week. Any other time, supplies shall be delivered within 24 hours after notification, Monday-Friday except when the next day is a weekend or holiday. If any of the stored Medical/Surgical Supplies are used, the VA will order the required supplies from the Medical/Surgical Prime Vendor or other approved sources to be delivered to the contractor’s warehouse facility to replenish the used supplies.

2.9 Per VHA Directive 1761 Access to the warehouse shall be restricted to authorized contracted personnel. Other persons with official business, and when accompanied by a contractor supervisor or designee, will be authorized entrance to the warehouse storage area.

2.10 The warehouse shall be equipped with Medical/Surgical supply storage racks capable of holding Medical/Surgical supplies with a weight compacity of 1000 pounds to 1500 pounds.

Pallets shall not be double stacked when stored. Space within the warehouse should be large enough for contractor to easily access and move supplies as needed. The lowest shelves in storage areas shall be solid and must have at least 8 inches of space between the floor and bottom shelf. This space will allow access for cleaning to avoid contamination. Top shelves and contents shall be arranged at least 5 inches from the ceiling and at least 18 inches from sprinkler heads. Items must be at least 2 inches from exterior building walls to avoid condensation and contamination. Space within the warehouse should be large enough for contractor to easily access and move supplies with forklifts, pallet jacks and/or other needed equipment.

2.11 All shipments will be bar coded, scanned, palletized and sealed prior to shipment to the Contractors facility and upon return. The pallets shall not exceed 72 inches or 500 lbs. Pallets shall not be double stacked when stored. When stored all SKU’s must be located together to allow for ease of inventory.

2.12 Request for Inbound and outbound shipments will be communicated via email from the COR or designee to the contractor. Once request has been established the Contractor will have 24 hours to delivery all requested supplies.

2.11 Contractor shall provide the COR the following:

• Weekly inspection reports of product inventory for expiration dates. Notify the COR of any product that expires within 12 months.

• All medical supplies shall be picked up from Bldg. 206 and taken to Contractor’s facility and segregated from all other supplies.

• The vendors database shall be capable of generating multiple reports in real time (live) electronic database of all medical supplies and PPE stored and cross reference this data with VA IFCAP numbers. Information shall contain item description, stock number, case quantities on hand, packaging multiples, expiration dates, vendor information, quantity per pallet, and pallet count.

• The contractor shall communicate any concerns or questions reference all incoming and outgoing medical supplies.

• During Start-up phase, the contractor shall be required to visit the site and work with the COR to identify all medical supplies that will be stored at the Contractor’s site.

• Contractor shall provide the COR a receipt of what supplies that were delivered and picked up.

• Contractor shall ensure that stored medical supplies are free from dust, rodents and insects while stored and delivered. The contractor will remove all corrugated boxes when delivered to CTX medical facility.

(d) Comptroller General Examination of Record. C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. (a) The Government may extend the term of this contract by written notice to the Contractor within 7 calendar days prior to contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 14 calendar days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

Technical Capability: Contractor shall furnish all necessary labor, equipment, services and supervision required to render a complete Warehouse Management Service (WMS) solution.

Contractor shall comply with all applicable Federal, State, local and industry safety, i.e., OSHA, Department of Labor and health standards, regulations/statutes pertaining to the operation of warehouse and/or distribution of commodities identified/associated within the Statement of Work.

Period for acceptance of offers: The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers.

Failure to submit a complete offer may result in a non-responsive determination.

(a) Definitions. As used in this provision—

Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education;

or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States;

and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2);

and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name.
